Resolution 8930006.900000 WSS /nkr 12/10/97 RESOLUTION NO. 893 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DECLARING TO BE IN THE PUBLIC INTEREST TO COMMENCE VACATION PROCEEDINGS FOR A PORTION OF THE PLATTED BUT UNBUILT RIGHT -OF -WAY OF 237TH PLACE SW, WEST OF 107TH PLACE SW (KNOWN AS WOODWAY MEADOWS), LOCATED IN THE CITY OF EDMONDS, RESERVING UTILITY EASEMENTS, SURFACE AND SUBSURFACE, ESTABLISHING A HEARING DATE, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City Engineer has reported to the City regarding rights -of -way, platted but unbuilt, which the City owns and which are suitable for vacation; and WHEREAS, many of these rights -of -way are either surplus to the needs of the City, or, due to terrain and other topographical features, are unsuitable for the construction of a roadway; and WHEREAS, the City Council wishes to initiate the vacation process, referring such matters for hearing to the City's Hearing Examiner for recommendation in accordance with the provisions of City ordinance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. The City Council hereby determines it to be in the public interest to initiate for vacation on its own motion the platted but unbuilt right -of -way of 237th Place SW, 181544.1R -1- west of 107th Place SW (known as Woodway Meadows). A map depicting the right -of -way is attached as Exhibit A hereto, incorporated by this reference as fully as if herein set forth. Section 2. The City Council hereby establishes January 20 , 1998, as the public hearing date on said vacation, said date being not more than sixty days nor less than twenty days after the date of passage of this Resolution. Section 3. The City Clerk shall prepare and distribute public notice in accordance with the provisions of Section 20.70.090. By this Resolution, the public is hereby informed that the City Council will consider whether or not a utility easement should be reserved for surface and subsurface utility easements on and across the right -of -way considered for vacation for the use of the City and its utilities or its franchisees. A. Content. The city clerk shall prepare a public notice containing the following information: 1. A statement that a request to vacate the street, alley, easement, or part thereof will be considered by the city council; 2. A locational description in nonlegal language along with a vicinity map that identifies the street, alley, easement, or part thereof; 3. A statement of the time and place of the public hearing before the city council; 4. A statement of the availability of the vacation file; and 5. A statement of the right of any person to submit written comments to the city council prior to or at the public hearing and to appear before the city council at the hearing to give comments orally. B. Distribution. At least 20 calendar days before the public hearing the planning manager shall distribute the public notice as follows: 1. A copy will be sent to the owner of each piece of property within 300 feet of any boundary of the street, alley, easement, or part thereof to be vacated; 2. A copy will be sent to each resident living immediately adjacent to the street, alley, easement, or part thereof to be vacated; 3. A copy will be published in the official newspaper of the city; 4. At least three copies will be posted in conspicuous public places in the city; and 5. At least three copies will be posted on the street, alley, easement, or part thereof to be vacated.
