Obligation to Restore. In the event entry is made onto the real property described in Exhibit C hereto pursuant to this easement by or on behalf of the owners of the Benefited Parcel, the owners of the Benefited Parcel, for themselves, their successors and assigns, hereby agree to Easement Agreement ORIGINALPage 1 restore the real property described in Exhibit C hereto to the condition it was in immediately prior to such entry, and further agree to prevent or repair any subsidence to any portion of the Burdened Parcel that may result from such entry, regardless of whether any such subsidence is caused by the negligence of the owners of the Benefited Parcel or by the negligence of any agent, employee or representative of the owners of the Benefited Parcel. The parties agree that the remedy of specific performance shall be available to enforce the provisions of this agreement, notwithstanding the availability of other remedies that may exist at law, in equity, or by force of this agreement. Nothing contained herein shall serve to limit the remedies available to any party to this agreement. 6. Attorney Fees and Costs. In the event any party to this agreement, or his or her successors or assigns, commences any legal action to enforce any aspect of this agreement, the prevailing party shall be entitled to recover all reasonable attorney fees and costs incurred therein. 7. Captions. and Use of Language. The titles of the sections herein are for convenience only and do not define or limit the contents. Words used in the neuter gender include the masculine and feminine, and vice versa; and words used in the singular or plural include the other as the context may require. 8. Covenants to Run With the Land. The rights, restrictions and obligations contained herein shall be covenants running with the land, and shall be binding upon and shall benefit the parties hereto, their heirs, executors and assigns forever. 9.
