ORDINANCE NO. 2959
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF ECDC
CHAPTER 20.10 ARCHITECTURAL DESIGN REVIEW.TO
ADD A NEW SECTION 20.10.075 APPLICATION OF
CRITERIA - EXAMPLES AND FIXING A TIME WHEN THE
SAME SHALL BECOME EFFECTIVE.
WHEREAS, a recent decision of the Washington Court of
Appeals requires that the City provide guidance to applicants and
more particularly to its Architectural Design Board regarding the
application of aesthetic elements to particular structures., and
WHEREAS, the City of Edmonds has for many years applied
its architectural design aesthetic criteria not only in the course
of specific applications but also through annual awards to projects
of merit erected throughout the City, and
WHEREAS, the City Council on the recommendation of the
Architectural Design Board deems it appropriate to provide the
specific aesthetic and design direction required by the Court of
Appeals by adopting as part of its architectural design criteria a
pictorial guide based on award winning projects so that the
Architectural Design Board, the public and applicants may utilize
and rely on prior approvals of specific projects as examples of the
applications of the design criteria contained in Section 20.10..070,
and

WHEREAS, the City Council deems it to be in the public
interest to adopt such specific examples of design standards and
incorporate them into the chapter, with the clear understanding
that when the City's review of its Comprehensive Plan process is
complete it will be appropriate to again review these criteria to
determine whether they continue to meet the objectives and purposes
of the Comprehensive Plan, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 20.10 of the Edmonds Community
Development Code relating to the Architectural Design Board is
hereby amended by the addition of a new Section 20.10.075

EXAMPLES
Examples of the successfully application of
the design criteria contained in Section
20.10.070 and /or of the requirements of the
Comprehensive Plan are incorporated in a
Building Design and Site Treatment Criteria
Interim Guide (Interim Guide) adopted by this
reference and incorporated in the provisions
of the Edmonds Community Development Code and
Chapter 20.10 as fully as if herein set forth.
Copies of the Interim Guide are available for
review or purchase from the Planning
Department of the City of Edmonds. The
Interim Guide contains photographs of various
residential and commercial structures erected
in the City of Edmonds, which comply with the
design criteria set forth in the preceding
section and the City's Comprehensive Plan.
Section 2. The City is in the process of reviewing its
Comprehensive Plan in accordance with the requirements of the

Growth Management Act. Upon completion of the comprehensive
planning process, the criteria of Chapter 20.10 and specifically
Section 20.10.070 and the Interim Guide adopted in Section
20.10.075 will be reviewed. The City Council therefore directs the
Planning Board and Architectural Design Board to review both the
design criteria and the Interim Guide in conjunction with the
amendment of the Comprehensive Plan and to report its findings to
the City Council in order that it may amend or revise the criteria
and Interim Guide. Such report is requested no later than February
28, 1995.
Section 3. Severability. If any section, sentence,
clause or phrase of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.
Section 4. Effective Date. This ordinance, being an
administrative action, is not subject to referendum and shall take
effect five (5) days after publication.
