ORDINANCE NO. 3352
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, EXTENDING THE DEADLINE FOR
ACCEPTANCE OF THE TELECOMMUNICATIONS
FRANCHISE GRANTED TO ADELPHIA BUSINESS
SOLUTIONS OPERATIONS, INC. UNDER ORDINANCE NO.
3333, AND FIXING A TIME WHEN THE SAME SHALL
BECOME EFFECTIVE.
WHEREAS, the City granted a telecommunications franchise to Adelphia
Business Solutions Operations, Inc. (hereinafter "Adelphia ") by way of Ordinance No. 3333 on
November 21, 2000; and
WHEREAS, Section 31 of the aforementioned ordinance required that Adelphia
tender a written acceptance of the terms and conditions of said franchise within sixty days of
approval and that failure to so accept the franchise would constitute a rejection thereof resulting
in all rights and privileges thereunder lapsing; and
WHEREAS, Adelphia intended to accept the franchise as provided in Section 31
of the franchise ordinance, but through inadvertence failed to do so; and
WHEREAS, Section 31 of the franchise ordinance provides that the City Council
may extend the deadline for filing an acceptance thereof by ordinance and the City Council
desires to grant an extension to Adelphia at this time, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. The deadline for tendering a written acceptance of the franchise
granted to Adelphia in Ordinance No. 3333 is hereby extended until May 15, 2001. Nothing
contained herein shall affect the remaining portions of Ordinance No. 3333 and the remaining
portions thereof shall continue in full force and effect upon Adelphia's written acceptance
thereof.
Section 2. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
