ORDINANCE NO. 3359
AN ORDINANCE OF THE 'CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF ECC
4.64.070 RELATING TO GARBAGE LICENSING AND RATES
AND FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, Sound Disposal is licensed by the City to provide garbage service
within the City limits; and
WHEREAS, the rates charged by Sound Disposal are regulated by the
Washington Utilities and Transportation Commission; and
WHEREAS, the City is pre - empted from regulating garbage rates but its
ordinance, originally enacted in 1961, still maintains a reference to City approval of rates; and
WHEREAS, the City Council deems it to be in the public interest to provide for
an informational filing of WUTC rate approvals (tariffs) and to condition the licensing of
garbage collection upon charging rates in accordance with approved tariff schedules; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds City Code Chapter 4.64 Garbage Collection is hereby
amended by the repeal and reenactment of Section 4.64.070 Filing Rates and Charges to read as
follows:

4.64.070 Filing rates and charges.
No licensee shall charge or collect a service charge, rate and/or
duty until such time as the service charge, rate or duty has been
approved by the Washington Utilities and Transportation
Commission. Copies of applications and approvals by the WUTC
shall be filed with the City Clerk in a timely fashion. The
collection of rates in excess of a WUTC approved tariff shall be
considered in default of licensing requirements and a ground for
revocation of the license granted by this Chapter. See Section
4.64.090.
Section 2. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
