Ordinance 33820006.900000 WSS /gjz 12/03/01 ORDINANCE NO. 3382 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE EDMONDS CITY CODE SECTION 1.02.035 FILLING A VACANT COUNCIL POSITION TO RENUMBER THE EXISTING PROVISIONS AS SUBPARAGRAPH (1) AND TO ADD A NEW SUBPARAGRAPH (2) ESTABLISHING A PROCEDURE FOR THE FILLING OF A COUNCIL VACANCY OCCURRING AFTER A SUCCESSOR HAS BEEN ELECTED AT GENERAL ELECTION, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City Council has established a procedure for filling vacant council positions; and WHEREAS, the procedural requirements imposed by that ordinance do not contemplate the filling of a vacancy which has been created following the election of a successor for the vacated position; WHEREAS, the City Council finds that the current procedures are appropriate for use in most situations but wish to establish an exception for situations when the City Council wishes to fill a vacancy created after a successor to the council position has been elected and prior to the date when such successor would normally be certified and sworn in; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: {WS S498930.DOC;1/00006.900000/} - I - Section 1. Section 1.02.035 of the Edmonds City Code, Filling Vacant Council Positions is hereby amended by numbering the existing provisions as subparagraph (1) and adding a new subparagraph (2) in order that said Section shall read as follows: 1.02.035 Filling vacant council positions. (2) In the event that a council member shall resign or otherwise become ineligible to hold office after the date when the council position has been filled by election but prior to the date on which the newly elected council member is eligible to take office, the City Council may in its sole discretion elect to dispense with the procedures established by subsection (1) above and appoint the newly elected successor to fill the vacancy for the remainder of the unexpired term. Section 2. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
