Ordinance 33940006.900020 JZL /gjz 11/2/01 R:3 /15 /02gjz ORDINANCE NO. 3394 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, ADOPTING SECTION 20.91.030 OF THE EDMONDS COMMUNITY DEVELOPMENT CODE. CONTINUANCES AS A ZONING REGULATION, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, in order to fully comply with state and local provisions requiring a public hearing for zoning regulations, the City Council adopted Ordinance No. 3317 on July 18, 2000, enacting Section 20.91.030 Continuances as an interim zoning regulation, and scheduling a public hearing on the same; and 2000; and WHEREAS, a public hearing on said interim measure was held on August 15, WHEREAS, Ordinance No. 3317 contained a sunset provision under which the interim zoning measure expired after six months; and WHEREAS, the City Council adopted Ordinance No. 3376 as an interim zoning regulation on November 27, 2001; WHEREAS, a need exists for a code provision authorizing a procedural continuance during the Planning Board's consideration of a particular zoning action; and WHEREAS, the City Council has retained to itself the procedural power to review a motion for continuance; and {JZL497502.D0C;1/00006.900150/} - 1 - WHEREAS, from time to time, it may be in the public interest to continue matters for good cause shown in advance of a regularly scheduled Council meeting; and WHEREAS, the City Council wishes to have the flexibility to delegate continuance authority to its Council President; and WHEREAS, the City Council desires to adopt interim Section 20.91.030 of the Edmonds Community Development Code as a permanent zoning regulation; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Adoption of ECDC Section 20.91.030 as a Zoning Regulation. Chapter 20.91 ECDC is hereby amended by the addition of Section 20.91.030 Continuances as a zoning regulation of the City of Edmonds to read in its entirety as follows: 20.91.030 Continuances. When a matter is set for quasi-judicial hearing before the City Council on a closed record appeal, the applicant, appellant or any other party of record may apply for a continuance to the City Council through the Council President. The Council President may continue such matter, based upon a showing of good cause, provided, however, that in no event may a matter be continued beyond the time period set by state statute and these ordinances for action on a development permit application without the express written consent of the applicant and a waiver of the time period imposed. The Council President shall make reasonable attempts to contact all interested parties and shall not rule on an application for continuance until the applicant and appellant have been given a reasonable opportunity in light of the circumstances to respond. Section 2. Effective Date.
