Ordinance 34390006.90000 WSS /gjz 2/5/03 ORDINANCE NO. 3439 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING ECC 4.72.010 DEFINITIONS, SECTION (B) RELATING TO BUSINESS; TO CONFIRM EXCLUSION OF OCCUPATIONS LICENSED PURSUANT TO CHAPTER 3.20, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City licenses businesses and/or occupations under a number of different structures; and license; and WHEREAS, the majority of businesses within the City pay a fee for a business WHEREAS, certain utilities are licensed under ECC Chapter 3.20 as "occupations "; and WHEREAS, ECC 4.72.010(B) exempts certain occupations which pay franchise or other significant fees to the City under regulatory structures other than business license requirements; and WHEREAS, garbage collection regulated pursuant to repealed Chapter 4.64 was previously specifically exempted; and WHEREAS, the City Council deems it to be in the public interest to clarify that "occupations" regulated pursuant to ECC Chapter 3.20 are not required to obtain a business license pursuant to Chapter 4.72, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: {WSS536859.D0Q1/00006.900000/} - 1 - Section 1. The Edmonds City Code Section 4.72.010 Definitions, subsection B Business is hereby amended to read as follows: 4.72.010 Definitions. B. Business. The term "business" includes all services and activities engaged in with the object of pecuniary gain, benefit or advantage to the person, or to any other person or class, directly or indirectly, whether part time or full time, except for those businesses or occupations which are regulated pursuant to, or for which licenses or franchises are required by the following chapters of the Edmonds City Code. 3.20 (Business License and Occupation Tax); 4.04 (Advertising License); 4.10 (Tow Truck Operators); 4.11 (Motor Vehicle Wreckers); 4.12 (Peddlers, Solicitors and Street Vendors); 4.20 (Liquor Licenses); 4.48 (Cabaret Dances); 4.50 (Public Message parlors and Public Bathhouses); 4.56 (Sound Trucks); 4.60 (Taxicabs); 4.68 (Community Antenna Television Systems); 4.75 (Pawnbrokers); and except nonbusiness activities carried on by a religious, charitable, benevolent, fraternal or social organization and persons leasing one rental unit or one private residence. Section 2. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
