ORDINANCE NO. 3463
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, VACATING THE HEREIN DESCRIBED
PORTION OF 7TH AVENUE SOUTH, AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City Council passed Resolution 1042 initiating the vacation of
the easterly half of the North 120 feet of 7th Avenue South, south of the intersection of Fir Street,
and
regard, and
WHEREAS, on June 17, 2003, the City Council held a public hearing in that
WHEREAS, the City Council finds that there remains no public use for the right-
of -way as a public street, due to its topography and other physical features, but would have
continued value to the City as a utility easement and for walkway purposes, and
WHEREAS, the City Council finds that requiring the payment of $5,454 in
compensation in return for the vacation and settlement of any outstanding claims regarding the
original vacation of property would be in the public interest, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Certain street right -of -way shown on the attached Exhibit A and
described as the northerly 120 feet of 7th Avenue South, south of Fir Street in the City of
Edmonds, Washington is hereby vacated, subject to the payment of the sum of $5,454 within

sixty (60) days of the effective date of this ordinance. If this condition is not met, this ordinance
shall be null and void.
Section 2. Upon receipt of the funds, and settlement acknowledgement, .
Community Services Director's designee is hereby authorized to amend the official street map to
show the vacation of said property.
Section 3. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
