Ordinance 34660006.900000 WSS /amg 3/27/03 R:8 /06 /03g'z ORDINANCE NO. 3466 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE EDMONDS CITY CODE TO CREATE A NEW CHAPTER 3.16 PARKS TRUST FUND, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City of Edmonds is fortunate in its combination both of natural beauty and the willingness of its citizens to voluntarily participate in the funding of youth, environmental protection and beautification projects which enhance both the city's beauty and its park and recreation system; and WHEREAS, the City's flower program is of considerable pride to the community and considerable benefit to its economic development efforts; and WHEREAS, the City's, beaches are protected as marine sanctuaries and generate community economic activity; and WHEREAS, the City's vision supports positive youth and community aquatic value at Yost Pool; and WHEREAS, current limitations on revenue create pressure on the funding of many City services; and WHEREAS, the City Council wishes to create a vehicle whereby its citizens may contribute to programs such as the flower program, Yost swimming pool, marine life protection and to other parks projects in a format which would allow such contributions to be tax deductible by creating a Parks Trust Fund whose principal the Council would seek to protect with the { WSS549930 .DOC;1/00006.900000/900000} - 1 - interest being used for the flower, pool and environmental protection programs and other similar parks projects, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Edmonds City Code is hereby amended by the creation of a new Chapter 3.16 Parks Trust Fund to read as follows: 3.16.010 Parks Trust Fund The Administrative Services Director is hereby authorized to create and number a new fund to be known as the Parks Trust Fund for the purpose of receiving donations from the city's citizens for, or in aid of, the cost of operating, maintaining and improving the city's parks and other related beautification, aquatic, and environmental protection programs such as the city's flower program, the Beach Ranger program and the Yost Pool. This fund is created and shall be maintained to the end that such donations shall be fully tax deductible and in accordance with the laws of the United States and the regulations of the Internal Revenue Service. 3.16.020 Administration of the Fund. The council shall endeavor to utilize the interest earned by the fund in accord with the donor's wishes for the flower beautification, aquatics, environmental protection and other parks related programs. The council shall use its best efforts not to invade the principal of the fund unless called upon by unforeseen budgetary needs. In the event that the principal of the fund shall be invaded, the council shall first attempt to utilize the principal for other similar programs such as programs for the arts, community beautification, parks acquisition or similar purposes. Ultimately however, the council shall maintain its absolute legislative discretion to use all available funds in the best interest of its citizens in accordance with the council's powers and duties pursuant to state law. Section 2. Effective Date.
