Ordinance 34890006.900000 WSS /gjz 1/28/04 R:2 /20 /04gjz ORDINANCE NO. 3489 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, REPEALING CHAPTER 1.14 PUBLIC OFFICIAL DISCLOSURE- PROHIBITED INTEREST, AMENDING CHAPTER 1.20 COPIES, CERTIFICATIONS AND TRANSCRIPTIONS OF CITY RECORDS TO ADD A NEW SECTION 1.20.080 RELATING TO THE FILING OF PUBLIC DISCLOSURE FORMS, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, Chapter 1.14 was enacted by the Edmonds City Council at a time prior to the enactment of State statutes which provide for public disclosure, online accessibility of. public disclosure forms and a public Codes of Ethics for municipal officials; and WHEREAS, the City finds that its existing provisions regarding Public Disclosure forms are both redundant and difficult to administer, create the appearance of a conflict of interest in the application of the provisions to City officials; and WHEREAS, enforcement of State provisions by neutral third parties such as the Public Disclosure Commission provides greater credibility to the process; and WHEREAS, the City Council wishes to provide as much information to the public as possible, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Edmonds City Code is hereby amended by the repeal of Chapter 1.14 Public Official Disclosure - Prohibited Interest in its entirety. {WSS563963.DOC;1/00006.900000/1 - I - Section 2. The Edmonds City Code, Chapter 1.20 Copies, certifications and transcriptions of City records is hereby amended by the addition of a new section 1.20.080 Public disclosure forms to read as follows: 1.20.080 Public disclosure forms. A. Public officials of the City of Edmonds shall file a public disclosure forms in accordance with the Washington State Public Disclosure Commission requirements. B. Copies of the forms filed, maintained in the offices of the Washington State Public Disclosure Commission and available for inspection over the Internet, shall be available on line at the public access computer in the City Hall customer service area without charge. C. One paper copy of each form shall be provided to any member of the public at no charge. Additional copies of any form requested by an individual shall be subject to the copying charges established by this chapter. D. While the Appearance of Fairness Doctrine Chapter 42.36 RCW does not require the disclosure of campaign contributions properly disclosed to the Public Disclosure Commission, a Councilmember should make a good faith effort to disclose in any quasi-judicial hearing before the Council campaign contributions in excess of .$250 received from a person or entity identified in the record as a party of record. Section 3. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
