An Ordirance appovirg and confirming the assessment and assessment roll of Local Improvement°District lo,49, for^theimprovemert of the alley it B10ek 77, Plat of the City of Edmonds, by the corstruction of a six (611) inch concrete lateral sewer,tngether with the necessary manholes, and other appertenarces necessary to make a complete improvement all in accordance with Ordirarce Eo.520 of the City of Edmonds, levying ~aL assessment or account thereof -against the several lots, tracts and parcels of lard as shower or said roll, providing for the issuance of bords therefor and fixirg the date of the issuance thereof. THE CITY OF EDMOII DS DOES ORDAII : Section Ia That the assessment and assessment roll of Local Improvement District E o.49, for the improvement of the alley it Block 77, Plat of the City of Edmonds, by the construction of a six irch(611) eorcrete.lateral sewer, together with the necessary manholes, and other apperterarces necessary to make a complete improvement all in accordance with,Ordinarce L o. 520 of the City of Edmords, as the same now stands, be and the same is hereby in all things approved and con- -firmed. SECTIOL II: That each lot, tracts and parcel of lard or other property shown or said roll is hereby declared to be specially benefited by said imorove- mert in at least the amount charged against the same that the assessmert appear- ing against the same is in proportion tb theseveral assessments appearing upon said roll and there is hereby levied an assessment agairst each lot,. treact and parcel of land ar_d other property appearing upor said roll the amount finally charged against the same thereon. SECTION III: That the lst day of March 1940, is hereby fixed as the date of the issuance of the bords required to be issued on account of said imptovemert. SECTIO1. 1Vo The City Af.jEdmords may sell said bords ar_d make payment in cash in the manner provided by the Ordirarces of said City. The sewer on Third Avenue South came up for consideration but was laid over to the next meeting of the Council. Mr. Bonner said he was building a house on Fourth Avenue South and that he must have water. On motion the Water Superintendent was instructed to lay a 4" cast iron line from Dayton Street to Mr. Borrers property, and that the work be done by day labor. On motion the Water Superintendent was instructed to purchase 500 feet of 40 cast iron pipe to make the correction, provided that Hugh G.Pureell & CO. will furnish it at the same price they furnished the 1000 feet. THE roll call showed the f011ovkirg Courcilmer present: Chandler, Hareid, Harsor, Clausen, Martin, ar_.d Jores. The minutes of the last meeting were read who and approved -The Mayor asked if there were any ore in the audience had any thing they wished to brir_g before the Council. Geo.gate complained that the City in emptjrir_.g their large water tack had created a hole about 35 feet deep next to his sisters property or Tenth Avenue 0 ard that it was very dangerous and was liable to cause the heavy damages. The matter was refured to the Street and Water Committes and the City ergir- eer. mark Wursher requested the Council to furnish him with water, The matter was refureed to the Water Commiee. The Coucil took up the question of fencing south water shed. The Council desided to call for bids for a 4 foot wire ferce with 8 straLds of barbed wire and a 6 foot wire fence with 3 strands of barbed wire, so the Coucil could mi ht choose which the prefured, Al in accordarce with the plans and specifi- ca ions of the City Engineer. An Ordirarce providing for the improvement -of ,the easterly side of Third Avenue North, in the City of Edmonds,by the.corstruction of a 10-inch lateral sewer from the irtersection of Third Avenue forth with the East and West carter line of Section 24, Township 27 Forth, Rarge 3, East W.M., routherly along said Third Averue forth for 950 feet more or less to a correction with the Forth Trurk Sewer;Also to, improve the Easterly side of Third Avenue I:,orth, it said city, bythe corstruction of:an eight -inch lateral sewer beginning at the irter- section of Third Avenue forth and the r orthern City Limits; thence Southerly alorg the Easterly side of Third Avenue Korth for 585 feet more or less to a correction with the Forth Trunk Sewer, also to improve the Easterly side of Third Averue.Borth, in said city, by the construction of concrete curbs and gutters, together with the necessary drainage from the intersection of Third Avenue I\orth ar.d Fourth Avenue Forth, in said city;.therce rortheasterly for 1100 feet, more or less, to the %orth City Limits of Edmonds, together witj the necessary manholes,catuh basics and other appertererces necessary tomake a complete improvemert, all in accordenee with Resolyior, h o.104 of the City of -.Edmonds; creating an Assessment District; creating a Local Improvement District Fund therefor, and providing that payment for such improvement be made by special assessment or said District order the mose of payment by bonds WHEREAS , by Resoltion I.o. 104, of the City of Edmonds, the City Council of the City of Edmonds, has declared its intention to order the improvement as above outlined, and doir_g all other work necessary in correction therewith to make a complete improvement in accordance with the plans and specification prepaired by the City Engineer, 10W, THEREFOR, THE CITY OF EDMOI<DS DOES ORDAII.: SECTION 1:That the easterly side of Third Averue Forth, in the City of Edmo- rds, rom t e intersection of Third Avenue Lorth with the east and west center line of Section 24, Township 27 forth, Range 3 East W.M.,Ebrthsastprly along said Third Avenue for 950 feet more or less to connection with the north Trunk Sewer be improved by the construction of a 10-inch lateral sewer, together with necessary manholes, catch basins and other appertererces necessary to mak a com- plete improvement; also that the Easterly side of Third Averue north, in said city, beginning at the irtersection of'Third Avenue I:orth and the Korth City Limits;thenee southwesterly along the Easterly side of Third Avenue North for 585 feet more or less to a correction with the Forth Trunk Sewer be omproved by the construction of an 8-inch lateral sewer'; together with the necessary mar -holes catch basins and other appertererces necessary to make a complete improvement; also that the Easterly side of Third Avenue Forth, in said city, From the inter- section of Third Avenue I:ort and Foyrth Avenue Iorth I:o-rtheasterly for 1100 feet more or less, to the I,orth City.Limits of the City of Edmonds b@ improved by the.construction of concrete curbs and.gutters, together with the necessary drainage. SECTION 2,_That the cost and expence of such -improvement shall be born by and assessed against the property included in the Assessment District herein created in accordance with law. SECTION 3: That there is hereby established a Local Improvement District to. P.q.called Local Improcement District L o.51, which District.shall include the following described property, to -wit: Beginning at an intersection of the West line of Third Avenue North and the forth City Limits line in the City of Edmords;thence easterly along the north City limets forl20 feet; thence south and parallel to and 120 feet easterly of the East line of Third Avenue North for 1401.5 feet to an intersection_, with the Southwesterly line of Fourth Avenue North; thence southerly along the West line of Fourth Averue Forth to an irtersection, With the East and West 6enter line of Section 24, Township 27 I.orth, Rang 3 East V.M.; thence West alor..g the East and West center lire of said Section 24 to the center line of Third Avenue I,orth; thence northeasterly can the center lire of Third Avenue Korth to an irtersection: with the North. City Limits; thence East along the North City limlite to, the point of beginning, less that portion of the foregoirg belonging to Scgool District j15 of Snohomish County, Washington. SECTION 4: A special fund is hereby created to be called Local'Improvement Furl I\o. 1 , which shall consist in the agregate of the several amounts assessed levied and collected on the several lots and parcels of lard in said Local Impro- vement District and the said proceeds of said sale of the bonds of the said Dis- trict for the purpose of defraying the cost and expence of such improvement. Out of said funds shall be paid the bonds, the interest thereon, and the entire cost of such improvement, except the cost of labor as hereinafter providedf SECTION 5: The cost and expence of such improvement shall be defrayed by special assessments payable in ten equal,annual installments with interest there- on at the rate of 5 percent per arnum under the mode of payment by bonds, as provided by law and the Ordinances of said city. Bonds bearing interest at the. rate of 5 per cent per annum, payable on or before twelve years from date of issue, shall be issued in payment of the cost and _expenses of such improvement, or the City of Edmonds may, at its election, sell said bonds and make payment in cash it the manner provided by the Ordinances of said city. SECTIOI< 6: That the cost and expenses of said improvement to be borne by and assessed against the property of the Assessment District, and for which bonds of said District are to be issued, shall not include the cost of labor upon said improvement, which labor is to be furnished by Federal funds under the W.P.A. plan of the Federal Government.
