Womer--------------------- 4,50 Councilman Clausen,reported that the Committe had consulted with Ineze Slate regarding the damage,done to lots 19 and 20 in Block 69. That the committe had made a proposition .to exchange some lots the City had for those, she said she would look'the exchange situation over but she thought the damage to the„ lots was about $100.,00 each. But before any thing could be done she would,have to take it up with other persons interested. The following communication was received from the State Bank of Edmonds. "December 2nd,1940 The City Council of the.City of Edmonds, Washington. Gent lemon : ' The turn of events has, brought up a matter that has been dorment for many years. It has come to my notice that the City of Edmonds has entered into a contract of sale covering Lots 22'to 29T1 both inc., Block 96, Plat, of the City of Edmonds. This hank is the owVer of Bonds' V-8-9-gland 10,Local Improvement District N.o.25, City of Edmonds, which are unpaid and in default and* the' payment of which are inpart secured by the above described property. The City of Edmonds is the trustee of the bondholders of this local improvement district. It is also suond law that a trustee cannot benefit at 1 1 1 1 the expense of those for whom it is trustee. THEREFORE the City of Edmonds has now placed itself in a position where it must recompense the bondholders under said local improvement district No.25. DEMAND is made for the payment of said local improve- ment bonds with interest. Your promt attention and immediate action is requested, Yours very truly, Geo.&Hanso4, President" On motion the request was refured to the City Attorney. The hearing on Resolution No.108 came for c.ohsidergtion. The mayor asked if there were any one in the audience who -had objections to the improvement as set forth.in Resolution Nool08. The Resolution seting forth the improvem®nt of the east sied of Third Avenue from Walnut Street south to Erbon Drive and the alley beteen Third, and Fourth Avenues north of Walnut Streit and a portion of Walnut Street. Mrs.H.S.Morgan objected to the improvement on the ground that her 'property was already connected with a sewer. The Council ordered her property stricken from the list. " Foe Union Land Corporation I wish to protest against this resolution of proposed sewer construction as being unnecessary, extravagant and excessive in cost, especially considering the present extremely low value of the class of property affected, being mostly vacant lots. Reapeotfully submitted Geo.HoSohlytter" "Hereby protested by Mr. & Mrs. D.M.Parker D.M.Parker Mrs. D.M.Parker" Chas Boshart protested in person against the improvement because the proposed improvement did not come along the property on which his house is situated. in the proposed Improvement District The City Engineer made a check of all the property and found that 75% were for the improvement and 25% against the improvement. It was moved by Chandler and seconded by Callahan that the City Attorney be instructed to draw up an Ordinance ordering the improvement as set forth in Resolution 11o.108. The vote was as follows: Chandler yes, Hareid yes, Hanson yes, Callahan yes, Clausen yes, Marten yes., Jones yeso Carried by unanimous vote of the Council. It came to the Councils attention that O.L.Kline and others have not connected their buildings with the sewer on Third Avenue North. On motion the Council instructed the City Cl&rk give them notice con - neat their buildings with the sewer in accordance with the Ordinances of the City of Edmonds. Councilman Chandler brought up the proprosition of purchasing a pot trailer forthe Street department. Also the fencing of the Water Department garage.grouzid.
