The hearing on Resolution No.108 came for c.ohsidergtion. The mayor asked if there were any one in the audience who -had objections to the improvement as set forth.in Resolution Nool08. The Resolution seting forth the improvem®nt of the east sied of Third Avenue from Walnut Street south to Erbon Drive and the alley beteen Third, and Fourth Avenues north of Walnut Streit and a portion of Walnut Street. Mrs.H.S.Morgan objected to the improvement on the ground that her 'property was already connected with a sewer. The Council ordered her property stricken from the list. " Foe Union Land Corporation I wish to protest against this resolution of proposed sewer construction as being unnecessary, extravagant and excessive in cost, especially considering the present extremely low value of the class of property affected, being mostly vacant lots. It was moved by Chandler and seconded by Callahan that the City Attorney be instructed to draw up an Ordinance ordering the improvement as set forth in Resolution 11o.108. The vote was as follows: Chandler yes, Hareid yes, Hanson yes, Callahan yes, Clausen yes, Marten yes., Jones yeso Carried by unanimous vote of the Council. It came to the Councils attention that O.L.Kline and others have not connected their buildings with the sewer on Third Avenue North. On motion the Council instructed the City Cl&rk give them notice con - neat their buildings with the sewer in accordance with the Ordinances of the City of Edmonds. Councilman Chandler brought up the proprosition of purchasing a pot trailer forthe Street department. Also the fencing of the Water Department garage.grouzid. Aspeoial fund is hereby created to-be`oalled Local Improvement District Fund ,No.52, which shall consist in the..__aggregate `of the several amounts assessed,. levied and collected on the'several lots and parcels of land.in said Local Improvement District and-the.proo.eeds of the sale of the bonds of the said.Distriet for :the purpose of defraying the costs and expenses of such improvement. Out of said fund shall be paid the bonds, the interest thereon, and the entire cost of such improvement., `except the 'cost of labor as ,herein- -after provided. SECTION V. The costs and expenses of such improvement shall be defrayed by special assessments payable in tea equal, annual installments with interest thereon at the rate of five per °cent :per annum under jrhe mode of payment by bonds, asprovided by law and the Ordinances of said city. Bonds bearing interest at the rate ,of five per cent per annum, payable on or before twelve years from date of issue, shall be issued in payment of the cost and expenses of.sueh improvement, or the City of Edmonds may, at its election, sell said bonds and make payment in -cash in the manner provided by the Ordinances of said city. ' SECTION VI. That the costs and expenses of said improvement to be borne by and assessed against the property of the-Ass�essment District, amd for which bonds of said District are to be issued, shall not include the cost of labor upon said improvement, which labor is to be furnished by Federal funds under the WPA plan of Federal Government. It came to the Councils attention that the Cityc:: Treasurer had put the tax money for Street Lights, $1300,00, into Current Expenee instead of the Street Fund. On motion the City Treasurer was instructed to transfer the Street Light money from the Current Expense Fond tbethe Street Fund. It came to the Councils attention that the State Bank of Edmonds, had in it•s posession $1000,00 in bonds of L..I..District No.45 and that they could be redeemed for face value with out interest. On motion the City Treasurer was instructed to purchase the $1000,00 of L.I.District No.45, to be paid with out interest.
