A motion was made by Councilman McGibbon and seconded by Maxwell that Hal, Bigelow be refunded his money which he deposited with the Treasurer several o years ago for sidewalks in front of his property. 'Motion carried. A motion was.made by councilman McGibbon and seconded by Waggoner that Ord- inance no. 579 be adopted. Motion carried. A letter was read from L. C. Weedin in which he claims damage done to his automobile on fifth & Bell Street. The attorney advised the council that this was not a legal claim. A motion was. made by councilman., McGibbon and seconded by councilman McGinness that the clerk write the Association of Washington for information on the. Employes Retirement fund. Motion carried. ThIZ7,,further business the meeting adjourned. e. City perk i ayor February 3, 1948 The Council met in regular session with Mayor rourtner presiding. The roll call showed all councilmen present. The Viater Collectors report was read. A motion was made by Councilman McGibbon and seconded by Councilman Maxwell that the bills which were approved by the finance committee be allowed and warrants be drawn on the proper funds.- Motion carried. A motion was made by councilman Tucker and seconded by councilman Clausen that the claim of Horton Brackett for $35-for damage done to his property by the Contractor Scarsella be'paid and held out of the balance due the contractor. Motion carried. A motion was made by councilman Tucker and seconded by councilman Maxwell that the hearing for assessment roll # 61 be set for March 2. Motion carried A letter was read from Fcancis Anderson, secreUry of the Library Board in which they ask that the roof of the library Bldg. be repaired and that the cost be taken from the general fund. A motion was made by councilman Tucker and seconded by councilman Clausen that this repair be made and $aOO be Its'ed.from the general fund to pay for same. Motion carried. A letter was read from Attorney Hunter in regards to the using of money on the Maple street Sewer.. He stated he vias.od the opinion that it is illegal t.o t..raneXer the balance of the money from the Dayton Street sewer outfall to the Maple street sewer, because when the district was set up, the property owners were to assume the full cost of the project. Mr. Hunter suggested that the State Development Board -be contacted and find out if the balance in that fund can be used on some other project. A. motion -was made by Council- man McGibbon and seconded by councilman Siefert that the attorney's report be accepted. Motion carried. A motion was madd by councilman Maxwell and seconded by councilman Tucker that the attorney contact the State Develop- ment Board in regards to the balance of funds in the State Detelopment Fund. Motion carried. A motion was made by councilman McGibbona end seconded by councilman Maxwell that the date for the new hearing on assessment roll #60 be aet for March 16. Motion carried. Mr. Sether, State Land commissioner and two other men from his office were at the meeting in a rds to the dock whibhewas built by Pointer Williamette during the war,. ated the dock would be a benefit to small boats as a place. for moorage, but cost for maintenance would amount to around $5000. Councilman McGibbon, chairman of the park board stated their estimate was $3000 to make it safe for heavy vehicles. Mr., Sethereremarked it was up to the council to decide what they wanted to do. Councilman Waggoner made a motion that the Attorney.draw up an application for a lease of the State Park area and extended water -ways, Councilman Tucker seconded the motion. A motion was made by Councilman Maxwell that this be referred back to the park department for Further investigation as to the cost of repairs and m§intenence. A roll call vote showed IVicGibbon yes, Tucker yes, Waggoner yes, Siefert no, McGinne.s yes, Clausen no and Maxwell yes. 1 1 1 P_J 1 City Treasurer Womer stated.the.Street, Park and Library funds would be short $3000 this year. He stated there would not be sufficient tax money to take care of these items, although they were in the budget. A motion was made by Councilman Siefert and seconded by councilman McGinness that this matter be turned over to the finance committee for an investigation. Motion eafried. Earl Joplin asked for permission to -.ay ,asphalt pavement in front of a delicatessen and Grocery store, on fifth avenue south. A motion w4s made by councilman Waggoner and seconded by,councilman McGinness that he be given permission to make these improvements providing curb and gutter are put in under the supervision of the engineer. Motion did not aarry. A motion : was made by Councilman Tucker and seconded by councilman Maxwell that he be given -permission to 3a:vetWithsabphtlt. Motion carried. 1 1 1 1 'Cleve Little reported a drainange condition from Strance property, which was running into. the city park. A motion was made by councilman Tucker that an interest bearing warrant be drawn on the general fund to take care of the expense of the park until tax money comes in. A letter was read from Mr. Lovett in which he states he was assessed for property he does not own. The attorney advised the Treasurer that he has a legal right to make the segregation of the property which has been sold. Mr. Lovett was advised to get statements from the County Auditor for the property which was sold. There being no further business the meeting adjourned. A motion was made by councilman McGibbon and seconded by Coinoilman Maxwell that the Bill of Paul Stalhamer for labor on the water, for $88 be allowed. Motion carried. A letter which was addressed to Attorney Aziderson from the State Finance Committee �asrre4d. This letter is in regards to the balance of money left over from -the Dayton Street sewer outfall.. It'states that the Council may submit plans, specifications and estimates for a new project and if approved authority will be granted to transfer the unexpended balance to the new project. A letter was read from the State Highway Department in which they state that their 1948 program does not provide for any work within the city limits of Edmonds. Councilman McGibbon reported that the Safety committee met with the Fire committee and several things were discussed. They suggested the installing of five new hydrants and the lowering of two hydrants. they also suggested that the hydrants be painted.once a year and the area around them to. be kept clear of brush. Also a,different sirene was discussed. A motion was made by Councilman Tucker and seconded by Councilman Maxwell that five hydrants of appropriate size$ be ordered. motion carried. Attorney Hunter reported he had not heard from the State in regards to the lease which he applied for. It was reported that the School Supt. Mr. Hill would like to have something done about the dogs which gather around the schools,. A motion w4s made by Councilman Waggoner and seconded by Councilman McGinness that this be re- ferred tbethe safety committee for a report. Motion carried. A letter was read from Paul McGibbon in regards to the dumping of garbage in the sound near the park area, which gives the beach an unsanitary appear- ance.
