DOTY has diligently served as Police Judge and Justice of the Peace.in the City of Edmonds since January, 1937 and prior thereto worked .for and served the City of Edmonds in various capacities for a number of years, and WHEREAS, during the time so spent JUDGE DOTY has been diligent and has devoted a great deal of time and effort to the performance of his duties as Police Judge, Justice of the Peace, and former City employee, and WHEREAS, JUDGE DOTY-is retiring, effective January 1st, 1959, and WHEREAS, the Mayor and the City Council of the City of Edmonds feel that there should be a fitting commendation for one who has applied himself so diligently to the performance of his uties and WHEREAS, it was felt by the s&id Mayor and City Council that a permanent record of such commendation should be made, NOW THEREFORE, IT IS HEREBY RESOLVED that the Mayor and the City Council of the City of Edmonds hereby commend JUDGE RAY H. DOTY for the fine job he has done during his several terms as Police Judge and Justice of the Peace for the City of Edmonds, and on behalf of the citizens of Edmonds extend their best wishes to JUDGE DOTY and his wife, and hope that they may spend many more years as residents of Edmonds. IT IS FURTHER RESOLVED that a copy of this Resolution be spread upon the minutes of the Council Meeting of December 2nd, 1958, and that a copy of this Resolution be given to JUDGE RAY H. DOTY. IT IS FURTHER RESOLVED that a copy of this Resolution be given to the Edmonds Tribune -Review for publication, in order that the citizens of Edmonds might be made aware of this expression of gratitude for the faithful and valuable services rendered by the said JUDGE RAY H. A motion was made by Councilman Christensen,.seconded by Councilman Simpson that Ordinance #748 be passed. Said Ordinance provides for the issuance of $179500.00 in General Obligation Bonds to pay for a Fire Truck. These bonds were authorized by the qualified voters of the City at an election held on November 4, 1958. Motion carried. A motion was made by Councilman Tuson, seconded by Councilman McGibbon that Ordinance #749 be passed, setting the salaries of all City employees for the year 1959• Motion carried. A motion was made by Councilman Tuson, seconded by Councilman McGibbon that an Addition to Chapter6, Article 49 on Safety and pertaining to the licensing and use of bicycles be passed. A roll-call.vote showed 3 for and 4,against, and the motion failed to carry. The proposed Amendment will be reworked and submitted at the next meeting. A Petition for Annexation was presented to the Council, signed by more than 75% of the assessed valuation of the area known as "Seattle Heights" annexation, which is a block - square area northeast of the high school annexation. A motion was made by Councilman Tuson, seconded by Councilman Christensen that the Council accept the Petition for Annexation of the area, and the Hearing on the Annexation be set for January 6, 19599 subject to checking by Attorney Holte as to the sufficiency and legality of the petition. Motion carried. The Water Collector's report for the month of November wasxead to the Council. A motion was made by Councilman Tuson, seconded by Councilman McGibbon that the City of Edmonds call for bids -on a Fire Truck, specifications to be furnished by the Fire Chief, and bids to be opened January 20, 1959• Motion carried. A motion was made by Councilman Kincaid, seconded by Councilman Sorensen that the approved bills be paid, and warrants drawn on the proper funds. Motion carried. There was no further business, and the meeting adjourned. City Clerk i December 16, 1958 Meeting was called -to order by Mayor Maxwell, with Councilmen Lambe, Tuson, Christensen, Simpson, Sorensen, and Kincaid present. Bids were opened on LID #94, Michielli Park sewers. They -were: Hale Construction $ 59481.25 Pacific Concrete Products Co. $ 5087.25 Mallory & Compton $ 5,826.00 After study, a motion was made by Councilman Tuson, seconded by Councilman Lambe that the bid of Hale Constru8t167i in the amount of $5,481.25 be accepted for LID #949 construction of sewers in Michielli Park, and the mayor be authorized to enter into contract with them. Motion carried. Hearing was held on the proposed annexation of "Willowdale Gardens". After some discussion, during which -time a petition for deletion of an area was presented containing 4 signatures, it was found that the original petition still had approximately 77.4% of the assessed valuation.. A motion was then made by Councilman Simpson, seconded by Councilman Sorensen that the- rea known as."Willowdale Gardens" be annexed to the City of Edmonds by Ordinance #7509 legal description as.follows: Beginning at the intersection of the north right-of-way line of 212t' Street S.W. and the west right -of -:Maya -line of 76t Ave.. W., thence` north along the west right-of-way line of 76a Avenue west.to the.south right-of-way line of 200 Street, S.W.; thence westerly along said south right-of-way line to the west right -of way line of 80t'' Ave. W.; thence south -along said west right-of-way, line to the northeast corner of Robert E. Thomas 2nd Addition, according.to the.plat thereof, records of Snohomish County, Washington; thence west along the.north 1�ne.of said Robert E. Thomas 2nd Addition Plat to the east right-of-way line of 82nd.Ave. W.; thence north along said east, rightt-of-way line to a point, where said, right-of-way line ,intersects the north line extended of Tract 2, Plat of East Edmonds -Acres,; thence west to the northeast corner of Tract 2, said East Edmonds Acres; thence west along the north line of. said Tract 2 to the north- west corner of said Tract 2;, thence south along the west line of said Tract 2 and Tract 1, East Edmonds Acf'es, to the north line of Lot 2 in Block 2,. Alderwood Manor No.9,.according to the plat thereof, records.of Snohomish County, Washington; thence west -along the north line of said Lot 2, and lot 3,-in Block 29 Alderwood Manor No. 9 to its intersection with the easterly right-of-way line of Aloha Road (the present boundary of the'City of Edmonds); thence southerly along said right-of-way line of 212m Street S. W.; thence east along said north right-of-way line to the point of beginning. A roll -call vote showed all councilmen in favor, and the motion carried.. A motion was made by Councilman Kincaid, -seconded by Councilman Lambe that.the Council accept the. re.commeftdati-on contained. in Resolution #12 of the Planning Commission, and zone the above described area known as "Willowdale Gardens" heretofore annexed .to the City of Edmonds in conformance with said Resolution #12 and that certain zoning map of the City of Edmonds File #8.34 dated December 1958. Motion carried. A motion was made by Councilman Tuson, seconded by.Councilman Sorensen that.the'Council Accept the recommendation of the Planning Commission contained in their Resolution #10 as to the zoning of the area known as "Cherry Lane".annexation, as shown on that certain zoning map of the City of Edmonds, File.#8.32 dated December 1958. Motion carried. A motion was made by Councilman Sorensen, seconded by Councilman Kincaid that the Council accept the recommendation.of the Planning Commission as contained in their Resolution #11 for zoning of the area known as "Meadowmoor", as shown on that certain zoning map of the City of Edmonds, File #8.3.3, dated December 1958.. Motion carried. Emergency Ordinance #751 was introduced, and a motion was made�by Councilman Tuson, seconded by Councilman Kincaid that the Hearing on Emergency.Ordinance.#751 be set for January 6, 1959• Motion carried. A motion was made by Councilman Tuson, seconded by Councilman Sorensen that an Amendment to the City Code, Chapter 2, Article 1, Section 2-1.05, and Section 2-1:07,' changing the offices of the City Clerk..and the: -City Attorney from elective to appointive positions, and deleting therefrom subsection "C" be passed. Motion carried.. A motion was made.by Councilman Christensen, seconded by Councilman Simpson that an Amendment to Chapter 4., Afticle.. 4, . of the. -Edmonds City Code, creating the office of the Assistant City Attorney be pass-ed... .Moti on carried.. The Resignation of Judge Ray H. Doty, effective as of December 31, 1958 was received and accepted, and an order appointing Charles-W. Shepherd as Police Judge commencing January 1, 1959 was signed by Mayor Maxwell. - The Treasurer's report for the month of November was read. A motion was made py Councilman Tuson,.seconded by Councilman Lambe that a group of approved bills.be paid,..and.warrants drawn.on the proper.funds. Motion carried. It was moved by Councilman Simpson, and seconded by Councilman Sorensen that the warrant representing the final payment to Hale Construction in the amount of $3440.79 for work on LID #86•be paid after a receipt is received certifying that all contractor's bills had been paid in connection with this LID. Motion carried. A motion was made by Councilman Kincaid, seconded by Councilman Christensen that the Clerk be authorized to issue 5 interest bearing warrants on LID #86 to.Southwick- Campbell.Co.,.Inc., as follows: #19 for $107670, and #20, #21,.#22, and #23 for.$1000.00 each, making'a total amount of $4,107.70 to cover $3440.79 submitted by Hale Construction for contractor's final estimate, and $666.91 submitted by James H. Reid & Associates for final fee for engineering services. Motion carried. A motion was made by Councilman Tuson, seconded by Councilman Kincaid that an Informal hearing be held on January 209 1959 for the-},pssible.severing of Pine Street in the 1100 Block. Motion carried. A motion was made by Councilman Tuson, seconded by Councilman Christensen that a call for bids be authorized for a new Billing Machine for the Water Dept., bids to be opened on January 20, 1959, and specifications to be furnished by the City Supervisor.
