Several members of the Police Dept. were present, and they also were dissatisfied with .the salaries proposed for them. Councilman Kincaid, however, brought out the fact that the Police Dept. had decided to negotiate with the City through their Union representative, and that this made it necessary for any discussions on wages to be held through these negotiating ' committees and thus prevented salary discussions on a personal basis between the council members and individual policemen. �i There were no tax payers in the audience who wished to comment further on the final budget, and the hearing was therefore closed. Because of further proposed salary negotiations, it was, moved by Councilman Kincaid, seconded by .Councilman Nordquist that the council defer action on .the Salary Ordinance and hold it for further discussion. However, Councilman Bennett felt that the salaries had been reviewed in detail, and he was prepared to vote tonight on salaries as well as on the Budget. At this point, Councilmen Kincaid and Nordquist retracted their motion. It was moved -by Councilman Kincaid, seconded by Councilman Nordquist that proposed Ordinance 1389 be passed, adopting the Final Budget of the City of Edmonds for the fiscal year com- mencing January 1, 1969. A roll call vote showed all councilmen voting in favor, and the motion carried unanimously. It was then moved by Councilman Nordquist, seconded by Councilman Slye that proposed Ordinance #1390 be passed, levying the general taxes for the City of Edmonds for the fiscal year commencing January 11 1969, and providing for the collection thereof! A roll call vote was taken, with all councilmen voting in favor, and the motion carried unanimously. This ended the budget hearing, and the meeting adjourned at 11:15 P.M. City Clerk Mayor October 15, 1968 ROLL CALL The regular meeting of the Edmonds City Council was called to order by Mayor Harve Harrison with all councilmen present. APPROVAL OF MINUTES Minutes of the meeting of October 1 had been posted and mailed, and since there were no omissions nor corrections, they stood approved. HEARING: FINAL ASSESSMENT ROLL - LID #140 - SEWERS, VICINITY 8tb & PUGET Engineer Larson explained the final costs of the LID. The final total costs were $17,033.59, with $3,998.17 reimbursable from the City of Edmonds., making a total cost for the LID in the amount of $13,035.42. The preliminary estimate was $12,700.00 with zoned front foot cost of $6.a$. The final zoned front foot cost was $7.74, the difference mainly coming from the fact that some of the original assessed property had to be deleted from the LID. Hearing was then opened. John Kannair, 1420 8m Avenue North, objected to the fact that the property. owners were having to pay the cost of a main trunk line. Engineer Larson explained that the main trunk line was installed at the cost of the City of Edmonds, not the property owners. The main line was installed to connect LID #151. H. D. Propst, Jr., 19514 — 100L Avenue W. asked when the project would be completed. He said the property had been left in a terrible shape, and that his neighbors yard had been a mud hole, and the contractor had dumped rocks in it and had gone' --off and left it. Councilman Bennett asked about e the use of the performance bond to get this project completed. Engineer Larson stated that the original contractor had gone bankrupt, but that sufficient retainage was held to pay to have all of the work done to complete the job. Ech's had been hired and would perhaps have the work done in a week. Hearing was closed. Councilman Bennett moved, seconded by Councilman Slye that Ordinance #1391 be passed approving and confirming the final assessment roll of LID #140. Motion carried. HEARING: FINAL ASSESSMENT ROLL - LID #162 - 5tb AVENUE SOUTH SIDEWALKS Engineer Larson explained the final costs of the LID. The preliminary estimate for total cost was $7,000.00, $5,000.00 of which was to be paid by the property owner and the balance by the City of Edmonds. The final cost was $10,445.25, with the increase in price due to the retaining wall. $5,000.00 was still chargeable to the property owner and the balance of $5,445.25 to be paid by the City of Edmonds. There was no one in the audience who wished to -ask questions so hearing was closed. A motion was made by Councilman Slye, seconded by Councilman Nordquist that Ordinance #1392 be passed approving and confirming the final assessment roll of LID #162. Motion carried. HEARING: ON PLANNING COMMISSION RESOLUTION #288 - RECOMMENDING AMENDMENT TO COMPREHENSIVE LAND USE PLAN MAP BY REDESIGNATING AS SINGLE FAMILY RESIDENCE PROPERTY DESCRIBED IN PLANNING COMMISSION FILE CP-1-68. City Planner Merlin Logan explained that for some reason three small lots on the west side of Second Avenue and just north of Edmonds St. had been zoned multiple residential. Residents of the Breakwatee Townhouse on the east side of Second Avenue had petitioned to have the area EDFsc single family, be- cause they had purchased their property with the understanding they would have an unobstructed view. Mayor Harrison asked if any opinions had been given by property owners and was told that property owners and was told that property owners had no objection to the reZeM. 9,rDEs,r_wA- oN. PROPOSED ORDINANCE FOR SEWERING UNITS 5 & 6 The engineer reported that the City Clerk has not had a chance to check the validation of the petitions, however he said he thought the preliminary assessment roll could be ready for the November 5 meeting. Councilman Nordquist moved, seconded by Councilman Slye that November 5, 1968 be set for the hearing date on the-preliminaryassessment roll for Units 5 and 6. Motion carried unanimously. Discussion was held on the University property in the north end. Mayor Harrison stated that the state had had appraisal made on the property zoned and unzoned. He stated that.he believed it to be in the best interest of the City to leave the area unsewered. Mr.,Don A. McQuade, 7215 176n S.W. said he had signed a petition to have his property sewered, but would like to exclude a portion of it. Engineer Larson said that the engineering would have to be done before a final answer could be made. PRESENTATION OF PETITION FOR PAVING ALDER, 7h to 8tn The petition for paving of Alder, 7-1h to 8t was referred to the City Engineer for checking the validity of petitioners. PROPOSED ORDINANCE REGULATING INVASION OF STREET R/W A motion was made by'Councilman.Bennett, seconded by Councilman Kincaid that Ordinance #1394 be passed, regulating the.laying of various utility lines or conduits by, along or across City right-of-ways, requiring fees and inspections and providing penalties.. Motion cariied.unanimously. AUDITING OF BILLS The Auditing.Committee having gone over the regular monthly bills, a motion was made by Councilman Slye, seconded by Councilman Nordquist that vouchers #7566 through #7697 in the amount of $71,202.07 be approved for payment and the City Clerk be authorized to draw warrants in payment of same. Motion carried unanimously. It was moved by Councilman Slye, seconded by Councilman Nordquist that Warrant #35 to J. J. Jackson, Inc. for estimat #1 for the construction of and furnishing of Watermains and Appurtenances, Phase II in the amount of $27,587.38_be approved for payment and the City Clerk be authorized to draw a warrant in this amount for the 1967 Water -Sewer Revenue Bond Issue. Motion carried. A motion was made by Councilman Slye, seconded by Councilman Nordquist that the following LID bills be paid: LID #140 - $17.85 to the Edmonds Tribune Review for legal publication; #160 - $35.95 to the Edmonds Tribune Review for legal publication,•and the City Clerk be author- ized to issue interest bearing warrant to the City of Edmonds in that amount; LID #161 - $4,655.47 to Bass Construction Company for contractors estimate #3, David M. Larson and Beverly B. Larson, $75.00 for easement for sewer line, and $60.00 to Charles'Lee. Helgesen and Deone D. Helgesen for easement for sewer line and the City Clerk be authorized to issue interest bearing warrants to Grande and Co., Inc. in the amount of $4,790.47 to cover these bills; LID #162 - $13.65 to the Edmonds Tribune Review for legal publication. Motion carried. CORRESPONDENCE Mayor Harrison reported a letter had been received from Raymond D. Poorman, 8802 205th P1. S.W., • concerning the proposed widening of 88Lh. The letter.was turned over th the City Engineer for processing. A letter from Armin K. Lafferty,.1317 Pine St., was read concerning the drainage problem on his property. Engineer Larson reported that this problem had been considered before and it was felt that it should be left and done when the overall drainage problens of the City were done. However, this is a problem of the City of Edmonds and not Mr. Lafferty's and should be taken care of. Engineering cost estimate made 7 months ago placed the cost at $19935.00. Councilman Tuson moved, .seconded by Councilman Kincaid that the drainage work on the property of Armin K. Lafferty, 1317 Pine St. be done with City crews and be done immediately. Motion carried. AUDIENCE PARTICIPATION Fire Chief Jack Cooper reported that the elevated platform for the Snorkel Truck has been shipped to the factory in Los Angeles and the truck is ahead of schedule. Chief Cooper also reported that the Washington Survey & Rating Bureau has been working in the City of Edmonds for the past week and perhaps will adjust the insurance.rating of the city. Captain Shields asked about an article in the paper which stated that property must be platted. Planner Logan explained that a piece of property only needed to be subdivided unless divided into 4 or more lots, then it must be platted. Frances C. Hunter, 711 Puget Lane said she had filed a claim against the City of Edmonds and Slead and Tonnesen last April, for reconstruction work to her front lawn due to LID 151. The insurance company said this was a valid claim and a letter had been written to Slead and Tonnesen, but she has not heard from them. Engineer Larson reported that the City of Edmonds is holding a certified check for $1,500.00 from Slead and Tonnesen, and that we could cash this check and in turn pay Miss Hunter. It was moved by Councilman Bennett, seconded by Councilman Tuson that the City of Ed- U 466 monds cash the certified check of Slead and Tonnesen in the amount of $1,500.00 and in turn pay Frances C. Hunter her claim of $219.45 for reconstruction work done to her front lawn. O Motion carried. COUNCIL PARTICIPATION Councilman Haines expressed the opinion concerning the Pine Street storm sewer work, that the City should not do the storm sewer work piece meal, but do the City --overall. He also said that perhaps the University property would be offered to the City first for development. Councilman Haines moved, seconded by Councilman Bennett, that the Mayor appoint a Citizens' committee to study the possible use of University property as a recreational site, golf course, etc. self supporting or with help. Motion carried. Councilman Slye stated that if.we had honored the University request at first talk of zoning, perhaps we would have no.problems with them now. Councilman Nordquist asked if there was still a moratorium on the Five Corners area for sub- dividing, and was told by the City Engineer that it would be in effect until storm sewer problems were resolved. He also stated that it appeared the City of Edmonds is allowing poles to be placed everywhere and we should have more control. Engineer Larson said that is what the new ordinance passed tonight would control. Councilman Bennett asked that information be supplied to the council on parchases of the various departments over a years time so the feasibility of hiring a Purchasing -Agent could be ascertained. Councilman Kincaid said the council should look ahead to the time when City Supervisor Don Lawsonunuld be retiring and perhaps hire an administrative assistant who could also handle the Purchasing Agents job and train for the Supervisors position. Engineer Larson was asked about the completion of LID #161 and said.perhaps it would be done by the end of the year. Councilman Bennett feels that after fair effort to complete a job, such as LID #140, the City should notify the bonding company that it will move against the bond. It is not the Engineer's responsibility to have to try to get the job done in these circumstances. CLAIMS FOR DAMAGES Council acknowledged claims for damages from Robert Anderson, 18310 Sunset Way, $2.00 and George Johnson, 7232 174o S.W. $18.81. These were referred to the City Clerk for processing. SET DATE FOR HEARING ON PLANNING COMMISSION RESOLUTIONS #290 AND #291 Planning Commission Resolution #290 to rezone in the Pine Ridge area from RS-8 to RS-12 as described in Planning Commission File R-14-68 was presented to council. It was moved by Councilman Slye, seconded by Councilman Bennett that November 19 be set for hearing on Planning Commission Resolution #290. Motion carried. Planning Commission Resolution #291 to amend the comprehensive plan as described in Planning Commission File AO-7-68 to redefine mobile homes and trailers and list as a prohibited use in residential districts was brought before the Council to set for hearing. A motion was made by Councilman Slye, seconded by Councilman Bennett that November 19 be set as the date for hearing on Planning Commission Resolution #291. Motion carried unanimously. BID DATE FOR UNITS 2 & 3 CONSTRUCTION & MATERIALS It was moved by Councilman Slye, seconded by Councilman Bennett that November 18, 1968 at 2:00 P.M. in the Mayor's office be set as bid opening for materials and construction for Units 2 & 3. Motion carried unanimously. e City Engineer Leif Larson reported that the State Legislative Committee for Urban Arterial Development held a hearing in Everett to get the reaction to their program from the various cities. He said he was impressed with their program and that work was progressing favorably. There was no further business to come before the council, and the meeting adjourned. AUTHORIZATION FOR PURCHASE OF POLICE CARS A letter was read from Police Chief Grimstad recommending that the two bids opened on October 21 for the 4 police cars be denied for reasons of high costs, and that the City of Edmonds join with the City of Seattle in the purchase of these vehicles, which would result in a substantial saving to Edmonds.
