19700505 City Council Minutes• MAY 59 1970 'ROLL CALL, The regular meeting of the Edmonds City Council was called to order by Mayor Harve karrison with all councilmen present except Sanborn. APPROVAL OF MINUTES The minutes of the council meeting of April 21 had been posted and mailed, and with no corrections nor omissions, they were approved as written. PROCLAMATION Mayor Harrison read a proclamation declaring the week of May 3 to 9 as "Be Kind to Animals Week". HEARING: FINAL ASSESSMENT ROLL - LID'#=173 Hearing on the final assessment roll for LID #173, sewering the petitioned portion of Unit 7, had been continued from the. meeting of April 21. City Engineer Leif Larson asked council for an extension of the hearing to June 2 in order to allow one pro- perty owner who had formerly been unintentionally omitted from the assessment roll to secure financing for prepayment as required. It was therefore moved by Councilman Nordquist, seconded by 6ouncilman Nelson that the hearing on the final assessment roll for LID #173 be continued to June 2. Motion carried. ORDINANCE TO REMOVE TERM "DISTRIBUTION CENTERS AND ACCESSORY STORAGE" FROM LIST OF PERMITTED USES IN CW ZONES • The Attorney had been instructed by motion at the meeting of April 21 to prepare -an ordinance to remove the -term "distribution centers and accessory storage" from the list of permitted uses in CW zones. Following some council discussion, it was moved by Councilman Nelson, seconded by.Councilman Nordquist that proposed Ordinance #1482 be passed, and the motion carried with four councilmen voting in favor; Councilman Slye against; and Councilman Haines abstaining because of interest in waterfront property. FINAL PLAT - O'MALLEY'S ADDITION City Planner Merlin Logan presented for council review the final plat of O'Malley's Addition, located on the SE corner of Cherry Street and 9th Avenue North. After a brief explanation, City Engineer Leif Larson addressed council on the question of engineering requirements, specifically for storm drainage, needed here to meet what he felt were acceptable standards. Richard Dickson, Chairman of the Planning Com- mission, was asked how the Commission felt about this plat when they considered it, and he answered that there was considerable doubt at the time if the platter should be asked to make expensive improvements such as the engineer suggested, which might prove to be of a temporary nature if a full improvement is made sometime in the future. City Planner Logan stated that the fairest move in his estimation would be to postpone any action until the owners could be present to speak in their own be- half. No one in the audience wished to comment. Following discussion, a motion was made by Councilman Kincaid, seconded by Councilman Nordquist that the matter of the final plat of O'Malley's Addition be set for a second consideration on June 2, to allow time for an engineering survey of the situation and for the proponents to be advised that it would be on the agenda at that time. Motion carried. DISCUSSION OF SUGGESTED OIL LEASE IN PUGET SOUND • In regard to the recent controversy over the proposal to drill for oil in Puget Sound, Mayor Harrison announced that a tremendous flood of protests had been received from citizens alarmed over the possibility of oil leaks polluting the Sound. 1 1 Doug Egan, representing the Edmonds Chamber of Commerce, showed slides of the oil spillage that took place in Santa Barbara, and the extensive damage to the beaches, boats, and waterfowl. During discussion, City Attorney Murphy noted that a 1909 state statute under "miscellaneous", which was recodified in 1965, gave all incor- porated cities, etc. fronting on waters jurisdiction to midpoint of that body of water. It was his consideration that the city should amend the comprehensive plan and zoning ordinance with appropriate exemptions, and make a concerted effort to coordinate this action with all other units of government fronting on the Sound, and that this be'done with dispatch. He suggested that instead of, or in addition to a resolution, that an ordinance be passed following hearing by the Planning Commission. After discussion, it was moved by Councilman Haines, seconded by Councilman Kincaid that the council direct the Planning Commission to schedule as soon as.possible a hearing to amend the comprehensive plan and zone the adjacent -Puget Sound area to mid- point. Motion carried. A motion was made by Councilman Nordquist, seconded by Councilman Kincaid that a Resolution be prepared, protesting any action regarding the proposal for oil drilling on Puget Sound, and copies be sent to the Department of Natural Resources, the Oil and Gas Conservation Committee, the State Legislators, and the Governor. Motion carried unanimously. 0 Councilman Haines then suggested, with full council approval, that the:Mayor and City Attorney be • authorized to notify all surrounding governmental units fronting on Puget Sound of Edmonds' action and request they participate by coordinating action within their jurisdictions. Councilman Haines then suggested correspondence be sent to Bert Cole, Dept. of Natural Resources, and the state legislature, stating that the City of Edmonds is against placing a dollar and cents valuation on natural resources; that a modification or guide lines was wanted with less concern put on the high rate of monetary return for leasing of state lands. Councilman Haines then incorporated this in the form of a motion, seconded by Councilman Tuson, that the City Attorney be instructed to write a letter with this suggestion. Motion carried. ANNEXATION: EDMONDS WAY R/W WEST OF HIGHWAY 99 City Engineer Leif Larson explained the proposal to annex a portion of R/W north of Sambo's to 204th, for the purpose of reducing the cost of a sewer line relocation. He added the State indicated it had no objection. A motion was then made by Councilman Slye, seconded by Councilman Nordquist that pro- posed Resolution #225 be passed, and the hearing date be set for June 16. Motion carried. CORRESPONDENCE A letter to Councilman Tuson from Detective Charles H. Riley was read, asking for formal recognition to the Edmonds Police Reserve Unit for their duties and dedication to the community. It was moved by Councilman Tuson, seconded by Councilman Kincaid that the Mayor write a letter of appreciation and a copy be sent to each Reserve commending him for the fine job done in behalf of the city. Motion carried. It was Ithen?moved by Councilman Nordquist, seconded by Councilman Slye that a letter of appreciation also be sent to each Volunteer Fireman for his services to the city. Motion carried. A letter was read from Bennett Box, member of the Board of Adjustment, suggesting that the procedure on requests for conditional use permits for home occupations be revised, since this takes most of the Board's meeting time and 90% are granted. He felt these might well be administrative decisions and • handled without Board meetings unless a particular problem arose. Council decided to review this matter and discuss it before taking any action, and this was to be put on the next work meeting agenda and brought up at a council meeting in the near future. Mayor Harrison read a letter received from an Edmonds High School student complaining about the dangerous conditions walking to the bus stop on 196th and asking if something could be done for instal- lation of sidewalks. This was referred to the Safety Committee. COUNCIL PARTICIPATION Councilman Nelson spoke about the volume of interest in the schoollsafety programs as indicated by sur- vey sheets, and there was concern by some citizens for more police patrolling of certain areas at certain times. Councilman Haines inquired if the Mayor had appointed an Ecology Committee. Mayor Harrison answered that he had. Councilman Haines then asked if the committee could come up with a theory or guideline on certain areas of interest to the city council. Councilman Nordquist asked about the status of the flag contest. He wondered if the city had pursued the matter of having flags made up. Chief Administrative Officer D. C. Lawson answered that it would cost approximately $175.00 for one flag. After some discussion, it was decided that the CAO pursue the field of suggesting to the schools, PUD, etc. that a city flag be purchased by each. Assistant Police Chief Crain reported to the.council that both the Fire and Police Depts. have ordered shoulder patches with the new flag insignia. The Mayor noted that it might also be added to the city station- ery and incorporated into the -present design in some way. CAO Lawson was asked to investigate this in regard to the stationery. Councilman Nelson inquired about the status of the proposed Underwater Park at Sunset Beach. Attorney Murphy answered that a survey had been made by the Dept of Fisheries who stated this area could be • made into a game preserve. He had also written to the Dept. of Natural Resources, Toll Authority, Corps of Army. Engineers, and the Port of Edmonds. Approval for the proposed underwater park had been received from all except the Port, who probably had not as yet had its regular meeting, and Attorney Murphy stated he anticipated no problems. However, a hearing would have to be held by the Dept. of, Fisheries to declare the area a game preserve. Councilman Nelson inquired about damage claim reports against the city, and CAO Lawson stated that he would see that the council received a monthly report on the disposition of each claim from the insurance company. SET BID DATE - SUNSET BEACH RESTROOM Plans were to be completed for the proposed restrooms at Sunset Beach, and it was recommended that a date for opening of bids be set. A motion wasnmade by Councilman Slye, seconded by Councilman Nordquist that bids be opened on May 25 for the restroom at Sunset Beach, and the motion carried. RESET PRELIMINARY ASSESSMENT ROLL HEARING DATE At the recommendation of the City Engineer, a motion was made by Councilman Tuson, seconded by Councilman Kincaid that Resolution of Intention #231 be passed, repealing Resolution of Intention #230, to install water mains and appurtenances in Driftwood Lane between 8th and 9th, and 8th between Driftwood Lane and Puget Drive, and the hearing on the preliminary assessment roll be set for June 16.
