19700519 City Council Minutes• May 19, 1970 ROLL CALL The regular meeting of the Edmonds City Council was called to order by Mayor Harve Harrison with all councilmen present. APPROVAL OF MINUTES Councilman Haines noted that on Page 2, paragraph 4 of the minutes of May 5, it should read that the guidelines were wanted for land for public uses. The minutes then stood approved as corrected. PROCLAMATION Mayor Harrison read a proclamation declaring July 18, 1970 as Fire Department Field Day and noted that the Edmonds Fire Dept. would compete in exercises against other departments on that day in Everett. CHANGE OF LOCATION FOR'JUNE 16 COUNCIL MEETING Noting that the Edmonds Art Festival will be using the council chambers at the Civic Center on June 16, Mayor Harrison announced that the June 16 meeting of the Edmonds City Council will be held in the Little Theatre -at the Edmonds High School. UNDERWATER PARK. The Mayor announced that a dedication ceremony for the proposed underwater park site • at Sunset Beach would take place on May 23 at 11:00 A.M. and Scuba Diving Club mem- bers would be in attendance. HEARING: APPEAL FROM PLANNING COMMISSION RESOLUTIONS #330 AND #331 Appeal had been received from the recommendations of -the Planning Commission in their Resolutions #330 and #331, to deny requests for waterfront zoning in Files ZO-2-69 and R-8-69. Councilman Haines asked that the minutes reflect that he would abstain from any action on this matter because of waterfront interest. City Planner Merlin Logan explained the; -proposed zone for height limitations, etc. on the original application, and a rundown on the three Planning Commission hear- ings held on these. Petitions had been submitted against the proposal. He also briefly read a summary of the findings of the Planning Commission on the question, wherein it was stated that this request was out of character for Edmonds and against the wishes of a great matey of its citizens. Mayor Harrison also read a petition with 561 signatures opposing any changes in the height limitations for the CW zone. Hearing was them opened. Steven Cook, 750 Edmonds Street, stated that he was against removing the present height limitations on the waterfront, and that such a move would in fact ruin the view for many people. Attorney William Wilson, for the appellants, gave a brief talk on the proposal and noted where a group of waterfront owners had met to see what could be done to improve the area. They were in agreement that certain parcels were unsightly and decided a solution was needed. They therefore hired Val Rupeiks to make a study and them told the City a zoning change would be -,:necessary in order • to develop the area. The only problems they felt would be limitation or restriction of view, and citizens opposing hi -rise on the waterfront. The City Planning Staff made a separate recommendation to the Planning Commission and'were also denied. The proponents were therefore asking the City Council.,:for consideration on other than the present 35 ft. height limitations, parking, and setbacks. Pat Welling, 18711 Soundview Placq representing the Algoma Garden Club, stated they had turned in petitions with 500 names; the Club wasconcerned with the development of Edmonds and opposed to hi -rise on the waterfront. Jim Mueller, 209 Casper, repre- senting PRIDE, reminded the council of the accepted philosophy - that Edmonds desires to be basically a single residential city, and any attempt to modify this would be undesirable. He mentioned the response to signing of the petitions was great, and in protest to hi -rise. He added that council perhaps should consider the possibil- ity of zoning the waterfront open space for aquatic recreation, and a bond issue for this purpose.from the ferry dock to Dayton Street. No one else in the audience wished to comment, and the hearing was closed. V Questions were then asked by the council members, and it was asknowledged that some- thing constructive should be done withthe waterfront. A motion was made by Council- man Tuson, seconded by Councilman Nordquist that the recommendation in Planning Com- mission Resolutions #330 and #331 be upheld and the requests be denied. Motion carried with Councilman Haines abstaining. PROTEST ON PROPOSAL FOR OIL DRILLING ON PUGET SOUND - Council had directed the City Attorney to prepare a resolution protesting any proposed drilling for oil in Puget Sound, and a motion was made by Councilman Haines, seconded _ by Councilman Nelson that proposed Resolution #226 be passed. Motion carried. CJ 8S AUDITING OF BILLS • A motion was made by Councilman Haines, seconded by Councilman Nordquist that the following LID bills be paid: LID #164 - $944.68 to Ewing Electric Inc. for estimate #2, standby generators; LID #167 - $2,655.00 to Western Sewer & Construction Co., Inc. for contractor's estimate #2; and the City Clerk be authorized to issue an interest bearing warrant to City of Edmonds in the same amount to cover this bill; LID #176 - $150.00 to Earl L. Stay for appraisal services, and the City Clerk be authorized to issue an interest bearing warrant to City of Edmonds in the same amount to cover this bill; LID #180 - $25.00 to Edmonds Tribune Review for legal publications, and the City Clerk be authorized to issue an interest bearing warrant in the same amount to cover this. Motion carried. It was moved by Councilman Haines, seconded by Councilman Slye that payment of warrants #52 and #53 be authorized against the 1967 Water -Sewer Revenue Bond Issue in the amounts of $968.79 to Reid, Middleton & Associates, Inc. for engineering and related costs for outfall extension evaluation study and report, and $600.00 to State of Washington Dept. of Natural Resources for easement charge for outf all over vacated Dayton Street waterway. Motion carried. , A motion was made by Councilman Haines, seconded by Councilman Tuson that vouchers #10669 through #10833 in the total amount of $124,349.43 be approved and the City Clerk be.authorized to issue warrants in payment of these regular monthly bills. Motion carried. AUDIENCE PARTICIPATION Dave Larson, 2110 - 86th P1. W., stated that he was concerned with the use of motor- bikes on property other than public R/W in his neighborhood and he requested that an ordinance be drawn to restrict their use to public streets. Following discussion, it was moved by Councilman Haines, seconded by Councilman Sanborn that the City Attorney be authorized to prepare an ordinance to prohibit use of motor vehicles in parks and on private property without the permission of the owners. Motion carried. COUNCIL PARTICIPATION Councilman Sanborn had a question_:,on whether a proposal had been received by the; state to pave part of Puget Drive. CAO D. C. Lawson answered that only Casper Street has been approved as far as he knew. Councilman Nelson stEt.ed that the Capital Improvements committee and staff were pre- pared to present the capital improvements program to the city and scheduled the June 2 council meeting for formal presentation and acceptance. Mayor Harrison inquired about a proposed ordinance for prohibiting spear fishing in the underwater park area and Attorney Murphy stated that he had not yet heard from' the Port on this question, so felt that this should be taken care of first. CLAIMS FOR DAMAGES A claim for damages was acknowledged from Mrs. Edith Schurr, and this was referred to the City Clerk for processing. 1 1 • ACCEPTANCE OF UAB MAIN STREET PROJECT Engineer Larson recommended acceptance of the Main Street UAB project, and it was • moved by Councilman Slye, seconded by Councilman Nordquist that the city accept the Main Street UAB project. Motion carried. AUTHORIZATION FOR CONDEMNATION PROCEEDINGS ON 76th Attorney Murphy reported that in regard to the proposed ordinance to authorize con- demnation proceedings on 76th, the property owners had accespted the city offer and therefore condemnation was not necessary.
