Council members Gellert Shippen and Nordquist will sit in on the meetings when exempt position applications are reviewed. Councilman Gellert asked for a one week notice regarding these' meetings. Mr. Whaley said he would advise of the schedule. Mr. Whaley passed out a draft of a Manpower Training Agreement. He then briefed the council and read parts of the agreement. Council -members stated that they would like to have more time to consider this item and therefore a motion was made by Councilman Gellert and seconded by Councilman Nordquist that the Manpower Training Agreement discussion be put on the agenda for April 3rd. Harrison, Mayor Regular meeting of the Edmonds City Council was called to order at 7:30 P.M. by Mayor Protem Natalie Shippen, with all council members present except Anderson and Nelson, who was in Olympia attending a Legislative Session. APPROVAL OF MINUTES • Minutes of the council meeting of March 27 had been posted, mailed and dis- tributed. Councilman Nordquist called attention to Par. 1, 2nd line from bottom on page 4, referring to "his attorney". He would like that changed to "owner's" attorney. In the next paragraph on page 4 regarding the vehicle bid opening, Councilman Nordquist would like it stated that the bid amounts included sales tax. Mayor Protem Shippen then said that the Deputy City Clerk had called to her attention that the dates for Cleanup Week, mentioned on page 6, should be changed to April 21, 1973 to May 1, 1973, instead of April 28 to May 1. The minutes were then approved as corrected. COUNCIL PARTICIPATION Councilman Tuson stated that he had received a letter dated March 29th regarding a gas line installed in Edmonds under Dayton Street. In the letter he was advised that the Gas Company rebored and installed the line to a depth of 30". Councilman Gellert said he had noticed that whenever a new house was built on 88th Avenue West, the street was ripped up, He asked if utilities were not supposed to be brought to the lot line? City Engineer, Leif Larson, stated that the water lines are part of the old Alderwood Water Lines and the water service lines are put in as they are needed. Councilman Gellert then asked if we are requiring that the person who tears up the road does an adequate job of restoring the road surface. *Mr. Larson said this is being done. Councilman Nordquist referred the council to a letter he had inserted in each. mailbox this evening. The letter was from the Snohomish County Council on • Alcoholism and he asked the council to review this. Mayor Protem Shippen reminded the council that representatives from CLAWS were present at the last council meeting, and at that time Mrs. Shippen said she would attend a meeting scheduled for last Thursday. The animal control problem was to be discussed. At this meeting Mrs. Shippen was asked to request a Resolution of Sympathy from the Edmonds City Council. Councilman Gellert said we have an animal control agreement for one year and he would be reluctant to break this contract. Mrs. Shippen stated that this is to be simply an expression of interest in a unified method of animal control. Police Chief, Marlo Foster remarked that he thought it was inevitable that we get into this sort of agreement. Following some discussion, Mayor Protem Shippen made a motion seconded by Councilman Tuson that Edmonds express an interest by Resolution in establishing a South Snohomish County Animal Shelter to be a multilateral approach to the animal control problem. Motion carried. Mayor Protem Shippen noted that we have been asked for appointments to Snohomish County Solid Waste Disposal Steering Committee. She said she has appointed herself to this committee and would be open to.suggestions from anyone else that would like to volunteer. Councilman Gellert suggested that �y perhaps the City Engineer should attend these meetings. Mr. Larson stated that he has been connected with the Washu Study for some time and attends the meetings. Mayor Protem Shippen asked if anyone would object to moving the CAO Report from the bottom of the agenda to a place following the Audience Participation portion. After a brief discussion it was thought that following the • 436 • Correspondence item would be a better place. A motion to that effect was made by Councilman Tuson and seconded by Mayor Protem Shippen and carried. CORRESPONDENCE The Deputy City Clerk read a Notice of Claim of Lien stating that the Water Department of the City of Edmonds had a claim in the sum of $102.73 against the bond taken from Knowles Construction Company and Argonaut Insurance Company for the work of storm sewer construction in the Five Corners Area. CAO REPORT CAO Ron Whaley advised the council that there would be an executive session after the meeting. Mr. Whaley said that the City Engineer requested that the council set a bid call date for LID 191 which is the sewerage for the area south of the Meadow - dale Junior High School. He requested that date be April 26, 1973 at 2 P.M. A motion to this effect was made by Councilman Gellert and seconded by Council- man Tuson and carried. Mr. Whaley stated that Gov. Evans has signed a bill bringing it into law, placing the burden on the cities to pay for the cost of court appointed attorneys for indigents. He said he had received a letter from Judge Atwell indicating this and what our charges are for the first three months, and it looks like it is averaging around $850.00 per month. Judge Atwell indicated that the city's cost in paying these attorneys would be withheld from fines, forfeitures, etc. that would normally come to the city. There was some discussion with • regard to this, and Mrs. Shippen asked if the City Attorney could have an opinion for the council next week after he had time to review the matter. CAO Whaley then said that he had attended a seminar on Human Resources at Sea-Tac Inn which had been advertised by the Puget Sound Governmental Conference. Mr. Whaley said that he thought the course pertained more to "New Federalism". He said it was an outstanding seminar which set forth information on what local and state government can look forward to in change of concept from the Federal level`to state and local government on funding. He will reduce this to a brief report and submit it to council for their perusal in the near future. CAO Whaley stated that he had seen an outstanding movie last week entitled "Multiply and Subdue the Earth". Arrangements have been made to have this film here on Thursday, April 19th at 7:30 P.M. for viewing by anyone interested. This will be shown in the Council Chambers. AUDIENCE PARTICIPATION Mr. Joe Mueller said there have been many sic#ings in recent days of rats in the area along Casper Street from 3rd to Brookmere Drive. They are in the Shell Creek Area primarily, and range in size from 12 to 20 inches. Mr. Whaley stated that we have a contract with Able Pest Control and he will get in touch with them tomorrow. PROPOSAL FOR YOST PARK LANDSCAPE DEVELOPMENT PLANNING Rod Gar.retson, Park and Recreation Director said he was coming before the council to request employment of an architect to plan the landscaping for Yost Park Pool. He stated that they have $6,000 in the budget for this year • for the planning of several parks and the Park Board has designated Yost Park as its 41 priority. Mr. Garretson and the Park Board feel that they wish to employ Talley and Associates to do this job, since they have many years of experience. This project would be to design the landscaping for the entrance to Yost Park, the parking areas for the pool and the earth bank to the south and east of the pool. Talley and Associates have indicated an hourly rate of $18.00. They also estimate a maximum of 116 hours to do this which would make a total cost of $2,088.00. Councilman Gellert asked why the Park Board felt this project should take precedence over the neighborhood parks, since they have been neglected for too long. Mr. Garretson stated that the Park Board felt Yost Park should be first since there is a tremendous amount of traffic here and the.area around the pool should be cleaned up and done right the first time. Mr. Garretson said the priority list showed Seaview next, then Holly School Site; Pine Ridge and Sierra. Mrs. Shippen thought it would be wise to submit priorities to the council so that it can be reviewed and discussed by the council. Councilman Tuson inquired about the $15,000 contingency fund for the pool and wondered how much of that is left. Mr. Garretson replied that it was something in the neighborhood of $13,000. Councilman Tuson thought we would be robbing the neighborhood parks if we take money out of the $6,000 budgeted for them, rather than using money already earmarked for the pool. He also said he would rather have a specific amount set for the project instead of working on an hourly rate. Following some further discussion, a motion was made by Councilman Gellert and seconded by Councilman Nordquist that we accept the Park Board recommendation of Tally and Associates for landscape development planning for the Yost Park Pool Site at $18 per hour, not to exceed 116 hours, said monies to be taken from Swimming Pool Contingency Fund. Motion carried. 437 • 1 1 • • 1 CONSIDERATION OF EDMONDS' CONTRIBUTUION TO SNOHOMISH COUNTY METRO COUNTY- WIDE PUBLIC TRANSIT STUDY. Mr. Vic Sood stated that the total cost of this study is estimated at $70;000. He said it appears that a grant would be available from the Urban Mass Transportation Administration amounting to two-thirds the cost of the county- wide study. The applicant must provide assurance that the local share is available in cash or in services, and that no portion of this represents Federal monies of any kind. The local share of the cost is $23,333, and pro -rated. on basis of population, Edmonds' share would be $2,980.16. Letters of commitment from all the jurisdictions have to be submitted for the final grant application. Mayor Protem Shippen asked who comprises the Metro. Council. Mr. Sood stated that the members were: Mayor of Edmonds, Lynnwood, Mountlake Terrace, the three County Commissioners and Mayor Balser of Brier who represents the jurisdictions of Brier, Mukilteo and Woodway; and also two lay members and the chairman, Mr. John Whittaker. Mr. Sood said at this point that he would like to call on Mr. Allen Hendricks, who has done all the legal work for Metro since its re -activation. Mr. Hendricks stated that the Mayors would serve until their terms expire. The chairman is on a rotating basis and is selected in even number years. Methods of financing Edmond suggested 50% in cash and 5 has done work with the Met r CONSIDERATION OF MANPOWER TRAINING STUDY CAO Ron Whaley reported that under the present policy for providing funds for training unemployed and underemployed -persons, Block Grants will be given to specified areas based upon population, the unemployment ratio, welfare rolls ratio, etc. That Block Grant is given to the area and the person who holds the highest office within the area representing the largest population count, is the chief administrator of those funds. In --our case, this Block Grant covers King and Snohomish Counties and Mayor Uhlman of Seattle would be the administrator of these funds. There is a subdivision below this level of the Mayors (or their appointees-) representing cities in excess of 20,000 in population; and representatives or the commissioners of the two counties 'representing all unincorporated areas or those cities of less than 20,000 population. Besides the two counties, the cities on the Executive Committee will be: Auburn, Bellevue, Edmonds, Everett, Kent, Redmond and Seattle. This committee, after signing a joint agreement, will be charged with administering these Block Grant Funds for the purpose of establishing training programs for unemployed, disadvantaged, etc. Mr. Whaley said there is an administrative staff presently establishing being funded by a grant from the Department of Labor. The administrative staff works with those people in the community who either by contract or through some estab- lished program will provide training to all of these individuals. The job of the Executive Committee is to work with the Administrative Staff to establish priorities as':to what programs would be supported and to what degree, and with what percentage of these funds. There was some discussion and it was asked if there would be an advantage to the city. Mr. Whaley replied in the affirmative and cited reactivation of the NYC Program as a possibility. Mr. Whaley advised the council that he will be meeting with Mayor Uhlman and other parties concerned on Friday at 8:00 A.M. After some discussion, a motion was made by Councilman Nordquist and seconded by Councilman.Winters that the City of Edmonds enter into this inter-a%ency agreement to provide programs to aleviate the unemployment and underemployment conditions in King and Snohomish Counties. Motion carried. FINAL PLAT OF NOVOLEEN'S PARK (FORMERLY SWAN'.S ADDITION) City Engineer, Leif Larson reported that this plat had been approved by the Planning Commission in April, 1969, and then the plan was not developed until 1972. They have either completed utilities and services as required or bonded for them. Mr. Larson recommended approval of the plat. A motion was made by Councilman Nordquist and seconded by Councilman Winters that Final Plat of Novoleen's Park (formerly Swan's Addition) be approved subject to engineering and planning requirements. Motion carried. SET FOR HEARING: PLANNING COMMISSION RESOLUTION.4404 - PROPOSED AMENDMENT TO OFFICIAL ZONING MAP TO REZONE :FROM GC TO BC THAT PROP- ERTY DESCRIBED IN PLANNING COMMISSION FILE.:R-1-73. 0 A motion was made by Councilman Tuson and seconded by Councilman Nordquist 438 to set hearing for April 17 on Planning Commission File #R-1-73. Carried. • PREPAYMENT ORDINANCE LID 4186 - UNDERGROUND VIRING -,SUNSET FROM CASPER TO EDMONDS. Mr. Dewey Leyda, who was in the audience, stepped flollrlward and read a property description that had been published in the Tribune -Review. He stated that a street light had been installed outside of their boundaries, but that they had been charged for it. He also questioned the amount of the PUD bill. Another item was the interest which was charged. After some discussion, a motion was made by Councilman Nordquist and seconded by Councilman Gellert to pass Ordinance 41653 stating that the cash pre -payment period for LID 186 has expired. The motion carried, with Councilman Tuson abstaining from voting as he is one of the residents in this area. PREPAYMENT ORDINANCE LID 4189 - SEWERS - 85th PLACE WEST A motion was made by Councilman Nordquist and seconded by Councilman Winters to pass Ordinance 41654 stating that the cash pre -payment period for LID #189 has expired. Motion carried. SNOHOMISH COUNTY TRANSPORTATION STUDY REPORT City Engineer, Leif Larson reported on this item. He placed a map on the bulletin board and indicated certain areas that had already been brought to standards as mentioned in this study: He reminded the council that on May 18th he made a presentation of the plan which indicated what was being done. Then in June a discussion was had on the street standards, and it was the recommendation of the City, that the design standards of the streets in the City -of Edmonds be no higher than those that we had adopted. This was written in.a letter to the Technical Coordinating Committee, however they did put higher standards in the Transportation Study. Mr. Larson felt that we should use this only as a guideline. Mr. Larson stated that no motion was needed tonight, but that he would recommend we have a resolution at some future date to adopt portions of this map. PROPOSED RESOLUTION INDICATING EDMONDS' PLAN TO CONFORM TO PUBLIC LAW 92-500 BEFORE JULY 1, 1977. This is a resolution to authorize application for a grant for upgrading the sewage treatment facilities pursuant to the Federal Pollution Control Act under Public Law 92-500, October 18, 1972. Councilman Nordquist read a portion of a memo which had been sent to Gary Nelson by R. Jerry Bollen, of the Washington Department of Ecology wherein "secondary treatment" is defined. It had been defined as 11850/'0 removal of biochemical oxygen demand and 90% removal of suspended solids from domestic wastes with adequate disinfection". This definition had been challenged by the EPA in recent months. A draft of a regulation proposal was circulated with the result that this definition was pulled back for revision, so there still is no definition. A motion was made by Councilman Gellert and seconded by Mayor Protem that Resolution #276 be adopted. There was some discussion regarding the Mountlake Terrace Industrial Park. Councilman Tuson asked that when the time comes we should review the Mountlake Terrace Sewer Contract. Following a roll call vote, the motion failed with Councilmen Tuson, Nordquist and Winters voting no. There being no further business to come before council, the meeting was adjourned at 10:00 P.M. Councilman Nordquist stated that on Page 2 under Audience Parti- cipation, Mr. Joe Mueller should be corrected to read Mr. Jim Mueller.
