19760511 City Council Minutes428 He stated it is a light duty grader, about 113 the size of the usual grader. It is proposed to • replace the 1965 maintainer they presently have. The present one is a high maintenance vehicle. He stated the item has been placed in the budget and explained how it would be paid for. He - requested authorization to call for bids. On questioning he gave figures projected to repair the present maintainer, saying it needed tires at $1,100, work on the clutch at $475 to $500, and that the engine was rebuilt in 1972 and was due to be replaced soon. Also, the frame has been welded in many places. He said he would expect at least two bids, He said it was difficult to compare to comething like a streetsweeper insofar as contracting for rental of one because it is not used for one specific function. There was further discussion about costs and the Council felt that because they were unfamiliar with the piece of equipment and because of the high cost MOTION: of purchasing it they should have more information before making a commitment. THEREFORE, A MOTION WAS MADE BY COUNCILMAN NORDQUIST, SECONDED BY COUNCILMAN CLEMENT, TO POSTPONE .THIS ITEM FOR ONE WEEK AND THAT PUBLIC WORKS SUPERVISOR HERB GILBO PREPARE AN IN DEPTH PRESENTATION TO PRESENT TO THE NEXT MEETING. AUTHORIZATION TO CALL FOR BIDS FOR LIBRARY CARPETING Librarian Kathy Turner reviewed this request to call for bids for approximately 425 square yards of acrylic nylon or continuous filament nylon carpet for the Edmonds Library. She.stated this has been budgeted for in the 1976 Library Fund. She stated the carpet pad had already been obtain - MOTION: ed and -.was being stored. MOTION CARRIED. • CLAIMS FOR DAMAGES The Deputy City Clerk reported that a claim for damages had been received from Allen and Marlene Weber in the amount of $21.06 and had been forwarded immediately to the insurance company. HARRISON, Mayor May 11, 1976 ROLL CALL The regular meeting of the Edmonds City Council was called to order at 7:30 P.M. by Mayor Harve Harrison in the Council Chambers of the Edmonds Civic Center with all councilmen present except Clement who had advised the Council he would not be present. APPROVAL OF MINUTES Minutes of the regular meeting of May 4, 1976 had been posted, mailed and distributed., and with no omissions or corrections they were approved as written. COUNCIL PARTICIPATION • Councilman Gellert inquired as -to whether the City was still getting an appraisal on Brookacres. City Attorney Wallace replied it had been ordered about six months ago and he had run into the appraiser about :three weeks ago and inquired about it and the appraiser said it was one he had not gotten to yet. The appraisal was to include the Haines property and would cost about $400 to $600. Councilman Gellert suggested canceling the appraisal regarding Broodacres since the MOTION: property was no longer available. A MOTION WAS THEREFORE MADE BY COUNCILMAN CARNS, SECONDED BY COUNCILMAN NORDQUIST, TO CANCEL THE APPRAISAL FOR BROOKACRES. MOTION CARRIED. Councilman Gellert stated he had had the opportunity to see some films taken based on the 201, Study being done for the Kitsap Peninsula regarding the flow of sewage into Puget Sound. He said it had been an interesting film and if the Council were interested in seeing it he could arrange for it to be shown at a work meeting. The Council: -did express interest and Councilman Gellert will try to.arrange it for the meeting of June 29 or another time if that date is not available. The question came up as to whether a schedule had been set for the secondary sewer treatment public hearing. City Engineer Leif Larson said it is being rescheduled, that the hearing will be to inform the public as to what is being studied in connection with the 201 money for the City of Edmonds and to solicit public input and as the study progresses there will be additional meetings. He said we are doing flow studies and infiltration of sewage system studies. Councilman Gellert brought up the Haines property appraisal again and suggested that it would .. be appropriate to ask the appraiser to expedite the appraisal so it can be considered in the park bond issue. CORRESPONDENCE A letter had -been received from Mr. and Mrs. Delbert Johnson, also signed by several of their neigh- bors, regarding the truck traffic going from 196th Street into Edmonds and the accident on May 10 when a truck lost its load. The letter asked for action as to rerouting heavy truck traffic. • • A on • L' • 1 1 Councilman Herb,, said he was concerned about this, that two trucks have overturned there and the first time about 20--children had been there just minutes before, awaiting a school bus. Dis- cussion of the incidents followed and Police Chief Marlo Faster said there had been an effort to try to reduce truck traffic on 196th Street, that letters had been written to the truckers' association and,also to Union Oil Company trying to restrict trucks from using 196th to go . through Edmonds. He said the trucking association had carried the letter in their publication but unless an ordinance to restrict them is written they are going to use whatever route they desire. Chief Foster felt an ordinance should be written restricting the truck traffic. The State Highway plans for 196th Street were then discussed and also the need for sidewalks MOTION: from the bottom of the draw to Caspar. A MOTION WAS THEN MADE BY COUNCILMAN GELLERT, SECONDED BY COUNCILMAN HERB, THAT THE COUNCIL RESPOND`<TO THE LETTER FROM MR. AND MRS. JOHNSON AND THEIR NEIGHBORS BY SCHEDULING A HEARING FOR JUNE 15 ON THE TRUCK TRAFFIC PROBLEM ON 196TH STREET. MOTION CARRIED. Councilman Gould asked what happened to the driver and company as far as the City is concerned. Chief Foster said the apparent cause was that the load was too high on the bed. He said he has asked for an official ruling on the weight of the pipe. He said the driver was doing 20-25 mph and there doesn't appear to be any gross violation of speed. Councilman Gould replied that some- body•was responsible for loading the truck improperly. Councilman Gould then requested that Chief Foster give a report on the outcome of the incident at the June 15 hearing. A letter had been received from Mrs. Patrick Crawford, signed by residents of the Meadowdale Beach area, regarding problems arising from young people flocking to the beach in their area. Problems included speeding automobiles,. parking on private property, trespassing, vandalism and consumption of alcohol and drugs. Chief Foster said as long as a police officer is on the scene there is no ,pooblem and that many manhours had been spent on the problem. He said he felt MOTION: the citizens should seek a solution through the Council. A MOTION WAS MADE BY COUNCILMAN NORDQUIST, SECONDED BY COUNCILMAN GOULD, TO SCHEDULE A HEARING ON JUNE 22 TO HEAR THE PETITION OF THE MEADOWDALE BEACH RESIDENTS AND THAT COUNTY COMMISSIONER FORSGREN BE REQUESTED TO ATTEND. MOTION CARRIED. Councilman Nordquist had received a letter from the City, - .:of Walla asking the City of Edmonds to review a resolution regarding pension reform and binding arbitration for police and firemen and MOTION: give an indorsement. A MOTION WAS MADE BY COUNCILMAN NORDQUIST, SECONDED BY COUNCILMAN CARNS, TO SET AS AN ITEM FOR THE MAY 18 MEETING A DISCUSSION ON THE PROPOSED RESOLUTION. MOTION CARRIED.. M.A.A. Ron Whaley asked that the report on Edmonds' eligibility for federal funding on bikeways be rescheduled from May 25 to May 18. He said the State has changed the application due date to MOTION: May 15 but he has gotten an extension to May 19, the day after the next meeting. A MOTION WAS MADE BY COUNCILMAN CARNS, SECONDED BY COUNCILMAN NORDQUIST, THAT THE CENSUS REPORT BE RESCHEDULED FOR MAY 25 AND THE BIKEWAY REPORT BE RESCHEDULED FOR MAY 18. MOTION CARRIED. Councilman Herb suggested that in order to expedite Council meetings consideration be given to a Consent Agenda where items not requireing individual discussion are grouped together for one vote.. COUNCILMAN HERB THEN MOVED, SECONDED BY COUNCILMAN GOULD, THAT THE SUBJECT OF A CONSENT AGENDA BE DISCUSSED AT THE JUNE 8 MEETING. MOTION CARRIED. LEOFF ACT - GENERAL DISCUSSION (REQUESTED BY DISABILITY BOARD MEMBER) Councilman Nordquist had requested this discussion and he reviewed for the Council the functions of the Disability Board and provisions of the LEOFF Act. The Board consists oftwo Councilmen Anderson and Nordquist, one policeman, one fireman, and Dr. Thomas Schilling, a citizen:, They meet once a month at Stevens Memorial Hospital with the purpose of dealing with disability problems. He said the problems of in-house disabilities had expanded to off -the -job disabilities and finally to problems of alcoholism, instabilities due to marital problems, etc. He said the city to -date has requests for disability payments amounting to $3,200i"and that many of these problems were in the departments before the LEOFF ACT took place and were grandfathered into the system. He said the Police and Fire Departments now have active athletic programs and candidates -are screened very closely for physical problems, but that this was not always the case. Councilman Nordquist wanted the Council to be aware of the existence of this committee and of the fact that the scope of its function is broadening and therefore additional funds may be needed in the future to support the program. He pointed out that there are now initiatives being generated to balance out what appear to be excesses in the LEOFF Act. There appear to be abuses of the system and the costs are building up. M.A.A. Whaley added that cityes had not realized what the impact of the Act would be financially and neither had the legislature. There was further discussion regarding job -related and nonjob-related disabilities for which payments are made and the fact that a person may be on disability and still be employed. City Attorney Wallace pointed out that in addition to the medical benefits the Act provides that upon application for permanent retirement for permanent disability, whether the disability is job related or not, the applicant goes on an up to six month probationary period while he receives full allowances. This is fund- ed by the City and if at the end of six months he is still disabled then the responsibility is passed on to the State, although the Cay pays any uncovered medical expenses. The question was raised as to whether sick leave is exhausted before qualifying for disability and Dr. Anderson stated that generally it depends on whether the disability is job related. Mayor._t; Harrison expressed the feeling that the City should administer it so that sick leave is used first. Councilman Gould pointed out that the Act had been passed because people recognize that policemen and firemen are exposed to very hazardous situations and that although the Act was creating a difficult situation =for the City financially, the positive aspects of the services MOTION: being rendered should be recognized. After further discussion A MOTION WAS MADE BY COUNCILMAN GOULD, THAT THE COUNCIL RECEIVE A REPORT IN 30 DAYS TO INCLUDE A LIST OF DISABILITY RETIREES FOR THE CITY OF EDMONDS, THE REASONS FOR DISABILITY, LENGTH OF TIME DISABLED, COMPLAINT FOR WHICH DISABLED, LENGTH:OF TIME OF SERVICE IN CITY OF EDMONDS, BENEFITS EACH IS NOW RECEIVING, AND WHETHER EACH RETIREE -IS PRESENTLY EMPLOYED. MOTION CARRIED. • 430 REPORT -FROM ENGINEER ON STUDY OF WATER -SEWER RATES AND FUTURE FUNDING OF WATER-SEWER.CONSTRUC- TION FUND • City Engineer Leif Larson said they would give a preliminary overview of the work to date and that they had analyzed present expenditures and revenues and past expenditures and revenues. He said some of the reasons for a deficiency were that water consumed in 1975 had been less than in 1973 and 1974, and that $50,000 had been anticipated that did not come in. He said also that increases for inflation used to be over a five year period but the rate of inflation today over a five year period is so startling an increase that he believes the City should review annually or biannually and go to smaller increases on a more frequent basis. He intro- duced Dick Kennedy of Seattle Northwest Securities, the Edmonds financial adviser, who gave an analysis of the study. Mr. Kennedy stated that municipalities must generate more revenue or reduce the services. He had two reports which he reviewed. The first, on Water and Sewer Utility, wnet into the historical way of operating a utility with the expected expenses and revenue. The second report concerned the same revenue and expense items but they were shown in a different from, deviating from the operating statement and going into the City's budgets, codes and description items. After some discussion Mr. Larson said he would like to return with the completed official report and that the anticipated rate increase would be significant. MOTION: A MOTION WAS MADE BY COUNCILMAN GELLERT SECONDED BY COUNCILMAN CARNS, TO HAVE THE FOLLOW-UP REPORT ON THE STUDY OF WATER -SEWER RATES AND FUTURE FUNDING OF WATER -SEWER CONSTRUCTION FUND AT THE JUNE 22 MEETING. OFFICIAL APPOINTMENT OF'JACOUELINE PARRETT AS DEPUTY CITY CLERK Mayor Harrison said he would like to appoint Jacqueline Parrett as Deputy City Clerk in order to authorize her to sign official documents and accomplish official duties in.the absence of the City Clerk. FIRST READING: PROPOSED ORDINANCES • First reading was held on the following proposed ordinances: (1) Redrafted Nuisance Ordinance (2) Amending Code Re Definitions of Lot Width, Lot Depth, etc. (3) Parking Spaces Required on Boat,Storage Facil.iti.es AUTHORIZATION TO CALL FOR BIDS ON STREET MAINTAINER (FROM MEETING OF MAY 4) Public Works Director Herb Gilbo give an in-depth,replacement analysis regarding the 1965 street maintainer which offered several alternatives. He reviewed worksheets showing cost data compar- isons for replacement, rebuilding and renting a replacement unit. The Council questioned Mr. Gilbo at length regarding down time on the present equipment, whether rebuilding might be more feasible than purchasing a new piece of equipment, and comparing merits of a diesel engine as compared to a gasoline engine. The difficulty in getting parts for a 10 year old piece of equipment was also discussed. A MOTION WAS THEN MADE BY COUNCILMAN NORDQUIST, SECONDED BY COUNCILMAN CARNS, THAT THE PUBLIC WORKS DIRECTOR BE AUTHORIZED TO CALL FOR BIDS ON THE STREET "MAINTAINER" AND THAT THE BIDS SHOULD BE FOR BOTH DIESEL AND GASOLINE ENGINES, BID OPENING TO BE JUNE 1 AT 2:00 P.M. MOTION CARRIED. REVIEW OF PLANS AND SPECIFICATIONS RE UAB 228TH/236TH ST. PROJECT (MOUNTLAKE TERRACE LETTER) Ciyt Engineer Leif Larson presented drwings of the UAB project that Mountlake Terrace is plan- ning to construct. There was some discussion as to what the City of Edmonds had previously committed itself for and the fact that this should be reiterated. It was pointed out that there is still the possibility that this will not be built and Mr. Larson said he had a letter from the Mountlake Terrace City Engineer indicating they are planning to proceed and that the consulting engineer would give us plans.. He recommended the City acknowledge receipt of the Mountlake Terrace letter and reiterate our position. A MOTION WAS MADE BY COUNCILMAN NORDQUIST, SECONDED BY COUNCILMAN CARNS, THAT THE MOUNTLAKE TERRACE LETTER BE ACKNOWLEDGED AND OUR POSITION BE REITERATED THAT IN ADDITION TO THE $4,000 ALREADY SPENT-EDMONDS WOULD COMMIT ONLY $27,200 AND THAT THOSE FUNDS WOULD BE THE LAST FUNDS EXPENDED ON THE PROJECT.
