Mr. Adams said it would be 6", the same as on .the other side of the roadway, and Mr. Morrison was pleased to hear that. William McKenzie of 707 7th Ave. S. suggested the tracks','be taken up and the steel sold. Mr. Adams responded that the steel belongs to the railroad; that the City has not.acquired the property, but only its use through an -easement.' He said.he would discuss it with the railroad people, however, as it would make construction easier but it would.be too costly for the City to do it. Leonard'Friesendahl of Harbor Realty., 264 Railroad Ave., said he owns the real estate office of which Mr. Adams spoke and he needed the six.parking spaces to stay in business. Mr. Adams responded that those parking stalls are actually only 16' long on the private property, but they run over into the right-of-way. Further, he said the curb cuts are a violation because they occupy more than 50% of property frontage, so his parking arrangement currently is in.violation.of the City*Code. It was noted that the added parallel parking on Railroad Ave. should be of benefit to Mr. Friesendahl. Mr. Adams said the area would be -surveyed -and a title search made prior to construction which should clear up any question the property owners may have as to their.property lines. SIX MONTHS' REVIEW OF ORDINANCE PROVIDING:.FOR ASSES T OF ONE-HALF DETENTION COSTS UN NtKJUNJ Z)O I tNULD 1 U IMNKISUNMtN I Police Chief Marlo Foster reported that the largest percentage of people brought into the Edmonds Municipal Court are brought in.on.warrants and are not covered by.the current ordinance. A proposed amendment to the ordinance was provided which would include those people and therefore greatly increase the amount of revenue. Chief Foster also noted that.beginning January 1, 1980 anyone arrested for drunk driving will be put in jail for one day, and the bail will then go up approximately 20%. He suggested that the proposed ordinance amendment be placed on next week's Consent Agenda, requiring that a penalty assessment shall be levied against each person who has been held in custody in the Lynnwood or Snohomish County Jail pursuant to a warrant..of arrest issued by the Edmonds Municipal Court. Councilman Carns felt the person should.pay the entire fee, not half of it. M.A.A. Dibble suggested that there may be challenges and that .the 50% fee would be easier to defend. Councilwoman Allen said she would like to attend the AWC mini -convention in Bellevue on October 27 if there was•no objection. She was encouraged to attend. MOTION CARRIED. Mayor Harrison brought up the topic of alternate members for the Planning Commission, noting that he..had been advised by the City Attorney that State law would permit such. City Attorney John Wallace added that the City Council should discuss this before taking action. COUNCILMAN MOTION: NORDQUIST MOVED, SECONDED BY COUNCILMAN CARNS, THAT A DISCUSSION OF PLANNING COMMISSION ALTERNATE MEMBERS BE SCHEDULED FOR OCTOBER 30, 1979. MOTION CARRIED. Mayor Harrison advised that he wished to call an Executitve Session following this meeting in order to discuss a personnel matter. Mayor Harrison advised that a letter had been received from the Snohomish County Planning Department regarding applications for open space classifications on properties owned by F. S. Millichamp, Joseph V.-Dunne, and William R. Leraas, all located within the corporate limits of the City of Edmonds. Three County Commissioners and three Edmonds City Council Members will sit as the "determining authority" on these applications and Mayor Harrison appointed Councilmen Nordquist, Gould, and Carns to serve. Councilwoman Allen noted that the School District would like representatives from the various entities to meet with Jim Bride to discuss the School District property which he is developing, and the Task Force was asking each Mayor to appoint a Council member or the Mayor, himself, to meet with Mr. Bride. Mayor Harrison appointed Councilwoman Allen. AUDIENCE Lorene Walvatne of 7845 220th S.W. presented a petition asking for a crossing light and proper posting at 7th and Main St: She said she represented the Holy Rosary School, the Edmonds Day Care Center, and the Special Education Classes held at�the Anderson.Center. MOTION CARRIED. Penny Witchurch.of 814 Birch St. presented a petition asking for a traffic signal at the ifiter- section of Edmonds Way and 226th. She also submitted 13 photographs to demonstrate the traffic problems at that intersection. She said cars have difficulty getting onto ­Edmonds Way from 226th and often back up for two blocks, and children have great difficulty crossing Edmonds Way. -John Harter of the Edmonds/Lynnwood Youth Club said a lot of children in the Youth Club use that crossing and it is very dangerous. The Council responded that Edmonds Way is a State highway route and the State has not been receptive to installing signals on such.routes, but with a concentrated effort by citizens, PTAs, the Council, and State legislators it may be accom- plished. The petitioners were urged to contact their State legislators in this regard.:. Toni Matherly of .724 14th Way S.W., president -of the Sherwood Elementary School PTA, asked to be kept informed on the status of this request so the PTA task force could work on the problem. Roger Williams of 16706 74th P1. W. registered a complaint regarding the response he had received from persons answering the telephone at the City on two occasions when he had called for assistance. He said they;had made it clear to him that it was an'inconvenience to be called on a weekend, and only after insisting was he able to get through to the person who could help him. He said on one occasion he had tried to get a City Engineer and when he finally did that person was very responsive and went to his -home to examine the situation. On the second occasion which was a complaint about a neighborhood disturbance he never received a return call. He felt that as a taxpayer he should not be told when calling for services that he should only ask for those services between Monday and Friday, and that whoever is answering the telephone should be more helpful. REVIEW OF -SUNSET AVE. ACTIONS -RE TRAFFIC. 1 11 • fl is 1 City Engineer Jim Adams asked that current restrictions be conti.nued for another month because of the continuing good weather, and at that time he hoped to have both a summer and winter 435 • October 2, 1979 - continued solution to the Sunset Ave. problems. He asked for Council guidance as to whether all ferry traffic should be routed to SR104. Councilman Naughten commented that from all the conversations they had had about the ferry traffic it appeared.it should.be'routed both.in and out via.SR104.. Councilman Carns felt the problem on Sunset was not because of the ferry but because of restrictions placed on Union Oil Beach and Brackett's Landing. Councilman Herb suggested that the merchants.may want the traffic -to continue on Main St., and Mayor Harrison said he would.raise that question at the Chamber of Commerce meeting.of October 3. John Siegelbaum of 320 Sunset said the traffic revision has caused cars to pull into driveways,to turn around which is dangerous'to children, other motorists on Sunset, and property: He said his.fence gets knocked'down.every'week by cars turning around and he asked`that the traffic pattern on Sunset be changed. He'suggested that the Sunset traffic be one- way and that the parking be retained on the east side of.the street for residents and guests. Councilman Kasper responded that this must be studied on a permanent basis, and he noted that the street narrows as it goes north. He felt the only solution until something can be done about additional policing was P1an.A which the City.Engineer had submitted for consideration (traffic southbound one- way to Bell and northbound one-way from Main to Bell) and which'Councilman Kasper had supported when the various suggested plans were discussed. He felt that the Council so far had been reacting ..MOTION: instead of acting. COUNCILWOMAN ALLEN THEN MOVED, SECONDED BY COUNCILMAN KASPER, THAT THIS ITEM BE Withdrawn CONTINUED TO NOVEMBER 6, 1979 AS REQUESTED BY.THE STAFF, IN -ORDER FOR THEM TO DO A COMPREHENSIVE STUDY OF ALL THE DOWNTOWN TRAFFIC. THE MOTION AND THE SECOND WERE, -THEN WITHDRAWN TO ALLOW MORE AUDIENCE INPUT. Irene Pinyard of 344 Sunset asked that the original petition be reviewed as the reason for that petition was the ferry traffic. She said..it.was.only coincidence that the other problems on Sunset occurred at the same time.as they had presented their petition regarding the ferry traffic, and she asked that.the traffic restrictions on Caspers remain because they have alleviated the ferry traffic problems.on Sunset. Darlene Moore -of 307 Bell felt the Sunset Ave: problems were caused by the restrictions placed on the beaches.. Councilman Gould responded that it • is one of the realities of life that young people are part of the community and it has been difficult to bring -them into the community while keeping law and order at the same time. He said there is work being done on a plan to bring the youth in and have'them a part of the decision making. Herbert Hirst of 115 Edmonds St. said his family lives near Sunset.and.it is almost a hazard for his two teenage boys to return home at night because of the other young people in the area and their activities. Herb Wright of 400 Sunset reminded the Council that an ordinance was passed regarding Sunset and that should be a permanent ordinance. He felt the Council could not improve on the solution already reached and he did not see any reason to continue discussing it at meeting after meeting. Andy Goodman of 429 Sprague, a teenager, said one of the problems was that other cities have closed their beaches so their young people are coming to the Edmonds beaches. He suggested that Sunset be southbound in order to take advantage of the view, and he said they need a place where they can recreate without being in the way of anybody else. John Siegelbaum said the current restrictions are generally good but they can be improved to'solve the problems they have created. He asked about the possibilities of residents getting parking permits to park in front of their residences. He was advised that question would be discussed under another item on this evening's agenda. COUNCILWOMAN ALLEN AGAIN MOTION: MOVED, SECONDED BY COUNCILMAN KASPER, TO CONTINUE THIS ITEM TO NOVEMBER 6, 1979 TO ALLOW THE STAFF Withdrawn TIME TO PREPARE A COMPREHENSIVE TRAFFIC STUDY FOR THE ENTIRE COMMUNITY. Councilman Carns said he did not think there would ever be a solution for Sunset that would be perfect and satisfactory to everybody. He felt this should be left as it is for a year. Public Works Director Fred Herzberg said a traffic study for the entire community could not be accomplished in that period of time and there were budget considerations involved. He suggested such a project might be budgeted for the next.year. THE MOTION AND THE SECOND WERE WITHDRAWN. Councilman Kasper said the matter of turning around in driveways should be looked at as it was -a serious question. Dewey Leyda of 342.Sunset said he had lived on Sunset for 47 years and drivers have always turned around in driveways. Council- woman Allen asked that a traffic study be considered at budget time. REVIEW OCEAN AVE. AND WATER ST. TRAFFIC City Engineer...Jim*Adams said that until this evening he had -believed the~City's actions had solved • the problems on..Ocean Ave. and Water St. as there had been no more complaints, but he was given a letter this evening from F..Halbert of 19027 Ocean Ave. who indicated the problems were continuing. Mr. Adams felt the "Local Access Only"sign should be removed-and.a sign saying no outlet should be installed. He said, however, that would not solve the problems. Jack Schaeffer of 19018,Sound View P1. suggested that possibly more signs would be helpful, and perhaps a sign saying' -no parking after sunset, as people had no business there after dark. Another gentleman said the local access sign is in the wrong place, that it should be..at the beginning.of Water. St. just as it comes off Sound View P1. He favored hiring an additional -police officer to cover the trouble spots on appointed rounds as he felt signs would not work without someone to enforce them.- Councilman Naughten.said the local access sign should be a dead-end sign and he agreed there should be no parking.after sunset and that the dead-end sign should be placed where people can see it before entering the street. AND BELL ST.-PARKING RESTRICTIONS AND POSSIBILITY OF ISSUING RESIDENT PARKING'PERMITS . City Engineer Jim Adams said because.of contradictory desires.of 3rd Ave. residents regarding parking restrictions on 3rd Ave. he was now recommending that all parking restrictions be eliminated on 3rd Ave. except in the central business district, and that a consistent policy be established in the central business district, restricting parking to two hours.from 8:00 a.m. to 6:00 p.m., Monday through Friday. Doris Byrne of 203 4th Ave. N. (corner of.4th and Bell) said she was unhappy with the parking restrictions, being able.to park only four hours in.front of her home. Darlene Moore of 307 Bel1 said she had received.a.parking ticket on a.Saturday.when there were few cars parked on the street so she now had to park on.her,grass or get a ticket.:..Evelyn,Jasper of'3rd Ave. S. asked that the parking restrictions be removed and that each problem be dealt with individually instead of penalizing the whole street when one person has a problem.. Police Chief Marlo Foster said he had no objection to a residential parking permit if it was done in a logical and reasonable way and by ordinance so it was fair to everyone. MOTION: COUNCILMAN NAUGHTEN MOVED, SECONDED BY COUNCILMAN HERB, THAT THE POLICE CHIEF PREPARE A REPORT ON THE SUBJECT OF RESIDENTIAL PARKING PERMITS, WITH A SUGGESTED.PROPOSAL, FOR REVIEW AT THE MOTION: OCTOBER 16, 1979 COUNCIL MEETING. MOTION CARRIED. COUNCILMAN KASPER MOVED, SECONDED BY COUNCILMAN (Amended) CARNS, THAT THE PARKING LIMITATIONS PROPOSED BY THE CITY ENGINEER -BE ADOPTED, AND THAT THE CITY ATTORNEY BE INSTRUCTED TO DRAFT AN ORDINANCE TO IMPLEMENT THEM. Councilman Gould was concerned that everything so far done should be changed without examining.why those things had been done, and he felt they should be reviewed before making another change, and he also preferred.to have Amendment the report on residential parking permits before making this change. COUNCILWOMAN ALLEN MOVED TO AMEND THE MOTION, SECONDED BY COUNCILMAN NAUGHTEN, THAT THE TWO-HOUR PARKING RESTRICTION BE FROM 9:00 A.M. TO 4:00 P.M., MONDAY THROUGH FRIDAY EXCEPT HOLIDAYS. .THE MOTION TO AMEND CARRIED, WITH COUNCILMAN GOULD ABSTAINING BECAUSE HE FELT IT WAS TOO SOON TO TAKE ACTION. THE MAIN MOTION, AS AMENDED, THEN CARRIED, WITH COUNCILMAN GOULD AGAIN ABSTAINING. The audience was advised that this ordinance would be on next week's consent agenda and would become effective five days after passage next week. REPORT FROM STAFF ON COMPLAINT BY HARRY FOSTER RE CONDITIONAL USE.PERMIT VIOLATION Community Development Director John LaTourelle reported that he had inspected the building, both inside and out, and could.find no evidence.of any manufacturing or fabricating activity. He noted that the roof of the building had been replaced, which may.have accounted for the daytime construction activity reported by Mr. Foster. He indicated that the building and grounds were well maintained and neatly kept, the activities of the office generated very little traffic, there were no retail sales;'and all of the business is conducted by outside sales or telephone. There is a daily parcel post delivery of samples and the building generally is occupied by only one person. The ADB on August 1, 1979 had approved an application to • provide additional, safer, parking on the site; with access from 82nd P1. W. instead of 212th St. S.W., and to make minor improvements to the landscaping and add an exterior door to the new parking area. Mr. LaTourelle.could find no violation of City ordinances or conditions established MOTION: for this business. None of the complainants were present. COUNCILMAN HERB MOVED, SECONDED BY COUNCILMAN NORDQUIST, TO ACCEPT THE REPORT. MOTION CARRIED. REPORT FROM STAFF RE STATE CONSTRUCTION OF 196TH ST. City Engineer Jim Adams reported that all work currently being accomplished was in connection with the drainage and shoulders, and no paving was being done at this time. The State had been contacted regarding the 5' from each side for right-of-way versus their proposed 10' from one side, and they had indicated they could not afford to buy the 5' from each side and suggested the City may purchase it. Mr. Adams said 1/2� gas tax money could be used for the purchase but -it was already earmarked for other uses. Public Works Director Fred Herzberg added that the additional costs to go with the City's requirement of 5''from each side would be approximately $60,0.00, and usually when the State builds such a highway the local entity purchases the right-of-way but Wes Bogart had committed the State to purchase this. However, they do not feel.obligated to take on the additional costs.. City Attorney John Wallace was asked what means the City had to get its decision implemented, and he responded that he would prefer to discuss that in Executive Session. Councilman Carns suggested that Mr. Zirkle, the District Administrator of the Department.of Transportation's District.Engineer's office, be invited to a Council meeting to discuss the problem, and Mr. Herzberg said he already was investigating that possibility. Mr. Herzberg also noted three of the City's major programs which would be impacted if this project did not go forward. REVENUE SHARING PROPOSED USE HEARING Finance Director Art Housler said the purpose of this hearing was to provide citizens with the opportunity to make oral and written comments regarding possible uses of general revenue sharing • funds. In recent years the funds have been used for police salaries. The hearing was opened, but there was no public input, and the.meeti.ng was closed. No other action was required at this time. REVIEW PLACEMENT OF "COUNCIL" AT END OF AGENDA Councilman Nordquist, who had.proposed this change in the agenda, now,proposed that it be continued until.November•6, 1979,, the date of the general election. Councilman Gould felt it was a mistake to have this item at the end of the agenda because when a citizen asks a Council member for help .with a problem and the Council member has to wait until the end of the meeting, that problem may not get the attentionit should get. Councilman Nordquist,-however, felt that a lot of the things which had been brought up under "Council" could have been taken care of by a telephone call or a memo to -the proper department head, but instead had taken much meeting iMOTION:. time when it was not necessary. Councilman Kasper will attend that meeting. • October 2, 1979 - continued 43. 1 Councilman -Gould noted that the Edmonds School District will be running a bond issue on.the May 20 ballot for.improvements to the football field, and he suggested.the City's bond issue should not be on the same ballot, but on one prior to that. J f • ACCEPTANCE OF SCHEDULE II, 3.0 MILLION.GALLON RESERVOIR AND -ESTABLISH 30-DAY LIEN PERIOD [Item (E) on Consent Agenda Councilman Herb questioned whether the painting of the inside of the tank was satisfactory, having read of some problems when it was tested. He was advised that the tank had been repainted and the 14OTION: Staff report indicated the purity -tests were acceptable to. the City. COUNCILMAN CARNS MOVED, SECONDED BY COUNCILMAN GOULD, TO APPROVE ITEM (E)..ON THE CONSENT AGENDA. MOTION CARRIED. PROPOSED.ORDINANCE FOR PARKING RESTRICTIONS IN CENTRAL BUSINESS.DISTRICT Item G on Consent Agenda Councilman Gould felt the Council should examine what they were doing on parking restrictions, noting that the Staff would'be making a traffic study that will give them the opportunity to make comprehensive changes. He said the changes provided in this.ordinance would be costly.. The Staff had advised that there are approximately 150 signs in the Central Business District which will require changing and recommended that the proposed ordinance be amended to read two-hour parking between 8:00 a.m. and'6:00 p.m.,.Monday.through Saturday,except holidays, which results in a cost of $10 each, or a total of $1,500 to accomplish. Any additional wording would require new signs at an approximate cost of $42 each, or a total of $6,300. .Councilman Gould suggested that the Staff's recommendation be accepted and that further changes be delayed,until the traffic study is accomplished. Mayor'Harrison added that the Edmonds Chamber of Commerce was. in favor of this recommendation. Councilman Kasper noted that the map provided of the Central:Business District does not correspond to the streets stated in the ordinance. He was in agreement with parking restrictions for the Central Business District but he commented.that when changes..are.made it gets into, a lot of money. MOTION: COUNCILMAN CARNS THEN MOVED, SECONDED.BY.000NCILMAN GOULD,..TO..ADOPT ORDINANCE 2099 WITH THE CHANGES READING FROM 8:00 TO 6:00 P.M., RATHER THAN FROM 9:00 TO'4:00 P.M.. MOTION CARRIED. (It was subsequently determined by the City Attorney that the Council's intent.had been to follow the Staff's recommendation, but the proposed ordinance had excepted Saturdays from the restrictions and the Staff's recommendation had not, and the motion did not state a change in the exception for Saturdays. Therefore, the amended ordinance will be placed on the next Consent Agenda in order to clarify this point.)
