The subject property is bounded on three sides by streets and on the fourth
by a wetland area.

No. The Treatment Plant will be landscaped and designed to fit into the neighborhood

Will these hardships have been caused by your own action?
In order to comply with all mitigating environmental conditions and to physically
construct the treatment plant to meet required State standards, the site must be
developed as proposed. If the variances are not granted, the plant cannot be
built.

The City of
Edmonds plans to construct a secondary wastewater treatment
plant at the
intersection of Dayton
Street and State Route
104.
The site is
occupied by
the City's primary wastewater treatment plant
and
the Public
Works Department's
storage yard.`
This letter transmits
information to
support the
City's application for a
conditional use permit
and
request for
setback variances. It also attempts
to clarify a few issues
that
may be of
concern.
✓v/ Enclosed are three copies of the following documents:
✓✓✓ A. A color aerial photograph shows surrounding land uses. The plant
�✓✓ site is located near the middle of the photograph at the southeast
corner of Dayton Street and State Route 104.
B. A topographic map of the existing site shows present ground
elevations and existing facilities.
C. A site plan shows how the secondary wastewater treatment plant
will appear on the surface.
D. A location plan defines the locations of all significant above grade
and below grade structures and identifies setbacks from the property
lines.
E. A predesign report provides a detailed description of the function,
design and aesthetic treatment of the treatment plant facilities.
Differences Between Current Site Plan and Predesign Report
Since completion of the Predesign Report, a few modifications have been
made to the treatment plant design which are incorporated in the current
site plan.
' The shape of the Operations Control Building has changed. This
structure has also been moved about 30 feet to the south to provide
better access between it and the Solids Process Building.

An access tunnel has been added along the west edge of the site
between the aeration basin/primary clarifier structures and the
property line.
Electrical supply facilities have been added along the east edge of
the site between the final clarifier and the property line. This
creates a need to construct a barrier (security) wall along the east
property line for approximately 105 feet.
Architectural Treatment of Dayton Street Frontage
A plaza area will be constructed along the street front on Dayton Street.
The site plan shows the proposed concept for this area, however, this plan
is still somewhat preliminary in nature. CWC-HDR is working closely with
several groups including the Architectural Design Board, the Citizens
Advisory Committee and the Edmonds Arts Commission to finalize plans for
this area. These groups are also providing input on other architectural,
landscaping and aesthetic issues associated with the plant.
Landscaping
Landscaping will vary across the plant. On the north end, formal flower
landscaping will be incorporated into the plaza design. Along the east and
west property lines, green slopes and plantings will be used along structures
and the perimeter wall to soften the appearance of these facilities. On the
south end of the site, plantings will be installed that provide. transition to
the adjoining wetlands. This approach is consistent with the conditions set
forth in the Mitigated Determination of Nonsignificance.
Building Heights
The existing ground surface varies from elevation 13 to elevation 20. The
mean elevation for the site is approximately elevation 16. Three structures,
the Solids Process Building, the Blower Building and the Influent Pumping
Station, will have a maximum elevation of 40 which is within the 25 foot
height limit. The height of all other structures will be lower, as shown in
the Predesign Report.
Setbacks
Construction of the Treatment Plant on the Dayton Street site requires
maximum use of the available area. When laying the plant out, efforts were
taken to maintain all facilities within the City's normal setback
requirements. Unfortunately economic considerations, process design
requirements and constraints of existing facilities made this impractical.
Consequently, setback variances are requested along the north, east and
west boundaries of the property. The requested setbacks are shown on the
location plan.

MITIGATING CONDITIONS
SECONDARY SEWAGE TREATMENT PLANT FOR THE CITY EDMONDS
1. No structures shall be higher than 25' in height.
2. No structures shall be allowed within 33' (ten meters) of the
marsh.
3. The entire -Treatment Plant site shall be
screened by a buffer which is a combination of fencing
and profuse evergreen landscaping.

5. A 33' (ten meter) natural landscape buffer shall be maintained
between the plant and the adjacent marsh. The buffer area
shall be supplemented as necessary by native vegetation,
selected for its compatibility with wetland areas .
6. All mechanical equipment must be screened and baffled to
{ comply with the City of Edmonds noise ordinance.
7. All truck traffic associated with the treatment plant shall
use Dayton Street to SR 104.
8. The treatment plant shall use the latest state-of-the-art
techniques for reducing odors associated with the plant such
as, but not limited to, electrostatic scubbers, filters, etc.
9. No non-native fill will be used.
10. Any areas exposed during construction, which will not
constitute part of the developed facility, will be
revegetated upon completion of construction.
11. The plant shall comply with all State and Federal air quality
standards.
12. Stormwater runoff shall be collected and conveyed to the
existing City storm system, which drains into Puget Sound.
There shall be no increase in stormwater runoff into the marsh.
13. A conditional use permit will be required.

I. REQUESTED ACTION:
Variances to reduce the required street setbacks for proposed
secondary sewage treatment plant at 100 Dayton Street, Edmonds.
Specifically, the City of Edmonds is seeking to reduce the
required 25' street setback to a minimum of 0 feet on 2nd Ave.
S.; 4.8 feet on Dayton Street; and .8 feet on SR 104.
Conditional use permit for secondary sewage treatment plant at
100 Dayton Street, Edmonds.

IV. STAFF FINDINGS AND CONCLUSIONS:
A. Description of the Subject Property and Surrounding Area
The City of Edmonds is seeking a conditional use permit and
variances to allow for the construction of a new secondary
sewage treatment plant on the southeast corner of the
intersection of SR 104 and Dayton Street. The site is the
current location of the Edmonds sewage treatment Plant.
The subject property is relatively level. It is bounded by
2nd Ave. S. on the east; Dayton Street to the north; and SR
104 to the west. The area to the south is undeveloped.
The existing site conditions are shown on Exhibit 4. The
proposed improvements are shown on Exhibit 5. The requested
setback variances are depicted on Exhibit 6.
Surrounding development is commercial to the west and
north. The City Public Works building is located to east,
across 2nd Ave. S. To the southeast, there is multifamily
development. As noted above, the land immediately to the
south is undeveloped.

1. Special Circumstances
Special circumstances do appear to exist in this
particular case. There is limited space to build all
the required improvements for the treatment plant. The
proposed plan allows for passive recreation on the site
with the development of a pedestrian park along Dayton
Street. Further, all structures on the site with meet
the building height limitation of 25 feet.
2. Special Privilege
The proposed setback variances do not appear to
represent a grant of special privilege. This is a
significant public structure that has been designed to
blend into the neighborhood.
3. Comprehensive Plan
The Comprehensive Policy Plan map designates the
subject property as High Density Residential.
The proposed conditional use permit and setback
variances do not appear to conflict with the purposes
of the Comprehensive Plan as listed in Chapter
15.20.030 of the ECDC.
4. Zoninq Ordinance
The subject property is zoned BN/Public Use. The
surrounding area is zoned:
North - BC South - BN West - CG (Contract)
East - Public Use/ RM-2.4
The proposed conditional use permit and setback
variances do not appear to conflict with the purposes
of the zoning ordinance or the BN/Public Use zone
districts.

The proposed conditional use permit and setback
variances do not appear to pose any significant impact
to the public or to any nearby private property or
improvement.
The treatment plant has been designed to be visually
sensitive to the neighborhood. A declaration of
nonsignificance has been issued on the project.
6. Minimum Variance
In order to provide all the required improvements on
the site, the requested setback variances do appear to
represent a minimum variance request.
7. Transferability
The conditional use permit should not be transferable.
V. STAFF RECOMMENDATION:
The City is required by both the State and Federal governments to
build this secondary sewage treatment plant. The plant is needed
to help implement cleaning up pollution in Puget Sound. It has
been designed to be both functional and aesthetically sensitive
to the surrounding properties.
Staff recommends that the CU-68-87 and V-33-87 be approved the
setback variances, subject to the following conditions:
1. Comply with all mitigating conditions listed in the
Mitigated Declaration of Nonsignificance (Exhibit 7).
2. Comply with all Architectural Design Board requirements.

After due consideration of the evidence presented by the Appli-
cant, and evidence elicited during the public hearing, the
following Findings of Fact and Conclusions constitute the basis
of the recommendation of the Hearing Examiner.
FINDINGS OF FACT
1. The Applicant has requested approval of a conditional use
permit for the operation of a secondary sewage treatment
plant at 100 Dayton Street, Edmonds, Washington. In
addition, the Applicant has requested variances to reduce
the required street setbacks at the proposed secondary
sewage treatment plant. The requested setbacks include: a
reduction from the 25-foot required street setback to 0 feet
on 2nd Avenue South, 4.8 feet on Dayton Street, and,
.8 feet on State Route (SR) 104. (Staff report.)
2. The subject property is the site of the current Edmonds
Sewage Treatment Plant. It is the intent of the Applicant
to expand this facility in order to be in compliance with an
order from the Washington Department of Ecology that the
City provide secondary treatment of waste water by April,
1991. The facility will serve Edmonds and all, or part, of
Mountlake Terrace, Olympic View Water District, Ronald Sewer
District, Woodway and Lynnwood. (Willey testimony.)
3. Should the City fail to award a contract by October 1988 for
the secondary sewer treatment plant, it could be subject to
fines and a building moratorium could be imposed for the
areas serviced by the plant. (Alberts testimony.)
4. The site for the sewage treatment plant was chosen in 1979.
In 1986 an engineering report on the proposed secondary
sewage treatment facility was finalized. The report was
eventually adopted by the City Council of the City of
Edmonds. (Alberts testimony.)
5. Admitted at the hearing as Exhibit 6 and attached hereto and
incorporated as part of these findings is a location and
setback plan of the proposed sewage treatment plant. All
the buildings and structures to be developed on site are
shown in Exhibit 6. (Exhibit 6.)
6. The wastewater treatment plant will have the following
buildings and structures:

a. An operations control building which will be a one-story
structure located at the southern portion of the site;
b. A solids process building where sludge residue will be
removed;
C. A new primary clarifier which will be constructed
immediately west of the existing primary clarifiers.
(Primary clarifiers are basins for the sludge);
d. A raw sludge pumping station;
e. An influent pumping station where waste water will be
pumped into the site;
f. Aeration basins used for biological treatment of the
sewage;
g. A blower building located immediately north of the
aeration building. The blower building will have
mechanical equipment which will feed air into the
biological treatment conducted in the aeration basin;
h. Three final clarifiers which will be used for the final
settling process; and
i. Effluent pumping station which will pump the treated
water from the site.

7. The subject property is zoned BN/Public Use. The Edmonds
Community Development Code (ECDC) 16.45.010(C)(2) require
community facilities such as the proposed secondary sewage
treatment plant to be developed with a conditional use
permit. (ECDC.)
B. ECDC 20.05.010 sets forth the criteria that must be
satisfied in order for a conditional use permit to be issued
within the City of Edmonds. These criteria include:
A. The proposed use must be consistent with the Comprehen-
sive Plan of the City of Edmonds;
B. The proposed use in its location must be consistent with
the purposes of the zoning ordinance in which the pro-
perty is located; and,
C. The proposed use must not be significantly detrimental
to the public health, safety or welfare, nor injurious
to nearby private properties or improvements.

lands. (Staff report.)
11. The subject property currently has a waste water treatment
facility on site. In addition, the southern portion of the
site is used for storage of City of Edmonds Public Works
Department equipment. This portion of the site would be
developed into the operations control building and the
solids process building. (Exhibit 4.)
12. The proposed secondary sewage treatment plant will not pose
any significant impact to the public, nor to nearby private
property or improvements. The City submitted that the
plant has been designed to be visually sensitive to the
neighborhood. A declaration of nonsignificance has been
issued for the project. Further, there was no testimony in
opposition to the granting of the conditional use permit.

13. In order for a variance to be granted within the City of
Edmonds the criteria as set forth in ECDC 20.85.010 must
be satisfied. These criteria include:
A. Because of special circumstances relating to the pro-
perty, the strict enforcement of the zoning ordinance
would deprive the owner of use rights and privileges
permitted to other properties in the vicinity with the
same zoning.
B. The approval of the variance would not be a grant of
special privilege to the property in comparison with the
limitations upon other properties in the vicinity with
the same zoning.
C. The approval of the variance will be consistent with the
Comprehensive Plan of the City of Edmonds.
D. The approval of the variance will be consistent with the
purposes of the zoning ordinance and the zone district
in which the property is located.
E. The variance as approved or conditionally approved will
not be significantly detrimental to the public health,
safety and welfare or injurious to the property or
improvements in the vicinity and same zone.

F. The requested variance is the minimum necessary to allow
the owner the rights enjoyed by other properties in the
vicinity with the same zoning.
(ECDC.)
14. The subject property is zoned BN/Public Use. There is no
classification in the ECDC for a Public Use. Therefore,
ECDC 17.00.020(D) applies to this application. This section
sets forth that all lands not classified according to
established district classifications on the Official zoning
Map shall be classified as RS-12. ECDC 16.20.030 estab-
lishes the minimum street setback for RS-12 zoned property
as 25 feet. It is from this standard that the Applicant
seeks a variance.
15. ECDC 17.00.030(C) requires that variances for public
structures and uses be reviewed by the Hearing Examiner with
a final recommendation to the Edmonds City Council. (ECDC.)
16. Special circumstances exist for the granting of a variance
from the street setbacks. Because of economic considera-
tions, process design regulations, and constraints of the
existing facilities, a variance is warranted. (Willey
testimony.)
17. It is the intent of the City to continue to use the existing
clarifiers on site and incorporate them as part of the
secondary treatment process. To replace the clarifiers
would result in a $500,000 to a $1,000,000 expenditure on
the part of the City. These are economic factors to be
considered in the granting of a variance. (Willey
testimony.)
18. Because of the location of the two existing clarifiers, all
other treatment facilities need to be developed in a
northerly direction. This results in a constraint on the
City of their existing facilities and it requires a design
that necessitates the granting of a variance in setbacks
from the various streets. (Willey testimony.)
19. The State of Washington's guidelines require that the
treatment facility must be a certain size in order to
adequately handle sewage flow. In order to design a
facility for that size, variances from the setbacks must be
acquired. (Willey testimony.)
20. A proposed park will be located on the northern -most final
clarifier. The park, a vest-pocket park, will be designed
to blend in with the neighborhood and provide aesthetic
relief to the site. (Willey testimony.)
21. The requested variance will not be detrimental to other
properties or improvements. Although the variances are

sought for the entire setbacks on the streets mentioned,
only a few buildings will encroach within the setback
standards of the BN zone. (Bowman testimony.)
22. The requested variance is the minimum necessary for the
Applicant to adequately make the secondary treatment
facility improvements. (Bowman testimony.)
23. The Planning Department of the City of Edmonds has
recommended approval of the conditional use permit and the
variance subject to the following conditions:
1. Comply with all mitigating conditions listed in the
Mitigated Declaration of Nonsignificance (Exhibit 7).
2. Comply with all Architectural Design Board requirements.
24. The proposed operations control building will be between 45
feet and 50 feet from the marsh land immediately to the
south. The construction of this building will not have an
environmental impact on the marsh lands. (Willey
testimony.)
25. No testimony from the public was presented at the hearing.
CONCLUSIONS
1. The application is for the approval of a conditional use
permit for the operation of a secondary sewage treatment
plant at 100 Dayton Street, Edmonds, Washington. In
addition, the Applicant has requested variances to reduce
the required street setbacks at the proposed secondary
sewage treatment plant. The requested setbacks include: a
reduction from the 25-foot required street setback to 0 feet
on 2nd Avenue South; 4.8 feet on Dayton Street; and, .8 feet
on SR 104. (Staff report.)
2. The requested conditional use permit and the variance are
consistent with the Comprehensive Plan Map designation of
the subject property as High Density Residential. In parti-
cular the proposed facility will satisfy the goals and
policies as set forth in ECDC 15.20.030.
3. The requested conditional use permit and the variance
request are consistent with the purposes of the zoning
ordinances of the City of Edmonds. Although there are no
purposes specifically listed for BN/Public Use in the ECDC,
the proposal is consistent with BN zones in that it will
provide a service to the residents of the City of Edmonds
and surrounding communities that is necessary for them.
4. The requested conditional use permit and the variance will
not be detrimental to the public, nor to the health, safety
and welfare of the public. It will not impact other private

properties or improvements in the area. The facility is a
public necessity that will be used for the treatment of
sewage in the City of Edmonds for the eventual pollution
control of the Puget Sound.
5. The conditional use permit should not be transferable.
6. The requested variances are the minimum necessary in order
for the Applicant to develop the property in a manner that
will satisfy State guidelines, utilize existing facilities,
and minimize cost.
RECOMMENDATION AND DECISION
The requested conditional use permit for the allowance of a
secondary sewage treatment plant at 100 Dayton Street, Edmonds,
Washington, is granted subject to the following conditions:
1. The Applicant shall comply with all mitigating conditions
listed in the Mitigated Declaration of Nonsignificance,
which is attached hereto and by this reference hereby
incorporated as part of this decision.
2. The Applicant shall comply with all Architectural Design
Board requirements.
3. A conditional use permit is valid only if the City Council
of the City of Edmonds approves the variance for a reduction
in the street setbacks on 2nd Avenue South, Dayton Street,
and SR 104.
4. The conditional use permit is not transferable.
It is hereby recommended to the City Council of the City of
Edmonds that the requested variances for the reduction of the 25-
foot street setbacks to 0 feet on 2nd Avenue South; 4.8 feet
on Dayton Street; and, .8 feet on SR 104 should be granted
subject to the conditions as set forth above for the conditional
use permit.

HISTORY AND SUMMARY STATEMENT:
The City of Edmonds selected the present site of our sewage treatment
plant as the location for the new secondary sewage treatment plant. Due
to the limited site area; the specific need for certain improvements at
the plant; and, the fact that site has three street setbacks, it was
necessary to apply for setback variances. The specific variance requests
involve reducing the required street setbacks from Dayton Street, 2nd
Avenue South, and SR104 to as little zero feet, instead of the maximum
required 20 foot setback.
On December 17, 1987, the Hearing Examiner held a public hearing on the
variance request of the City of Edmonds to reduce the required street
setbacks for the new Secondary Sewage Treatment Plant at 100 Dayton
Street. No testimony was presented in opposition to the application.
The Hearing Examiner issued his report on January 8, 1988 recommending
approval of the setback variances, subject to the conditions listed in
his report.
RECOMMENDED ACTION:
Adopt the Hearing Examiner's findings and recommendation.

Councilmember Jaech recommended that the hearing be continued to a future date to allow the Coun-
cil to review the evidence that was submitted that evening. She inquired if the Council could
continue the hearing to a future date without closing the hearing. Mr. Snyder said there would
be no requirement to republish the hearing if it was continued, without closing it, to a date cer-
tain.
Mr. Snyder noted that the entire file has been available in the Council office for Council review
and will remain there until the new hearing date, if the Council chose to continue the hearing.
Councilmember Jaech inquired if the Council could request that additional information be present-
ed to them if the hearing was continued. Mr. Snyder replied affirmatively. He said, however,
both parties must be given an opportunity to address any additional information.
COUNCILMEMBER JAECH MOVED, SECONDED BY COUNCILMEMBER NORDQUIST, TO CONTINUE THE HEAPING TO FEBRU-
ARY 16, 1988.
Councilmember Dwyer inquired about the Council's position regarding issues to questions that
arise that are not addressed in Chapter 20.10 Mr. Snyder said the development was subject to
SEPA review and the Council, in making the underlying decision, must incorporate the SEPA factor
as a part of 20.10.020, which refers to the fact that the development must be consistent with
zoning ordinances and the Comprehensive Plan. He said if the Council feels that there is any
significant environmental impact that has not been addressed by the mitigation measures, it could
amend those measures or impose additional measures.
MOTION CARRIED.
Mr. Snyder inquired if the Council desired to allow the applicant to submit any references to any
of the environmental documents that were already submitted. The Council replied affirmatively.
Mr. Snyder suggested that a deadline for submittals be established. A February 11, 1988 deadline
was established for submitting any additional information to the Council.
SECOND HEARING ON PROPOSED SEWER RATE INCREASES
Administrative Services Director Art Housler noted that the hearing was the last of the scheduled
sewer rate hearings. He said the Council received an ordinance which is scheduled for adoption
on February 16, 1988 to increase the rates on March 1, 1988. He said there have been numerous
discussions regarding the issue and information is contained in the Facility Plan.
Mayor Naughten opened the public portion of the hearing. No input was offered. Mayor Naughten

Councilmember Hertrich inquired if a sidewalk could be constructed if the setback was reduced.
Ms. Block replied affirmatively. She said the sidewalk will be located in the public right-of-
way.
Councilmember Hall requested clarification of item #17 of the Hearing Examiner's Findings of
Fact: "It is the intent of the City to continue to use the existing clarifiers...". Community
Services Director Peter Hahn said the City will use the existing clarifiers unless something
unforeseen occurred.
Councilmember Wilson inquired how the entire treatment plant will be screened by a buffer, as
referenced in mitigation condition 0, with a zero setback. Ms. Block said screening will be
provided in places where there is no facade. City Engineer Bob Alberts added that landscaping
will be installed in the right-of-way.

Councilmember Jaech inquired if trees located on the site will be pruned so they do not exceed
the height limitation. Ms. Block replied affirmatively.

PROPOSED ORDINANCE 2655 ESTABLISHING 1988 BUILDING PERMIT FEES
f Community Services Director Peter Hahn reported that one year ago, the Council and Staff dis-
cussed building permit revenues, expenditures, and fee levels. The Council adopted a policy, set
in an ordinance, that fee levels should recover 100% of the actual costs for building permit
activities. Those costs would not include other City costs such as management, City overhead, or
attorney fees. The policy was to be phased in gradually.
Mr. Hahn said the updated analysis indicates that recovery levels have fallen from the 1986 high
level of 89% and were only 77% in 1987. He said those recovery levels are a result of Edmonds
permit fees set at only 72% of the 1985 Uniform Building Code (UBC) levels. He noted that almost
all other governmental agencies charge the full 1985 UBC fees. Mr. Hahn said it is recommended
that the Council adopt a 1988 fee level set at 90% of the 1985 UBC fees.
Councilmember Dwyer reiterated that he did not believe 100% recovery was necessary. He said the
costs incurred are derived in the City's function to protect the public interest, as is police
protection without recovering 100% of the costs.
COUNCILMEMBER JAECH MOVED, SECONDED BY COUNCILMEMBER HALL, TO ADOPT THE 1988 FEE LEVEL SET AT 90%
OF THE 1985 UBC FEES. MOTION CARRIED.
COUNCILMEMBER JAECH NOTED THAT THE MOTION SHOULD INCLUDE ADOPTION OF ORDINANCE 2655. THE SECOND-
ER AGREED.

Mayor Naughten noted that a position is available on the Tourism Committee for a Councilmember to

KASPER TO SERVE ON THE TOURISM COMMITTEE. MOTION CARRIED.
Mayor Naughten announced that Fire Chief Jack Weinz has served the City for twenty-five years.
Mayor Naughten noted that Ed Huntley's retirement party, held on January 29, was well attended
and everyone had a good time.
Mayor Naughten reported that the Highway 99 Economic Development Council met on January 29, 1988.
Mayor Naughten said a liquor license was pending for the food service for the Washington State
Ferry System and would be approved if no objection was noted. No objection was noted.
Mayor Naughten said .the Edmonds Lions Club has requested that a sign of theirs be placed at the
entrance to the City. Because an amendment to the Code would be necessary to install an off-prem-

ise sign, the Mayor suggested that the issue be forwarded to the Planning Board for review.
Mayor Naughten said a free Crime Prevention seminar is scheduled on February 27, 1988.
