A site inspection of the property has revealed Hindly creek passing near the western property
line.
Based on the above findings, it is determined that there is critical area due to a stream on or
adjacent to the site. A Critical Areas Study is required to delineate the boundaries of this
potential critical areas, the buffers and setbacks. A stream biologist or hydrologist must delineate
the bank of the stream. Then a licensed surveyor must create a map of the site which shows the
exact location of the stream bank and the required buffers and setbacks from the stream. The
surveyor must also create legal descriptions for the critical areas and the buffers. The critical
area study must be created through a three party contract between the applicant, the City and the
consultant
If the property owner wishes to apply for a specific development permit which they feel would
not impact the Critical Areas located on the site, they may submit their proposal to the Planning
Department for review. If the Planning Department finds that the proposed development permit
will not adversely impact a Critical Areas or its buffers, a conditional waiver may be issued on a
project by project basis.
