The
parcel of ground contains 11350sq. ft. of area. The zoning
is RS-6,
minimum 6000 s.f. area and min. lot width of 60 ft. The actual
variance
requested would be to allow a two lot sub -division, with each
new lot
to have 5675 s.f. in area, and have a lot width of 56.75ft-(see
plot plan)
My reasons for granting this variance are as follows:
1.
There was a street dedication which removed approximately 20ft
off of the North boundry of the property. This can be seen by
viewing the area map, also attached. Had this not taken place
the property would meet all zoning requirements.
2.
There was another street dedication that removed five feet off of
the east property line, It appears that this was to make ex-
tra parking for activities at the Pine St. Play -field, park.

Parcel 2-121 is a Duplex.(see area map) Parcel 2-135 had a rec-
ent variance granted, giving them a higher than allowable_;
density than the zoning allowed.

of the Hearing Examiner. f'
FINDINGS OF FACT
1. The application is for the approval of variances toallowtwo lots below }
the minimum lot area and lot width at 1010 6th Avenue South, Edm onds,
Washington, and more particularly described as set forth above.
2. The specific request of the applicant is to allow lots, on the above
described property to consist of 5,675 square feet in area and lot E-
widths of 56.75 feet.
3. The above described property is zoned RS-6. For lots within an RS-6 zone
within the City of Edmonds the standard area is 161000 square feet and
60 feet*of lot width.
4. The Applicant submitted with the application a map showing the proposed
short plat of the two lots should a variance be granted. ,As shown on �.
the map, Exhibit 4, the width of the existing lot is shown to be 113.5 feet.
This figure was obtained by the Applicant from the title report for the
subject property. However, at the public hearing a survey was presented
as Exhibit 9 shoeing that the actual width of the existing lot is only t
107.69 feet. Thus, it appears that the actual width of each lot in the
proposed short plat would be 53.84 feet instead of the submitted 56`.75
feet for each lot.
5. The subject property was part of a .short subdivision in 1962 (see file t .1
TS-1-62). At that time. the property that was subdivided was divided into t.'
lots of 120 feet by 115.5 feet and 60 feet , by l l 5.5 feet. The 120' by t
115.5' is the subject property. �.
6. In 1975 the subject property was involved in a lot line adjustment which
re -moved the east two feet of the lot resulting in a reduction
of the property to a 120 feet by 113.5 feet parcel of land. (It should

The Applicant indicates in Exhibit 3 that, with the dedication of,':riht g

As noted earlier, adequate building pads meeting all setbacks can be.
achieved even with the requested variances. However, because they
variances do not comply with all the criteria of Section 20.85010,'r
a,
staff cannot recommend approval.. Staff does not actively oppose the
variances.

15. The Applicant testified that through informal discussions with the City `
personnel it appeared that part of the original lot was taken because f
of dedications of right-of-way for Pine Street and 6th Avenue South.
There is no proof of these dedications; however 60 the - foot wide
right-of-way of Pine Street indicates to the Applicant that such a
dedication would have had to have taken place in the past. According
to the Applicant, this right-of-way is excessive for the area at•the
time it was developed.
16. The Applicant submitted that the subject property is prime property for
a rezone to allow increased density on the site.
17. The Applicant submitted that if the variances were granted he would take
down the existing garage on the site and put.two new houses on the lot.
On lot A he had house plans for a_39-foot wide, 28-foot deep house that
would have four -foot setbacks, On lot B he had the style'of house that
could be built on the property to conform with the existing architecture
and design.`
18. The Applicant submitted that the requested variances would not be detri-
mental to the land and would be an asset and improvement to the neighbor
hood.
'19. A witness (Mather) testified that his predecessor.in interest had purchased
two feet indirectly through the Applicant's predecessor in interest to
allow him to have a 60-foot wide lot. Without this two feet it appears ,...
that the Mather property would not have been able to have been developed E
without a variance..
20. Witness Mather testified that the width figures as submitted were in-
correct and the figures as shown in the survey, with each lot being
53.84 feet and the total lot being 174.69 feet, were the correct figures.
21. The City submitted that even though the width size was reduced.there is

sufficient land on both lots to allow'building pads to be developed as
Proposed by the Applicant.
22. Letters of opposition were submitted and are noted in the Introduction
to this document.

CONCLUSIONS;
1. The application is.for the approval of variances to allow two lots
below the minimum Tot area and lot width at 1010 6th Avenue South,,`
Edmonds, Washington, and more particularly described as set forth above
2. The width of the lots on the subject property should be considered to.
be 107.69 feet as "shown on the survey of the property. The Applicant
has relied upon a title report and the information given to him in
this report appears ,to be incorrect.
3. The lot widths of the requested variances must be considered as 53.84 feet
for each lot. This is an equal division of the subject property which is
r 107.69`feet wide.
4. In order for a variance to be granted in the City of Edmonds the criteria
as listed in Section 20.85.010 of the Edmonds Community Development Code `
must be met.
5. Although there has been erroneous information in the original short.pl.at
of the subject property, and although part of the, subject property has
been transferred to other property owners in order for other lots to meet.
the zoning standards, there appears to be no special circumstances for the
granting of a variance.
6. The granting of a variance as requested by the Applicant would result in
the granting of a special privilege. No evidence or testimony has been
presented to show otherwise.'..
7. The requested variances appear to be in conformity with the Comprehensive
Policy Plan map and the RS-6 zoning ordinances of the City of Edmonds.
8. The requested variances would not be detrimental to the existing properties
or to the public health, safety or welfare.
9. The requested variances appear to be the minimum necessary _for. the proper'
development of the subject property.
10. The Planning Department of the City of Edmonds has recommended denial:
subject to the comments submitted as shown in Finding-#14.

DECISION

The request for the variances to allow two lots below the minimum lot area and
width at 1010 6th Avenue South, Edmonds, Washington, is denied.`
As noted in the Findings and Conclusions, all the criteria as listed in
Section 20.85.010 of the Edmonds Community Development Code must be met before
the variances can be granted. It appears to the Hearing Examiner that the
granting of these variances would be the granting of a special privile,ge'in
that no special circumstances seem to exist to allow variances from the RS-6
