I contacted Jeannine, who suggested that I publicly request the following related to my property, as well as its related short -plat: •A copy of the storm drainage ordinance •A copy of the approved civil plans for the short plat *The original permit, including any engineering inspection reports •The development code, indicating whether or not the storm drainage code is required For your reference, the house was completed on February 28, 1990. The side sewer permit was issued on January 4, 1990. I believe the area was short -platted several years earlier. Specifically, I am attempting to find out if the downspout water is appropriately removed. For example, did city ordinance/code allow for an infiltration trench on this property, or was a detention tank required? Please call me at 292-2387 if you have any questions. To maintain high quality surface water by protecting creeks, streams, ponds, lakes and other bodies of water from pollution by sediment, oil or•other damaging substances. B. To protect land near development sites from increased surface water runoff rates which could cause erosion or flooding. C. To protect private and public property and city streets and rights -of -way from flooding or erosion. D. To promote development practices which will ensure that the above purposes are met. 18.30.020 DRAINAGE APPROVAL REQUIRED A. Drainage Plan. Before issuance of any development permit, and before development begins on any site, the developer shall submit a drainage plan and obtain approval from the Public Works Director. B. Installation of Drainage System. The drainage system shall be installed concurrently with site development, and shall be completed as shown on the approved plan before City approval of an occupancy permit or final inspection. C. Scope. 1. Development permit means: a. A building permit or other construction permit for a development which will result in more than 2000 square feet of previously uncovered land being covered with impervious surfacing. b. A grading permit, or a permit for a rockery or a retaining wall. C. Final approval of a subdivision or Planned Residential Development. 160 18.30.030 2. Development means any change to a site which results in more than 2000 square feet -of previously uncovered land) being covered with impervious surfacing. D. Preliminary Drainage Proposal. Preliminary drainage proposals are required with other required application materials for staff review for the following applications: 1. Preliminary approval of a subdivision. 2. Preliminary approval of a Planned Residential Development. 3. Approval of any of the following permits which would allow the construction of more than one single family dwelling on one lot: a. Conditional use permits. b. Variances. C. Shoreline permits. E. Waiver. The Public Works Director may waive the requirement of a drainage plan and system if he determines that the proposed development will not adversely affect the amount or location of drainage on and near the site, and will not result in any pollution of surface water. 18.30.030 CONTENTS OF DRAINAGE PLANS A drainage plan is a proposal for handling the water flowing through and falling on a site. The plan shall contain the following elements. A. Topographic Map. A topographic map drawn to scale showing the site, and all drainage areas from which water flows onto :he site, with a calculation of the acreage of the drainage areas. The site shall be shown in detail, and grading and clearing plans shall be included. B. Proposed Drainage System. Plans drawn to scale showing the improvements or other methods of handling the runoff in accordance with the requirements of Section 18.30.040, and cost estimates for .the installation of the proposed system. C. Calculations. Calculations used to size the.proposed drainage system, indicating the existing and proposed peak flow and amount of water entering and leaving the site. Calculations of proposed conditions shall be shown for each major on -site facility affecting flow rates. 161 4/ 18.30.040 D. Erosion Control. Measures proposed to control erosion, or other pollution of offsite property and surface water, both temporarily during construction and permanently after construction. E. Open Channels. If use of open channels or ponds is proposed, plans shall show the extent and -elevation of the designed maximum water flow. A cross section shall be submitted, showing side wall construction and the designed maximum level of water flow, which shall be at least one foot below the edge of the channel. F. Preliminary Proposals. When a preliminary drainage proposal is required to be submitted, it shall consist of a general description of how the applicant plants -to comply with this chapter. G. Schedule. A time schedule for construction and inspection of the system, including clearing and grading. H. Standard Plans. The Public Works Director shall adopt sets of standard engineered plans to be used for development permits involving less than 5000 square feet of impervious surfacing, not located in critical drainage areas or environmentally sensitive areas. (See Sections 18.30.040 and 20.15.040.) 18.30.040 DESIGN REQUIREMENTS A. Engineered Plans. All elements of a drainage plan shall be prepared by a registered civil engineer and shall bear the seal and signature of the engineer, unless waived by the Public Works Director. B. Peak Discharge Rate. The rate of surface water leaving the property from the design storm after construction shall not exceed the rate before construction. This requirement'may be met by retaining water for on -site disposal, by detaining water on -site for release offsite at the allowable rate, or by a combination of the two methods. C. Critical Drainage Areas. In the critical drainage areas, the Public Works Director may require that the volume of water leaving the site over a period of time may not exceed the pre -construction volume for the same period of time, or may require other special measures related to the critical drainage problems. Critical drainage areas are areas with special drainage problems because of existing flood potential, soil instability or high erodibility of the soil. Critical drainage areas shall be identified by the Public Works Director. 162 18.30:050 D. Receiving Facilities. There shall be no change in location or capacity of existing facilities or natural features that receive offsite surface water entering the site. E. Discharge Facilities. Where possible, surface water discharge offsite shall be released at the same points that handled the runoff before -construction, with no significant change in the proportion of water handled at each point. Where significant changes are necessary, downstream drainage facilities shall be improved to allow them to -accommodate the increased drainage without damage to the drainage facilities, nearby property or water quality. F. Design Basis. All drainage calculations shall be based on a design rainstorm with a ten year average return period. A 25-year design rainstorm shall be used if the drainage area is more than 50 acres or if the drainage area produces runoff of more than 20 cubic feet per second during a 25-year design rainstorm. G. Setbacks. All structures on the site shall be setback at least ten feet from any closed drainage facility, and at least 15 feet from the edge of any open drainage channel or pond. H. Deviations. The Public Works Director may approve minor deviations from the requirements of this section. The decision shall be written, shall state the reasons for the decision, and shall be based on the following factors: 1. Capacity and condition of downstream facilities. 2. Effect on receiving bodies of water. 3. Significant damage from on -site disposal of water. 4. Existence of regional retention or detention facilities. 5. Major difficulties in maintaining the drainage system. I. Water Quality. To the extent technically feasible, as determined by the Public Works Director, the quality of water released offsite or disposed of on -site shall be at least as high as the pre -construction water quality. 18.30.050 REVIEW OF DRAINAGE PLANS A. Review. The Public Works Director shall review all plans for compliance with this chapter. Revision and resubmittal may be required. B. Fee. A review fee as set in Chapter 15.00 shall be paid. y 163 Ll 18.30.060 18.30.060 PERFORMANCE BONDS Before beginning construction on the site, and before the City issues any construction permit for any site, the owner or builder shall post a performance bond or other suitable security, in accordance with Chapter 17.10. A maintenance bond may be required before final approval of the drainage system. 18.30.070 MAINTENANCE A. Owner's Responsibility. Failure to maintain the on -site drainage system in accordance with this chapter and the approved specifications shall be punishable as a misdemeanor. In addition, the Public Works Director may notify the owner of the violation in writing, which notice may set a reasonable time for compliance. The Public Works Director may extend the time limit for reasonable cause. The notice shall also contain an explanation of subsection 2 below. 2. If the owner fails to correct the violation within the time limit, the Public Works Director may cause the violation to be corrected at City expense, and bill the owner -for two times the direct cost to the City. This bill shall be a lien on the property. C. City Inspection. The Public Works Director may inspect the maintenance of the system from time to time, but shall have no duty to inspect at regular intervals. The owner shall allow the Director free access to all parts of the system for purposes of inspection during normal working hours or'in an emergency. D. Owner's Covenant. The owner shall grant the City a covenant incorporating the provisions of subsection B and C above unless the City assumes the maintenance. The covenant shall include a clause releasing, and indemnifying and holding harmless the City from any and all claims for damages or injunctive relief of whatever nature resulting from the construction, operation or maintenance of the drainage sys- tem. The City may record the covenant at the owner's expense to give notice to later owners of the site. 164 E. Citv_'s Option. If the Public Works Director recommends that. the City assume the maintenance of a drainage system, because the system provides a public benefit, the City Council may approve the maintenance of the system at the end of the first two year maintenance period. Before the Council accepts the system, the Public Works Director shall: 1. Determine by inspection that the system has been satisfactorily completed according to the approved plan. 2. Review and report to the Council the owner's record of system expenses over the two year period. 3. Obtain deeds or easements from the owner to allow the City to maintain the system. 18.30.080 NEIGHBORHOOD DRAINAGE PLANS A. Preparation and Effect. The Public Works Director may prepare drainage plans for neighborhood areas. When a plan has been prepared, all drainage systems for development in the area covered by a plan shall be consistent with the plan. B. Neighborhood Drainage Facilities. When a drainage plan is required for a development in a location suitable for the construction of a drainage facility serving a neighborhood area, the Public Works Director may require that the owner pay an amount equivalent to the cost of a normal drainage system to the City, and grant the City permission to construct the neighborhood facility on the site, in lieu of constructing the normally required drainage system. 18.30.090 GOVERNMENTAL ENTITIES Any governmental entity beginning a development in the City shall comply with this chapter. 18.30.100. OTHER MEASURES The Public Works Director may order a property owner to take measures other than those listed in this chapter to protect the public health, safety and welfare from imminent dangers caused by erosion, flooding and other drainage related problems. 165 EX.
