side sewer in street area. Do not cover any portion of sewer before it has been inspected.
NOTE No. 2—All work performed in city right-of-way requires an Invasion of Right -of -Way Permit obtainable from the City Engineer's office.
NOTE No. 3—Obtain full information regarding Ordinance 11.16.030 and Regulations governing side sewers when you get permit.
NOTE No. 4—Top of side sewer must have at least 30 inches coverage at property line and 12 inches inside property line; minimum grade of 2%. No bends in grade
sharper than % will be permitted.
NOTE No. 5--Trenches in street must be water settled and surface of street restored to original condition. Contractors shall be responsible for failure due to improper
work which may develop within one year of completion.

A site inspection has revealed a site developed with a single family hotne on the west side of
12th Avenue North. The site has very little elevation change between 12th Avenue North and
the existing house. However the site slopes steeply downward from the east side of the house
westward beyond the western property line. On the west side of the house there is a steep slope
with a rockery which appears to be between 15 and 25 feet tall. The slope is also steep above
and below the rockery. The site appears to contain slopes that are greater than 40% with a
vertical elevation gain of more than 20 feet.
Based on the above findings, it .is determined that there is potentially a steep slope critical area on
or adjacent to the site. A Critical Areas Study is required to delineate the boundaries of this
potential critical areas, the buffers and setbacks. For the steep slopes, a licensed surveyor must
create a topographic map of the site which indicates all areas which slope 40% or more and have
a vertical gain of 20 feet or more within the 40% slopes. The map must also show the location of
the steep slope buffers and setbacks. The surveyor must also create legal -descriptions for the
critical areas and the buffers.
If the property owner wishes to apply for a specific development permit which they feel would
not impact the Critical Areas located on the site, they may submit their proposal to the Planning
Department for review. If the Planning Department finds that the proposed development permit
will not adversely impact a Critical Areas or its buffers, a conditional waiver may be issued on a
project by project basis.

This is in response to Councilman Clement's request for a
status report on the storm damage claim filed by Ronald E.
Wachs in the amount of $9000. As with the other parties
that filed a claim for damage, a letter disclaiming any
liability on the part of the City was mailed to Mr. Wachs
on February 7, 1979 by the City's insurance carrier— CNA.
A copy of the letter is attached.
Incidentally, from the seven other parties involved, only
two responded to the letters and according to our insurance
carriers claims specialist, no further action will be
required on these seven claims.

We have completed our investigation as to the cause of the water damage which
occurred on November 3, 1978, to your property. The U.S. Weather Bureau shows
that the amount of rainfall which occurred during this evening would classify
this as a twenty year storms. The criteria used for the design of the storm
system is a five year storm as the costs for a twenty year -storm would be
prohibited.
There is not any negligence on the pert of the City of Rdmonds for Water damage
to your property as the cause was an abnormal amount of rainfall. Thus, we

TO WHOM IT MAY CONCERNI
On November 3, 1978 it approximately 800 P.M., I discovered Water
rushing down the North side of my property at 1011 - 12th Ave., N.,
Edmonds, We, Upon investigating the cause, I discovered the storm
catch basin located two houses North was plugged. The Water had
backed up to the point that it was running down the driveway9of the
house located directly to the north of our property, 1015 12th Ave.,M.
The meter coming down the two driveways continued out the South aide of
their carport on to our property. At this point the washing of dirt and
rocks started. The dater was running so fast and so deep it made a
ditch approximately 4 to 5 feet wide and 3 feet deep down to the North-
west corner of our house. At this point the water started to erode
the rockery and rock bulk head which extends across the West side of
our property from South to North. The force and quantity of water was
so great that it washed approximately 25feet of the rockery, bulkhead
andshrubs away. With the dirt.and rocks washed away, it has left the
Northwest corner of the dock dangerously supported making it unusable
for fear of.collapee.
I feel that the cause of the damages are due to poor or inadequate
atorm drains. My house located at 1011 - 12th Ave., No., Edmonds
is located on the West side of the street. There is only one catch
basin located on the West side of the street in the area we are con-
eernsd_with. There are two other catch basins located on 12th Ave.
on the East side of the street, however 12th Ave. slopes so badly to
the West that the East catch basins are bypassed by moat of the water.
Attached is a layout of the area of 12th Avenue over which we are con -
earned.
Listed below are what@ we feel are contributing factors to the present
water problem we are encountering.
1. The -lack of adequate storm drains. (there are no storm drains
as far up the hill as 12th P1., all water bypasses the storm
drain on the .corner of Vista Way and 12th Ave.)
2. The location of existing storm drains.
3. The amount of water being diverted onto the street from houses
on the east side of 12th and above.
4. The slope of the street Which allows all water to run to the
west side.
5. The driveways at 1015 - 12th Ave.,No..
Nona of the above mentioned .are problems which we individually can solve
or have control oiler but we remain victims of all of the above. The es-
timate which we have received is $9000.00 to repair the damage done. We
era at this tima filing a claim against the City of Edmonds for the
f9000.00 to repair the damage.. We are most interested in the City of
Edmonds proposing some solution to this water problem in order that we
do not have to live in fear everytimo it reins.

the night of November 3. the morning of November 4th, a city employee
came and looked at the damage and said that his supervisor would be in

SUBJECT: STORM.DRAINAGE DAMAGE, 1011 12th Ave. North
An intense rain storm on the evening of November 3, 1978,
resulted in heavy excess storm water runoff in the M anle-
wood Hill area from 12th Place North, Vista Way, and Wagners
Road, which flowed to catch basins located at 1015 12th Place
North. Heavy leaf drop occurred with the high winds also
and resulted in many catch basin inlet grates being covered
above this location and increasing the amount of drainage
runoff at this low point of the drainage system collection.
No knowledge or record of the problem was received by Street'
crews during the evening of the storm however the Street
Foreman responded to a call on the following morning. On
investigation it was found that water had overflowed the
curb near the drainage inlet into the driveway at 1015 12th
North and around the house and along the property line be-
tween the adjoining properties of 1015 and 1011 12th Avenue
North. Adjacent to theproperty line in the Northwest corner
of the claimants property a rock retaining wall which was
constructed in 1978 against a loose.fill enbankment had
collapsed. Due to this, being a�newl,y constructed residence
the matter was referred to the Engineering Division for
further investigation as attached.

1. Pictures taken did not develop. The claimant, however
stated that he had taken several pictures.
2. The route of the water described by the claimant is
consistent with evidence I found.
3. It is possible that the water eroded and saturated
the north end.of the rockery base causing it to fail.
The water probably did not directly remove all rockery
described.
4. A water head of about 3-, inches would be required
to allow the single inlet to handle a 25 .year storm from
the tributary area shown on attached map. Curbs are
about 5+ inches high. Normally, adequate capacity would
exist. The driveway at 1015 12th Avenue .North appears,
however, to allow overtopping prior to development of 32
inch head.
5. The claimant was advised of three courses.of action
which could all be pursued:
a. File claim for damages.
b. Realize they built in a swale and that they
should make some provision for flood -type waters -
the City could not keep people at all catch basins
throughout storms to keep them from clogging.
C. The Public Works Department will look.into placing an
additional catch basin up slope from the adjacent,
property driveway.

On November 3, 1978 at approximately 800 P.M., I discovered water
rushing down the North side of my property at 1011 - 12th Ave., N.,
Edmonds, Wa. Upon investigatiiig the cause, I discovered the storm
catch basin located two houses North was plugged. The water had
backed up to the point that it was running down the drivewaysof the
house located directly.to the north of our property, 1015 12th Ave. ^
The water coming down the two driveways continued out the South side of
their carport on to our property. At this point the washing of dirt and
rocks started. The water was running.so fast.and so deep it made a
ditch approximately 4 to 5 feet wide and 3 feet deep down to the North-
west corner of our house.. At this point the water.started to erode
the rockery and rock bulk head which extends across the West aide of
our property from South to North. The force and quantity of water was
so great that it washed approximately 25feet of the rockery, bulkhead
and shrubs away. With the dirt and rocks washed away, it has loft the
Northwest corner of the deck dangerously supported making it unusable
for fear of collaPee..
I feel that the cause of the damages are due to poor or inadequate
storm drains. My house located at 1011 - 1.2th Ave., No., Edmonds
is located on the West side of the..strent. There is only one catch
basin located on the West side of the street in the area we are con-
cerned with. There are two other catch basins located on 12th Ave.
on the East side of the street, however 12th Ave. slopes so,badly to
the West that the East catch basins are bypassed by most of the water.
Attached, is a layout of the area of 12th Avenue over which we are con-
cerned.
Listed below are whate we feel are contributing factors to the present
water problem we are encountering,
1. The lack of adequate storm drains. (there are no storm drains
as far up the hill as 12th P1., all water bypasses the storm
drain on the corner of Vista Way and 12th Ave.)
2. The location of existing storm drains.
3. The amount of water being diverted onto the street from houses
on the east side of 12th and above.
' 4. The slope of the street which allows all water to run to the
west side.
5. The driveways at 1015 - 12th Ave.,No.
None of the above mentioned are problems which we individually cart solve
or have control over but we remain victims of all of the above. The es-
timate which we have received is $9000.00 to repair the damage done. We
are at this time filing a claim against the City of Edmonds for the
59000.00 to repair the damage. We are most interested in the City of
Edmonds proposing some solution to this water problem in order that we
do not have to live in fear everytime it rains.
