After reviewing the official file which included the Planning Division Staff Advisory Report; and
after visiting the site, the Hearing Examiner conducted a public hearing on the application. The
hearing on the Wachs application was opened at 12:14 pm., June 20, 1996, in the Plaza Room,
Edmonds Library, Edmonds, Washington, and closed at 12:23 p.m. Participants at the public
hearing and the exhibits offered and entered are listed in this report. A verbatim recording of the
hearing is available in the Planning Division.

Kirk Vinish submitted the staff report into the record which recommended partial approval
of the application.
From the Applicant:
Jed Miller, Architect for the Applicant, explained that:
e The closet is identical to the encroachment proposed for the other side of the house.
The only way to obtain a reasonable closet for the master bedroom is to extend 18
inches into the setback under the overhand.
® There is no practical way to relocate the closet to another place in the house.
There will be no view impact from neighboring properties if the variance is approved.

FINDINGS OF FACT AND CONCLUSIONS
A. SITE DESCRIPTION
1. Site Development And Zoning:
a. Facts•
(1) Size. The subject property is approximately 11,764 square feet in area.
The proposed additions would be located on the north and south
portions of the property approximately 8-feet 6-inches from the nearest
property line (see Exhibit A, Attachment 4
(2) Zoning The zoning of the subject property is Single Family Residential
(RS-12) (see Exhibit A, Attachment 3).
(3) Terrain and Vegetation: Generally the subject property is fairly level,
with a sharp downward slope near the west property line and a
significant decline on the east side of the property, with all open areas
fully landscaped (see Exhibit A, Attachment 4).
2. Neighboring Development And Zoning:

(1) North: Developed with detached single family residences, and zoned
RS-12 (see Exhibit A, Attachment 3).

B. EDMONDS COMMUNITY DEVELOPMENT CODE (ECDC) COMPLIANCE
1. Compliance with RS-6 Zoning Standards
a. Facts:
The fundamental site development standards in a RS-12 zone are set forth
in Chapter 16.20.030.
b. gonclusion: Except for the requested side setback variance, the applicant is
proposing to build a structure which conforms to the RS-12 development
standards for locating structures on a lot.
2. Compliance with requirement for a Variance
ECDC Chapter 20.15B.180.A, states an applicant may request a variance from
the standards of this Chapter pursuant to the procedures set forth in ECDC
Chapter 20.85 (Variances). Chapter 20.85 of the ECDC sets forth the
mechanism whereby a provision of the Code may be varied on a case -by -case
basis if the application of the provision would result in an unusual and
unreasonable hardship (see Exhibit A, Attachment 2).
a. Fac : ECDC Section 20.85.010 establishes the decisional criteria with
which a variance request must comply in order to be granted by the
Hearing Examiner. These criteria include: a special circumstance must
exist; no special privilege is granted; the proposal is consistent with the
Comprehensive Plan and the Zoning Code; the proposal will not be
detrimental and is the minimum necessary.
Variances may be used to modify bulk standards. They may not be used to
modify use or procedural requirements.
(1)Special circumstances include the size, shape, topography, location or
surroundings of the property and public necessity for public structures.
In this case, the applicant wants to construct to additions attached to an
existing residence. The topography towards the west has a sharp
downward slope and the topography towards the east also has a
significant downward slope. The applicants believe they would
encroach upon the steep slope critical area buffer if they were to locate
in that area, however they could locate in the area of the deck which

already encroaches on the critical area buffer. The subject property is
11,764 square feet, and zoned RS-12, since the property is slightly
under sized for the zoning district approval of one of the
encroac tnents would be reasonable. Special circumstances exist,
therefore, due to the topography and size of the property relative to the
zoning classification (see Exhibit A, Attachment 2) for the kitchen
addition.
(2) $,pecial Privilege
It does not appear that any special privilege will be demonstrated in
granting this variance in that other properties in the same zone with
similarly sized lots have also qualified for a variance.
(3) Zoning Code and the Comprehensive Plan
Approval of the proposed variance would allow for the continued
development of the site in a manner consistent with the intent of the
Zoning Code and the Comprehensive Plan designation of the site (see
Exhibit A, Attachment 2).
(4) Not Detrimental
Approval of the variance would not be detrimental to the public health,
safety or welfare (see Exhibit A, Attachment 2).
(5) Muumum Required
The request appears to be the rninirnum necessary to allow for
accommodate of both the closet for the master bedroom and addition
for the kitchen. After conducting a site visit, the Examiner has
concluded there are no other logical alternatives if the expansions are to
be allowed at all.
C. TECHMCAL COMMIWEE
1. Review by City Departments
a. Fact: No comments were submitted by other departments.
D. COWREHENSiVE PLAN (ECDC)
1. a. Fact: The subject property is designated as "Single Family
Residential".
b. Conclusion: The proposed developmnt is consistent with the
existing Comprehensive Plan Land Use designation for the site.
2. a. Facts: The Comprehensive Plan, Residential Development section,
identifies goals and policies which relate to "Residential Development"
in the City. Specific goals and policies are discussed in detail below.
(1) Section B states as a goal of the City that: "High quality
residential development which is appropriate to the diverse
lifestyle of Edmonds residents should be maintained and
promoted...: '

b. Conclusion The proposed development is consistent with the
above adopted goals and policies of the City for the development of
residential property in the City.
Based upon the foregoing findings and conclusions, the request for a variance is approved, subject
to the following conditions:
1. This variance is to allow the kitchen and closet projections in the location identified on the
proposed site plan (see Exhibit A, Attachment 4). Any other structures, additions or
remodels would have to conform with the typical setbacks or height requirements for the
zone or obtain another variance.
2. This application is subject to the applicable requirements contained in the Edmonds
Community Development Code. It is the responsibility of the applicant to ensure
compliance with the various provisions contained in these ordinances.
3. The applicant must obtain a building permit prior to construction.
4. The permit is transferable.

Be Appeals
Section 20.105.020.A & B describe how appeals of a Hearing Examiner decision or

of the individual or group appealing the decision, their interest in the matter, and reasons why the
appellant believes the decision to be wrong. The appeal must be filed with the Community
Development Director within ten (10) working days after the date of the decision being appealed.
IV. LAPSE OF APPROVAL
Section 20.05.020.0 states 'Unless the owner obtains a building permit, or if no building is required,
substantially commences the use allowed within one year from the date of approval, the conditional use
permit shall expire and be null and void, unless the owner files an application for an extension of the time
before the expiration date.'

Project Description: Remodel existing single family residence to include modifications to
the existing roof and addition of I8"projections into the side yard setbacks on the north and south
side of the existing residence. These additions would be designed to be hung off the existing
structure.
Variance Request: Encroachment of 18"projections into both side yard setbacks on the
north and south side of a single family residence in an RS -12 Zone (refer to attached site plan).
1. &LeSLal circumstances Criteria:
a. Zoning: The site is zoned RS -12 , requiring a minimum lot size of 12,000 sq; ft. and 80'
minimum lot width. The lot is slightly sub -standard per the Site Development Standards. The lot
width is 78.43' and the actual lot area is 11,764.5 sq ft. (the depth is 150 ft.).
b. Easements: There are two easements on site. A ten foot easement on the west end of the
site running the width of the property far the sanitary sewer line and a second easement is located
at the northeast corner of the property, 10 by 10 feet, for the Public Utility District and West Coast
Telephone Co.
c. Topography: The site has steep slopes. Towards the east end of the site the grades are
approx. 15-30%, exceeding 30% at the west end of the property. It is preferable not to disturb the
existing grades by installing foundations since the site is within Critical Areas.
2. Special Privilege:
If the site met the minimum site development standards of an 80' lot width at least one the
18' projections would be allowed. The existing eaves on the north and south side of the residence
project 18" into the side yard setbacks and the additions would be tucked in under the eaves. The
design would not increase this distance. Other properties in the vicinity with steep slopes often
qualify for reductions of setback requirements.
3. Comprehensive Plan Goals:_
The project goals are consistent with the Comprehensive Plan Designation of the site and areas
follows:
a. To preserve existing natural site characteristics.
b. To control and limit erosion due to disturbance of the hillside and vegetation.
c. To protect natural storm drainage system.
d. To assure visual quality and aesthetic harmony of residential development to enhalceahe
community.

Project .description: Remodel existing single family residence to include modifications to
the existing roof and addition of 18"projections into the side yard setbacks on the north and south
side of the existing residence. These additions would be designed to be hung off the existing
structure.
Variance Request: Encroachment of 18" projections into both side yard setbacks on the
north and south side of a single family residence in an RS -12 Zone (refer to attached site plan).
1. Saecial Circumstances Criteria:
a. Zoning: The site is zoned RS -12 , requiring a minimum lot size of 12,000 sq ft. and 80'
minimum lot width.. The lot is slightly sub -standard per the Site Development Standards. The lot
width is 78.43' and the actual lot area is 11,764.5 sq.t. (the depth is 150 ft.).
b. Easements: There are two easements on site. A ten foot easement on the west end of the
site running the width of the property for the sanitary sewer line and a second easement is located
at the northeast corner of the property, 10 by 10 feet, for the Public Utility District and West Coast
Telephone Co.
C. Topography: The site has steep slopes. Towards the east end of the site the grades are
approx. 15-30%, exceeding 30% at the west end of the property. It is preferable not to disturb the
existing grades by installing foundations since the site is within Critical Areas.
2. �pecial Privilege:
If the site met the minimum site development standards of an 80' lot width at least one the
18"projections would be allowed. The existing eaves on the north and south side of the residence
project 18" into the side yard setbacks and the additions would be tucked in under the eaves. The
design would not increase this distance. Other properties in the vicinity with steep slopes often
qualify for reductions of setback requirements.
3. Comprehensive Plan Goals:
The project goals are consistent with the Comprehensive Plan Designation of the site and are as
follows:
a. To preserve existing natural site characteristics.
b. To control and limit erosion due to disturbance of the hillside and vegetation.
c. To protect natural storm drainage system.
d. To assure visual quality and aesthetic harmony of residential development to enhangelthe -
community.
