Please answer all questions
1. What are the physical characteristics, (i.e. topography, shape
of lot, etc.) which create a hardship for you in regard to
development of your property?
This is a retail gasoline sales facility containing a canopy covered gasoline dis-
pensing area with a small building for'the sales attendant. Using building wall to
determine allowable sign area results in exceedingly small area, an area much

smaller than existing sign being replaced.
2. How does your property differ from other property in the same
vicinity?
,although the property is similar to other commercial property, the small building
related to large covered area is different than other enclosed buildings.
3. Will this variance be detrimental to the public or damaging to
other property or improvements in the vicinity?
No, as the requested sign is not larger than other adjacent business signs. Also,
the resulting area is the same as sign being replaced.
4. What hardships will result to you if the variance is not granted?
Will these hardships have been caused by your own action?
The existing business cannot remain economically viable without displaying name, and
applicable laws require sales prices to be displayed.
5. Can you make reasonable use of your property without the variance?
Only if we completely rebuild the existing damaged sign.

OF GULL INDUSTRIES, INC. FOR
APPROVAL OF A VARIANCE
DECISION: The variance request is denied.
INTRODUCTION
Gull Industries, Inc., P.O. Box 24687, Seattle, Washington, 98134,
and hereinafter referred to as Applicant, has requested a variance
from the maximum area for signs a llceed in a BN zone. The Appli-
cant seeks a 36 square foot freestanding sign which is in excess
of the allowed area for signs by 1.2 square feet.
A hearing on the request was held before the Hearing Examiner of
-the City of Edmonds on March 6, 1986.
At the hearing the following presented testimony and evidence:

After due consideration of the evidence presented by the Applicant;
evidence elicited during the public hearing; and, as a result of
the personal inspection of the subject property and surrounding
areas by the Hearing Examiner, the following Findings of Fact and
Conclusions constitute the basis of the decision of the Hearing
Examiner.
FINDINGS OF FACT
1. The application is for the approval of a variance to allow a
freestanding sign at 10119 Edmonds Way, Edmonds, Washington,
to exceed the maximum allowed 24 square foot freestanding sign
by an additional 12 square feet. The specific request is for

a 36 square foot freestanding sign to be located on the subject
property. (Staff report.)
2. The subject property is zoned Neighborhood Business (BN).
Section 20.60.040(B) of the Edmonds Community Development Code
(ECDC) sets the maximum area for freestanding signs in a BN
zone at 24 square feet. it is from this section of the ECDC
that the Applicant seeks a variance. (Bowman testimony.)
3. The Applicant is an oil company that operates a gas station
on the subject property. It is the intent of the Applicant
to construct a 36 square foot freestanding sign that will con-
sist of two separate panels. The top panel will identify the
Gull Gas Station and the lower panel will set forth the prices
of the various gasoline•on site. (011enburg testimony.)
4. The subject property is a triangular -shaped lot that is located
on the east side of State Route 104 in the City of Edmonds.
It consists of a small gas station facility and a covered
pump island. Until recently there was a non -conforming 32-
square foot freestanding sign on site. This sign was damaged
beyond repair by vandals. It is the intent of the Applicant
to replace the damaged sign with a 36 square foot sign.

5. In order for a variance to be granted within the City of Edmonds
the criteria as set forth in Section 20.85.010 of the ECDC must
be satisfied. These criteria include:
A. Special circumstances relating to the property must
exist necessitating the variance;
B. The required variance must not result in a special
privilege being granted to the Applicant;
C. The variance must be consistent with the Comprehensive
Policy Plan Map of the City of Edmonds;
D. The variance must be consistent with the purposes of
the zone district in which the property is located;
E. The variance must not be significantly detrimental to
the public health, safety or welfare, nor injurious
to the property or improvements in the vicinity of the
same zone; and,
F. The variance must be the minimum necessary to allow
the same rights enjoyed by other properties in the
same zone.

6. The Planning Department submitted that the allowable sign
area for the business on the subject property should be cal-
culated off the small attendant building which is located on

site. To calculate as such puts the Applicant at a disadvantage
because of the size of the other businesses and buildings in the
area. (Bowman and O1lenburg testimony.)
7. The Planning Department submitted that the requested variance
would not be the grant of a special privilege to the Applicant.
(Bowman testimony.)
8. The Planning Department submitted that the requested variance
does not conflict with the purposes of the Comprehensive Plan
which designates the subject property as High Density Resi-
dential. Further, the Planning Department submitted that the
requested variance is consistent with the zoning ordinances
of the City of Edmonds and the BN zone. (Staff report.)
9. The Planning Department submitted that the proposed variance
does not create a significant impact to the public, nor to
nearby private properties or improvements. (Staff report.)
10. The Planning Department submitted that the only criterion that
is not satisfied by the variance request is that the requested
variance does not appear to represent the minimum necessary
to allow the Applicants the same rights enjoyed by other pro-
perty owners in the same zone. Because of the exposure to the
traffic on Edmonds Way and the allowed 24 square foot sign
requirements for BN zones, the Planning Department submitted
that a 24 square foot sign is adequate to identify the subject
property. (Bowman testimony.)
11. The Applicant submitted that if the original sign had not been
destroyed by vandals it was their intent to remove it and re-
place the sign with a new base. The reasoning for the replace-
ment was to provide more exposure for the gas station. (011en-
burg testimony.)
12. The Applicant submitted that a 24 square foot sign would result
in the reduction of the Gull logo on the sign and also smaller
numbers for the advertising of the prices of gasoline. Accord-
ing to the Applicant, this reduction will not be beneficial to
the business on site. (011enburg testimony.)
13. The sign as proposed by the Applicant would have a six-foot
wide face on the two panels of the sign and would be six foot,
one inch, in length. In addition, the face of the sign would
be 7' 1.1" above grade. The sign would be illuminated from the
interior and would have a plastic face. (Exhibit 9.)
14. The Applicant submitted that the design of the sign can be
altered somewhat, but it is dependent upon the size of the
illuminating lamp for the exact size. According to the Ap-
plicant, a 24 square foot sign would have smaller lamps for
illumination. (011enburg testimony.)

15. The Planning Department of the City of Edmonds recommended
denial of the variance. In the recommendation the Planning
Department stated:
It is the staff's recommendation that the Applicant be allowed
to either replace the existing sign with a new 24 square foot
freestanding sign or that the present sign be repaired, as it
was originally approved by the City under ADB-36-77.

16. No other testimony was submitted at the public hearing.
CONCLUSIONS
1. The application is for the approval of a variance to allow a
freestanding sign on property located at 10119 Edmonds Way,
Edmonds, Washington, to exceed the 24 square foot area standard
for BN zoned properties. The specific request is for the al-
lowance of a 36 square foot sign on the subject property.
2. In order for a variance to be granted within the City of Edmonds
the criteria as set forth in Section 20.85.010 of the ECDC must
be satisfied. All of the criteria of that section must be
satisfied. The request of the Applicant does not satisfy all
the criteria of Section 20.85.010 of the ECDC.
3. Special circumstances do exist for the granting of a variance.
The Applicant's original nonconforming sign of 32 square feet
was destroyed by vandals and was not the act of the Applicant.
As a result, the Applicant must replace the sign. In addition,
the size of the Applicant's structure in comparison with other
structures in the vicinity warrant the granting of a larger
sign than the allowable 24 square feet. However, the circum-
stances do not warrant the granting of a variance for a 36
square foot sign.
4. The granting of a 36 square foot sign will be the grant of a
special privilege to the Applicant. The Applicant could
utilize the base and the 32 square foot existing sign.
5. The requested variance does not conform to the standards of the
zoning ordinances of. the City of Edmonds or the BN zoning
standards for the City of Edmonds.
6. The granting of a variance will not be detrimental to the sub-
ject property or to other properties in the vicinity.
7. The variance requested is not the minimum necessary for the
Applicant to properly erect the sign that identifies the pro-
perty. The Applicant should be allowed to replace the exist-
ing sign with a 24 square foot freestanding sign, or repair
the existing 32 square foot sign and use that sign for adver-
tising purposes.

DECISION
Based upon the preceding Findings of Fact and Conclusions; the
testimony and evidence submitted at the public hearing; and, upon
the impressions of the Hearing Examiner, the requested variance
for a 36 square foot freestanding sign to be located at 10119
Edmonds Way, Edmonds, Washington, is denied. However, the Appli-
cant 'is allowed to erect a 24 square foot sign per the Edmonds
Community Development Code standards for signs in BN zoned pro-
perty, or to repair the existing sign and use the 32 square foot
sign.
COMMENTS
The Hearing Examiner has adopted the position of the Planning
Department of the City of Edmonds for the request of the Appli-
cant for the variance to allow a 36 square foot sign. The Appli-
cant's situation is not self-imposed and it is appreciated that
circumstances beyond the control of the Applicant have created
the situation for a new sign. Vandals destroyed the original
sign and now the Applicant must replace the sign. It must be
noted, however, that the original sign was a nonconforming sign
of 32 square feet that exceeded the BN zone requirements fob
freestanding signs by 8 square feet. To allow the Applicant to
replace the nonconforming large sign with a sign that is four
square feet larger does not appear to be justified or reasonable.
To do so would disrupt the sign standards for the City of Edmonds.
Accordingly, the Applicant should be required to meet the standards
for signs in BN zones or to use the existing nonconforming sign
structure for the new sign.
Entered this 21st day of March, 1986, pursuant to the authority
granted the Hearing Examiner under Chapter 20.100 of the Community
Development Code of the City of Edmonds.

A. Descri tion of the Subject Property and Surrounding Area +
The subject property is a triangular_ shaped lot located on
the east side of SR 104, across from the McDonalds
restaurant. The station consists of a small station
attendant building and a covered pump island. },
The gas station was built under CU-26-77 and building permit
#770351. A variance was granted to allow the gas canopy to
project 101into the then required 30' setback
The Applicant is seeking to replace the existing damaged
freestanding sign with a new sign. The existing sign is a
nonconforming 32 sq. ft. freestanding sign. The intended
replacement sign is 36 sq. ft. in area.
Surrounding development is primarily commercial, with the
exception of the single family development to the north.

1. Special Circumstances
The subject property is developed as a self service
station with a small station attendant building and gas
canopy. Allowable sign area is calculated off the
attendant building which puts the station at a
disadvantage with other businesses in the area.
Special circumstances do appear to exist in this
particular case to allow for increased sign area. They
do not however warrant increasing the sign area over
that which presently exists.
2. S cial Privilege
As conditioned, the proposed variance does not appear
to represent a grant of special privilege.
3. Comprehensive Plan
The Comprehensive Policy Plan map designates the
subject property as High Density Residential, as are
all the adjoining properties to the north and west.
The properties to the south and east are designated as
Commercial/Business.
The proposed variance,as conditioned, does not appear
to conflict with the purposes of the Comprehensive
Plan.
4. Zoning Ordinance
The subject property, as well as the surrounding area
to the south, west and east are zoned BN. To the north
is RS-20 and RS-6 zoning.
The proposed variance, as conditioned, does not appear
to conflict with the purposes of the zoning ordinance
or the BN zone district.
5. Not Detrimental
The proposed variance does not appear to pose any
significant impact to the public or to any near by
private property or improvement.
6. Minimum Variance
The requested variance does not appear to represent a
minimum variance request. While the building on which

sign area is calculated is very small, this does not
warrant exceeding the code required 24 sq. ft.
V . STAFF RECOMMENDATION:

Staff cannot support the proposed variance request. It is the
staff's reconunendation that the Applicant be allowed to either
replace the existing sign with a new 24 sq. ft. freestanding sign
or that the present sign be repaired, as it was originally
approved by the City under ADB-36-77.
