Re: S-42-79 - Duitsman Short Subdivision
Dear Mr. Adams:
The engineering requirements set forth at the hearing for the subject
short subdivision on September 27th, specifically items 9a, 9b and additional
requirement d, are the subject of this letter.
There are no immediate plans to apply for a permit to build on parcel B.
The restriction on culverting the stream leaves me with the choice of opening
the adjoining alley or bridging the creek to provide vehicular access to the
building site. Also, the design of a site drainage plan will depend on the
location of the vehicular access.
My request is that these items be deferred until such time that I, or a
subsequent owner of parcel B, submit an application for a building permit. 1
suggest that the deferred requirements be set forth clearly on the final short
subdivision recording documents in order to properly advise a subsequent owner
of the lot.
Please consider this request at your earliest convenience and advise me
of your decision.

having heard comments from the public and owner, the Edmonds
Planning and Engineering Divisions granted Owner a short sub-
division approval under Planning Division File No. S-43-79,
subject to certain conditions as set forth herein, and
WHEREAS, Owner has no objections to the imposition of
said conditions, now, therefore,
IN CONSIDERATION of the grant of short subdivision
approval for the property described herein under Planning Division
File No. S-43-79 and mutual benefits to be derived, Owner, his
heirs, successors in interest and assigns hereby covenant as
follows:
1. Owner is the owner of certain real property located,
in the City of Edmonds, Washington and legally described as set forth
on Exhibit I'l", attached hereto and incorporated herein as if set

a. 2. 'Before any building permit may be issued for any
building or structure to be constructed or enlarged on Lot B of
the property described on Exhibit "l", the plans therefor shall
be subject to approval by the City of Edmonds Engineering Divi-
sion or its successors to ensure that the proposed locations and
designs of the access to said property provides protection of
Shellabarger Creek.
3. Before any building permit may be issued for any
building and/or structure to be constructed or enlarged on Lot B
of the property described in Exhibit "l", certain engineering
requirements normally required prior to recording of the short

subdivision, must be met. These requirements include:
A. Submission to and approval by the City
Engineer of an on -site drainage plan showing,
a
among other things, the means of detention
and/or retention of storm water in excess of
the natural runoff as set forth in Chapter
u;i..: 12.17 of the Edmonds City Code as now exists
or as hereafter amended,or recodified;

alter that portion of Shellabarger Creek that runs through Lot A
or B except as authorized by the City and shall remove all tem-
porary culverts as designated on the building permit number 790083 ,
