VARIANCE CRITERIA - Section 12.16.100
1. Does this amount to a rezone? No.
2.(a) Are there conditions and/or circumstances not generally applicable to other
lands in the same district? Yes, the home was built in 1932. Sub-
sequent platting and street improvements made home non -conforming.
(b) Would strict enforcement of the zoning code deprive the property owner of rights
commonly enjoyed by other properties in the same district? No.
3. Do the special conditions result from the actions of the applicant?
No, see item 2a.
4. Are there unnecessary hardships and practical difficulties in carrying out the

The Engineering Division of Public Works has the following comments to
offer pertaining to the hearing scheduled for the November 19, 1980
Board of Adjustment meeting:

V-34-80 . LAURENCE FREEBURN - Variance of five°feet frw the 'required
ten feet at 19005 92nd Avenue West. (RS-12)
The driveway easement shown by the applicant appears to be
private and not for public use. A five-foot wide sanitary and storm sewer
easement is centered on the north property line also and would not be
affected by this action.

Engineering has no objection to this variance.
V-36-80 P.J. CONSTRUCTION - Variance of four feet from the required
twenty foot rearyard setback at 20815 76th Avenue West. (RMH)
This property is the subject of two other actions that will
have been heard by the time this variance is considered. The presumption
of the applicant is that subdivision of Lot 9 to two lots will have been
approved, thus making this variance necessary. Engineering would have no
objection to this action only if the following conditions are met:
1. That the subdivision of Lot 9 provides an access easement
to 76th Avenue' West ,for this subject easterly lot.
2. That the driveway,yn dth on 76th Avenue West be 24 feet
