'TW CRITICAL AREAS CHECKLIST
The Critical Areas Checklist contained on this form is
to be filled out by any person preparing a
Development Permit Application for the City of
Edmonds prior to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable City staff to
determine whether any potential Critical Areas are, or
may be, present on the subject property. The
information needed to complete the Checklist should
be easily available from observations of the site or
data available at City Hall (Critical Areas inventories,
maps, or soil surveys).
An applicant, or his/her representative, must fill out
the checklist, sign and date it, and submit it to the
City. The City will review the checklist, make a
precursory site visit, and make a determination of the
subsequent steps necessary to complete a development
permit application.
Please submit a vicinity map along with the signed
copy of this form to assist City staff in finding and
locating the specific piece of property described on
this form. In addition, the applicant shall include
other pertinent information (e.g., site plan, topography
map, etc.) or studies in conjunction with this Checklist
to assist staff in completing their preliminary

SUBJECT: Reisner Building Permit Application
Per our conversation at 9:30 a.m. this memo is to inform you of the
previous enforcement action on this property, the Planning Divisions
position on the removal or permitting of the fence in the subject right
of way, and the code requirements of extending a variance.
1. On 5/23/1989, The building division notified Mr. Reinser with a
correction notice that a permit was required for the carport built
on his property. After a letter from the Building Division,
followed by a letter from the Code Enforcement Tech., Mr. Reisner
applied for a permit. In the processing of the permit it was
discovered that a variance was required. The applicant was
notified in the permit process and then failed to apply for a
variance. The applicant was then notified that if a variance was
not applied for or the structure not removed, we would take legal
action. He applied for a variance. The variance was denied. He
asked for reconsideration. Is request was denied. Once again we
informed him that he needed to remove the structure, or legal
action would be taken. He then applied for a second variance
placing the carport in another location. This variance was
approved and is to expire on_ 11/2/91. The applicant was notified
that if the structure is not removed by 11/2/91 enforcement action
will begin. I believe that this property owner has received ample
notification to the illegal status of his carport ant that the
City requires the removal of said carport.
2. V-22-90 was approved by the Hearing Examiner with several
conditions. Condition # 2 states that a street use permit is
required for the fence that is to be located in the right of way.
If the fence is not located in the right of way, there will be no
purpose to the street use permit, therefore the street use permit
would not be required to fulfill the conditions of the variance.
If the street use permit is denied, the fence must be removed from
the right of way in.order to comply with the condition, and to
comply with City ordinance.
3. The applicant may apply for an extension of time by making an
application with the Planning Division prior to the expiration
date of the variance. In this case the application must be
received no later than 11/1/91. The application must state
compelling reasons why this work could not be done before the
expiration date.
