1. We,. as well as our tennants chose this location for "home"

because`_of the surrounding natural beauty. We have lived

(and owned) our property for over 13 years, like the neighbor- `
hood, and have an excellent record of.doing business with
top notch, desireable tennants. lie wish to maintain the status

quo.
2. Fences over 6' in heighth are not acceptable and you can ride

around for hours making your observations in this regard and
you'll conclude that they are non existent except in Industrial .
areas:

3. Any fences having smooth or solid surfaces eventually become
the victums of defacement in one way or another. Graffiti

seems to be the order of the day.
4. We have talked to accredited landscape and nursery experts
and have learned that laurel plants of as tall as five feet can

be transplanted successfully --new growth can be contemplated
{
as high as 6 to 8 inches each year with prover care. We have

r
a laurel "fence" on our west property line and can 'therefore
k
also speak from personal experience.
We love Edmonds, s city of unique beauty. our mayor has always
been an avid exponent of natural beauty and protection of same.
Council approval of the request outlined in subject application could
only encourage many others to apply for equal treatment.

A. Description of the Proposed Action and the Subject Property
The applicant is requesting a Conditional Use Permit to allow

for the construction of a 10' to 12' high concrete block fence.
The proposed fence will run the width of the property (approximately,

80', excluding driveway entrance).
The subject property is 100' wide and its north boundary abuts

SR 524(Puget Drive). A laurel hedge approximately 11' high, is located
on the north property line.
Development adjacent the subject property, to the east and west, .is

single family residential. To the north, across SR 524, .is a gas

station, an apartment house and a single family residence.

The Washington State Department of Transportation is currently
constructing a series of road improvements on Puget Drive. The
improvements which will affect this property include a five foot

D. Zoning Ordinance
The subject property is zoned RS-12. Surrounding zoning to
the east, west and south is also RS-12. To the north,
across Puget Drive, the area is zoned BN (Neighborhood Business).
Fences and hedges are regulated by Chapter 17.30 and must

conform with the purposes of the RS zone.
E. Detriment of Proposed Action
Two property owners, who live across Puget Drive to the north'
have submitted written objections to the proposed fence. Copies

of those letters are attached to this report.
F. Conclusions
The applicant is understandably disturbed at the prospect of -
losing his existing laurel hedge. The hedge provides a sight
screen of the gas station and traffic along Puget Drive. The

immediate solution is to construct a fence 10' to 12' high
which would act not only as a sight screen, but also as a noise
f
barrier.
The problem is that the fence proposed by the applicant does
not appear to be in the best interests of the neighborhood and

the community, i

structure in the neighborhood. The fence would be out of

scale with the homes and other fences in the area.
IV. STAFF RECOMMENDATION j
Staff cannot recommend approval of a 10' to 12' high fence or wall
as proposed by the applicant, f
However, the staff recommends that a modified proposal, be approved,
subject to the following conditions:
1. That the fence be a solid, sight -obscuring structure, six feet
in height, with an additional two feet of latticework allowed
on top, set back five feet from the proposed sidewalk.

2. That, within the five foot setback, the applicant be allowed r
to plant a hedge or other plantings to grow to a height not
