An illegal discharge problem was brought to my attention on August 18, 2008. The coating that was
applied to your roof was apparently partially washed off by rainfall, passed through your downspouts,
and entered the City's stormwater system. I understand that once you were aware of the situation, you
plugged the downspouts from your house and mopped up the remaining wet paint.
The storm drainage from your street flows to Hindley Creek. The system is intended for storm runoff
only, and the water receives no treatment downstream, which means that fish and wildlife habitat are
impacted by any pollutant discharges.
The discharge of any substance other than rainwater into waters of the State constitutes a violation of
Edmonds City Code 7.200 entitled Illegal Discharges to Storm Water System and Watercourses and is
subject to enforcement actions. Payment of a fine of up to $500 per day to cover administrative and
remediation costs associated with this violation is authorized in accordance with Edmonds City Code
7.200.150.
Based on your responsiveness to the situation, however, we will not require you to pay a fine for this first
time occurrence as a homeowner. Please be mindful of additional situations where substances, other than
rainwater, may be washed into the City's storm system.

CONDITIONS OF MITIGATION
MARK M. DEMARA BUILDING PERMIT PLAN CHECK #248
This determination of nonsignificance is subject to the following
conditions:
1. All excavation and grading shall comply with Chapter 70 of
the Uniform Building Code, 1989 edition.
2. The Applicant shall obtain a building permit from the
Building Department and shall comply with all conditions of
permit approval.
3. The applicant shall place a fabric filter fence along the
north and east perimeters of the stream prior to any grading
on site. The fabric filter fence shall remain until
construction is complete. The fabric filter fence shall be
installed with the bottom of the fence buried in a trench to
prevent sediment from passing under the fence.
4. The Applicant shall make every reasonable effort to keep
exposed soil covered during construction.
5. The Applicant is to make every possible effort to keep dust
controlled and to keep the streets clear of dirt and debris.
NOTE: The proposed addition to the existing structure will not place
any portion of the new construction closer to the stream than the
existing structure.
