The church was constructed prior to annexation to the City. County regulations did not require a conditional use permit at the time the use was implemented. The applicant has requested a Conditional Use Permit to allow the existing church, the proposed expansion, and unidentified future expansions. The applicant has requested approval of the possible T unidentified future expansions with the understanding that all changes to the site development must be approved by the Architectural Design Board (ADB). The proposal requires approval by the Architectural ADB and approval of a Conditional Use Permit. The applicant has requested combined hearings. The ADB has held a public meeting where a recommendation for approval was made (see Exhibit A, Attachments 3 through 5). 'earing Examiner Decision Case No. CUP 9746 Page 2 PUBLIC BEARING: j After reviewing the official file which included the Planning Division Staff Advisory Report; and after visiting the site, the Hearing Examiner conducted a public hearing on the application. The hearing on the application was opened at 9:00 a.m., June 5, 1997, in the Community Services Conference Room, 250 5s' Ave. N., Edmonds, Washington, and closed at 9:13 a.m. Participants at the public hearing and the exhibits offered and entered are listed in this report. A verbatim recording of the hearing is available in the Planning Division. HEARING COMMENTS: The following is a summary of the comments offered at the public hearing. From the City: John Bissell reviewed the staff report and recommended partial approval with conditions: From the Applicant: Pastor Phil Assink felt the staff report is supportive and hoped there would be a good working relationship with the City. He also hoped there would be some latitude so that minor modifications would not need to go through another CUP hearing. From the Community: No one from the general public spoke at the public hearing. Response from the City: John Bissell said the code is silent regarding minor modifications, however, minor modifications could be allowed without ADB review, and staff had no objections to allowing minor modifications with staff review, but with no CUP hearing. FINDINGS OF FACT AND CONCLUSIONS A. SITE DESCRIPTION 1. Site Development, Neighboring Development, And Zoning: a. Facts: 1) Size: The subject property "T" shaped with 64,644 square feet and 144 lineal feet of street frontage (see Exhibit A, Attachments l & 4). 2) Land Use: The property is currently developed with a church. 3) Zoning: The zoning of the subject property is Single -Family Residential (RS-8) (see Exhibit A, Attachment 1). 4) Terrain and Vegetation: The subject property is nearly flat. y .. :':u,. w13�u3+Swi$ �iwi�Y2.eLu�itdlt2.:4o z j UJI L< U � 71 o., U- 01 U) u,; J C/) � UJ o_ Na It z l�- F- 001 w ua TW c v, u- ZI LU o z U C tIearing Examiner Decision Case No. CUP 97-16 Page 4 that the proposed use will meet all the applicable requirements of the Zoning Ordinance. o Not Detrimental - That the use, as approved or conditionally approved, will not be significantly detrimental to the public health, safety and welfare, and to nearby private property or improvements unless the use is a public necessity. • Transferability - The Hearing Examiner shall determine whether the conditional use permit shall run with the land or shall be personal. 2) The City of Edmonds Comprehensive Plan Residential Development Policy B.S. states "Protect residential areas from incompatible land uses through the careful control of other types of development and expansion based upon the following principles: a) Residential privacy is a fundamental protection to be upheld by local government. b) Traffic not directly accessing residences in a neighborhood must be discouraged. c) :Stable property values must not be threatened by view, traffic or land use encroachments. d) Private property must be protected from adverse environmental impacts of development including noise, drainage, traffic, slides, etc." 3) The Comprehensive Plan designates the subject property "Single Family." 4) The proposed expansion would not protrude beyond existing development to the north or south. 5) Future development must be approved by the ADB. The ADB may only grant approval of a proposal if the proposal is found to be in compliance with the aforementioned comprehensive plan sections. 6) ECDC 16.20.010 allows churches as a permitted primary use on arterial and collectors in the R-8 zone subject to a conditional use permit. 7) The subject property is located on 238th Street Southwest and was annexed into the City of Edmonds after the most recent comprehensive plan amendment. The Comprehensive Transportation Plan did not evaluate areas outside the City. Therefore, 238th Street Southwest is not designated. 8) 238th Street Southwest is one of three access points from an arterial to a large section of the City. Therefore 238th Street Southwest functions as a collector. The deadline for appeals was May 14, 1997. 3) No appeals of the Determination of Nonsignificance were received. b. Conclusion: The applicant and the City have complied with the requirements of the State Environmental Policy Act: 4. Compliance with ECDC Chapter 20.15B (Critical Areas) a. Facts: 1) The applicants submitted a Critical Areas Checklist and received a Determination as required prior to the issuance of any permit. 2) The Critical Areas Determination indicated that no further Critical Area studies would be required to develop these lots. b. Any person wishing to file or respond to a recommendation or appeal should contact the Planning Department for further procedural information. REQUEST FOR RECONSIDERATION Section 20.100.010.G allows for the Hearing Examiner to reconsider his decision or recommendation if a written request is filed within ten (10) working days of the date of the initial decision by any person who attends the public hearing and signs the attendance register and/or presents testimony or by any person holding an ownership interest in a tract of land which is the subject of such decision or recommendation. The reconsideration request must cite O specific references to the findings and/or the criteria contained in the ordinances governing the type of application being reviewed. APPEALS OF CONDITIONAL USE PERMITS Section 20.105.020.A & B describe how appeals of a Hearing Examiner decision or recommendation shall be made. Introduction: The subject property is currently developed with a church which was constructed ® while the property was located in unincorporated of Snohomish County. t) y; Recently the subject property was annexed into the City of Edmonds. Pursuant o � to City of Edmonds Regulations churches in the RS-8 zone district require a = v conditional use permit. The applicant is proposing to add a 15 foot by 15 foot entry to the east side of the building to accommodate a new elevator. `U Since this applicant has requested to combine the required hearings, the ADB v ai will not hold a hearing. Rather the ADB will hold a public meeting and will z~` make a recommendation to the Hearing Examiner. D. Background: 1. Zoning: The port property is zoned Residential, Single family, 8,000 square foot minimum lot size (RS-8). `` 1 2. Environmental Review: The proposal requires a SEPA review. The applicant has submitted an environmental checklist and the City has issued a determination of nonsignificance. The appeal period for the SEPA determination will not expire prior to this ADB meeting. The SEPA determination must be complete, including the appeal period, prior 0 to the hearing to be held by the Hearing Examiner. 3. Issues: Design of the site, and landscaping have all been addressed by the applicant in their proposal, and the Architectural Design Board must determine the appropriateness of the proposal. j E. Staff Analysis: 1. Design: The existing building is a two story woad framed, building with brick and vertical wood siding, as well as flat painted wood panels above and below the existing windows. Policies from ECDC 20.10.070 that seem to apply to this project are: 20.10.070 Criteria. A. Building Design. No one architectural style is required. the building shall be, " designed to comply with the purposes of this chapter and to avoid conflict with the existing and planned character of the nearby area. All elements of building design shall form an integrated development, harmonious in scale, line and mass. He stated that, therefore, this ADB consideration is being held as a public meeting and the Board will need to make a recommendation to the Hearing Examiner for action. The existing building is two stories with brick and vertical wood siding and gable ends. The proposed addition will extend the existing roof line from the eastern gable end, keeping the existing design, and colors and materials will match the existing building. New landscaping is not being proposed since the site currently contains a large amount of native vegetation. Two sixty -watt porch lights over each of the two new doors are proposed. Mr. Bissell stated that staff is recommending approval of this application. Boardmember Sullivan asked about the property to the east of the proposed improvement to clarify whether any possible light spillage would occur from the porch lights being proposed. Judy Downing explained that there is a residence on the east side of the addition which is located farther forward on their property from where the porch lights will be placed. Phil Assink added that there is a landscaped area with native vegetation next to the driveway, and beyond that area is a carport, which is located behind the residence. He stated that there is at least 50 feet from where the porch light will be to the back porch of the house, and approximately 20 feet to the carport area. There were no audience comments on this proposal. Boardmembers all indicated that the design and materials outlined in the application were appropriate.
