Director of Public Works SUBJECT: AUTHORIZATION FOR MAYOR TO RELEASE PORTION OF UTILITY EASEMENT AT 1023. 7TH AVENUE SOUTH In 1976 the City contacted the owner of the old house at the subject location and obtained free -of -charge a utility ease- ment. The City then placed a storm sewer within the easement from the alley westerly to 7th Avenue. This was done to resolve a drainage problem and water damage to the alley. The old house is now being removed and the new owners of the property find that the easement encroaches within the area of their proposed building. The easement is 7 1/2 feet wide, whereas the zoning code allows building to within 5 feet of the property line. Since the storm sewer is within the 5-foot distance and the 2 1/2 feet remaining is surplus to the City's needs, it is recommended that the City Council authorize you to execute the necessary instrument,to be prepared by the City Attorney, for granting the north 2 1/2 feet of the ease- ment to the current owners.
