Dear Mr. Kemp,
On July 8, 1998, we mailed you a letter in reply to your July 1, 1998 letter regarding off-
street parking for the above project. Unfortunately, it appears the staff did not inform
you of the need for a Street Use permit to allow the small area of right-of-way needed to
create a legal parking space.
In order for us to sign off our portion of the permit and for you to meet the Code
- requirements for off-street parking, you will need to obtain a Street Use permit from the
Permit Coordinator. The permit requires insurance coverage and once issued, must be
renewed yearly. The application fee is $50. When the street -use permit is issued, we will
sign off the Engineering portion of the permit.
Enclosed is an application and handout for your information and action. If you have any
questions, please call Lara Knaack, Permit Coordinator at (425) 771-0220, Ext. 336.

The City is in receipt of your faxed letter dated 5/27/98. I will try to summarize the outstanding requirements for
this project per your request, however please note, the application is still incomplete.
1. A true and accurate plot plan is required (see enclosed sample and minimum detail requirements). One plot
plan should show what the property looked like before the work was started and one plot plan should be
submitted that shows what the property looks like now.
2. Per your request, a variance application form and handout is enclosed. The Planning Division regulates this
process and once a complete application is submitted the process typically takes 2 to 3 months provided no
appeals are filed. Since the covered porch was constructed without first obtaining a permit and encroaches into
the required front yard setback, a variance is one option to resolve this violation. Another option is to obtain a
$25 demolition permit and remove the covered porch. Please contact the Planning Division for specific
questions regarding the variance process and other, possible code options. Regardless, a permit (either
construction permit or demolition permit) shall be required to resolve the covered porch violation. If the
owners apply for a variance they must also submit a building permit application (see enclosed handout for
minimum permit submittal requirements). Double permit fees are assessed for all permits and discretionary
permits when work is started prior to permit issuance.
3. Enclosed is the City's handout for rockeries and retaining walls. The plot plan should show the exact location
of all retaining walls and/or rockeries and/or ecology block walls, etc. on site. Elevation views showing the
height from finished grade must also be provided for all walls.
4. I cannot provide you with outstanding Engineering requirements for the driveway, sidewalk or driveway apron
please contact Gordy Hyde, Engineering Coordinator directly at 425-771-0220 for outstanding requirements.
Typically, once a complete permit application is submitted the building permit review process for projects, minor in
nature, is 2 to 3 weeks. Until the City receives complete permit applications for all work completed without a
permit and all work proposed (i.e., work to be done to remove a violation) the City cannot create an accurate list of
what would make this site a "violation free project." I encourage you to request that the owner submit complete
applications to the City for a timely review of all applications.

concerns listed in your letter.
1. Because it is physically impossible to construct a turn -around on the site, this
requirement is waived.
2. Item number 2 will be answered by the Planning Division.
3. Due to the physical restraints of available off-street parking as shown on your
drawing, and after review of Chapter 18.95D.1.b of the Edmonds Community
Development Code, we will allow deviation of the minimum parking stall depth from
the code requirement of 1.6'-6" to 16'-0".
With regard to the remaining plan review comments, a right -or -way pennit will be
required to construct the driveway approach, curb and gutter and sidewalk. In addition,
we need to know how the drainage behind the wall will be handled and where it will
drain. Drainage from the house shall be accomplished with gutter/downspouts and
splashblocks.
Please revise your drawing to reflect the above requirements and resubmit two copies to
the Permit Coordinator. If you have any questions, please call Lyle Chrisman at 425-

Due to the non -conforming lot situation that exists at the above address, We request
relief from some city codes and requirements. The lost size is only 2400 square feet
and the home was built probably in the 1950's.
1) A turnaround on the property is impossible to attain.
2) The front yard setback requirement is not being encroached
anymore than what existed previously with the - chimney and
old porch roof that have both been removed and want to be
replaced with an equal 30" roof over a new front door.
3) As some work has already been done here with the relocation
of the retaining wall to create an off-street parking space, we
would like relief from the 16' 6" minimum length rule to 16' 0"
and are willing to put a Notice on Title to reflect a restriction
that would only allow compact cars to be parked there if needed.
These are -not major issues and are only an improvement to the property and
neighborhood. Many homes nearby encroach closer to the street than this one
does. We would like to resolve this issue as quickly and easily as we can and are
even willing to put in a new sidewalk (per city requirements) for the full length of
the property as none exists now.
