From the City: Kirk Vinish, AICP, Project Planner, presented the staff report which recommended denial. He noted that they did not feel that the application met the criteria for the B & B and home occupation to conduct weddings. They did not feel that the number of parking spaces was adequate and that the measures taken to accommodate the parking were not consistent with the single family area. In addition, the Park Department had expressed concern about the potential use of parking spaces adjacent to the City Park next door. In response to a question from the Hearing Examiner, Mr. Vinish indicated that there would be no Conditional Use Permit required for a one bedroom B & B. He also indicated the Parks Department was concerned that noise from the ballfields at the park would conflict with weddings, if approved. Staff provided copies of the complaint forms (Exhibits D & E). From the Applicant: r JoAnn and Bill Morton testified that they had lived there for 10 years and recently remodeled to add space to the house. They noted that they have a one bedroom B & B and that they can provide 14 cars on their property at times when they conduct weddings. They were not aware of the neighbors complaints until the complaints were filed and they were concerned that they could not get the names of the people who concerned so they could talk to them. They provided eight photographs (Exhibit B) showing parking in the area. They indicated that Edmonds Landscaping down the street has employees and trucks which also park on the street. In response to the neighbor's comments the Mortons indicated that they were surprised by the neighbor's reactions. That when concern had been expressed about their sign, they had removed it. From the Community: Kerstin Ragde, 1029 A Avenue, noted that they are across the street facing the Mortons and expressed concern about the amount of parking and the noise of weddings. She indicated that she has no concern about the B & B. She provided a photograph of the parking along the street (Exhibit Q. n Joe Camden, 1021 A Avenue, also lives across from the Morton and indicated he has no i problem with the B & B; however he is very concerned about a business generating lots of people coming into the neighborhood. He feels it will decrease the quality of life. He chose the area because it is a dead end street and they have the park across the street. ' =r ' . SITE DESCRIPTION 1. Site Development And Zoning: a. Facts: 1) Size: The subject property is approximately'7,500 square feet and is rectangular in shape; with property dimensions of approximately 60-feet in width by 125-feet in depth (see Exhibit A, Attachment 3). 2) Land Use: The subject property is currently developed with a detached single- family residence. 3) Zoning: The subject property is located in a single family residential zone (RS-6) (see Exhibit A, Attachment 1). 4) Terrain and Vegetation: The property is generally flat and sloping downward toward the western property line. The property is landscaped with lawn and shrubs. 2. Neighboring Development And Zoning: a. Facts: 1) The site is located in a single family residential zone,(RS-6). 2) The lots neighboring the subject property are zoned RS-6 and developed with single-family residences and P and developed with a City Park (see Exhibit A, Attachment 1). B. HISTORY s 1. In June 1996 the City received two written complaints regarding a sign and business at i the subject property (see Exhibits D & E). 2. On June 6 and 14 Meg Gruwell, the City Code Enforcement Officer sent letters to Mr. and Mrs. Morton informing them that they would need to obtain a Conditional Use © Permit in order to legally operate their business. 3. On October 15, 1996 Mr. Morton applied for a Conditional Use Permit to conduct small in -home weddings. C. EDMONDS COMMUNITY DEVELOPMENT CODE (ECDC) COMPLIANCE 0 1. Compliance with Residential Single -Family Zoning Standards a. Fact: ECDC Section 16.20.010132 allows home occupations in single family residential zones if a Conditional Use Permit is obtained and the home occupation meets the requirements of Chapter 20.20. b. Facts: ECDC Section 20.20.010B sets forth the following criteria for review of home occupations: 1) The home occupation must not harm, the character of the surrounding neighborhood. 2) Animals associated with the home occupation must comply with the animal control regulations set forth in Edmonds Municipal Code Chapter 5.05, and ECDC Title 16. 3) The home occupation must not include storage, display of goods, building materials and/or the operation of building machinery commercial vehicles or other tools, unless it is completely enclosed within a structure; does not emit noise, odor or heat; and does not create glare or emit light from the site in violation of the code. 4) The home occupation must not create a condition which injures or endangers the comfort, or pose health or safety threats of persons on abutting properties or streets. 5) The home occupation must not generate traffic from outside of the neighborhood nor excessive intra-neighborhood traffic, or necessitate excessive parking beyond that normally associated with a residential use. b. Conclusions: 1) The home occupation appears to harm the character of the neighborhood by bringing traffic to the neighborhood which would not normally be there. The applicant states that "Bed & Breakfast" customers will visit the site throughout out the year and weddings will bring individuals to the site at least 8 times a year. The applicant has also stated he will not exceed 35 guests per wedding, however he does not provide any supporting evidence regarding the manner in which he will restrict the number of guests. Regardless, it appears that the guests will very likely come from outside of the neighborhood. Staff has not confirmed how many vehicles related to the home occupation would visit the site each day, as the burden of persuasion lies on the applicant to show that he is within the stated purposes and criteria of ECDC Chapter 20.20. 2) There are no animals associated with the home occupation. 3) The applicant states that the `Bed and & Breakfast" and wedding business is conducted within the home and nothing is stored outside , of the structure (see Exhibit A, Attachment 3). 4) The home occupation appears to pose a health or safety threat to adjacent neighbors due to the magnitude of the parking needed by the proposed business in U OF z M) c. Fact: ECDC Section 20.20.015 states that home occupations which are prohibited are those which depend upon the sale or provision of services to persons throughout the City or the regional community rather than the neighborhood in which they reside, thereby attracting to the neighborhood, traffic beyond that generally associated with the neighborhood or intra-neighborhood traffic. Conclusion: The "Bed and & Breakfast" and wedding business depends on guests coming to the site. It appears that the traffic generated by the home occupation makes this home occupation one which is prohibited by the code. d. Fact: ECDC Section 20.20.020 states that a sign is permitted in conjunction with the home occupation if it is no larger than three square feet and contains only the name and address of the resident. Conclusion: The applicant anticipates signage for the business to be in compliance with the code requirements, therefore this portion of the code would be complied with. 3. Compliance with Parking Requirements a. Facts: 1) The applicant shows on his plans the following: 760 square feet for indoor assembly, 500 square feet for outdoor assembly, one room for bed & breakfast and one single-family use. 2) ECDC Section 17.50.020.C.3 requires I parking space per 40 square feet of indoor places of public assembly and I parking space per 100 square feet of outdoor assembly use. Additionally, ECDC Section 17.50.020.A.3 requires 1 space per room for boarding house use and finally ECDC Section 17.50.020.A. requires I space per single-family dwelling. 3) The applicant has stated that they will have at least 14 parking spaces available for customers. However, the Engineering division has determined that there are only 4 legal parking spaces on -site. The applicant may not use off -site street parking as part of his required parking. Any new parking created on -site must be paved. b. Conclusions: 1) The applicant is required by ECDC Section 17 to provide 19 parking spaces for indoor assembly, 5 spaces for outdoor assembly, one space for the "Bed & Breakfast" and one space for the single-family residence. The total number of required parking spaces is 26. 2) The Engineering Division has determined that there are 4legal parking spaces on - site. M 1. a. Fact: The subject property is designated as "Single Family Large Lot". b. Conclusion: The proposed development is consistent with the existing Comprehensive Plan Land Use designation for the site. 2. a. Facts: The Comprehensive Plan, Residential Development section, identifies goals and policies which relate to "Residential Development" in the City. Specific goals and policies are discussed in detail below. (1) Section B states as a goal of the City that: "High quality residential development which is appropriate to the diverse lifestyle of Edmonds residents should be maintained and ,promoted. The options available to the City to influence the quality of housing for all citizens should be approached realistically in balancing economic and aesthetic consideration, in accordance with the following policies: " (2) Fact: Section B.5.b states as a goal of the City that: "Traffic not directly accessing residences in a neighborhood must be discouraged." (3) Fact: Section B.5.d states as a goal of the City that: "Private property must be protected from adverse environmental impacts of development including noise, drainage, traffic, slides, etc." (4) Page 31, subsection B.5.0 states, "Stable property values must not be threatened by view, traffic, or land use encroachments. " b. Conclusion: The "Bed and & Breakfast" and wedding home occupation is not consistent with the requirements of the Comprehensive Plan and is more appropriate in a business/commercial zone than a residential zone. E. STATE ENVIRONMENTAL POLICY ACT (SEPA) 1. a. Fact: The City of Edmonds is the agency with SEPA jurisdiction. A Mitigated Determination of Nonsignificance was issued November 5, 1996. The SEPA appeal period expired November 27, 1996 and no appeals were filed. b. Conclusion: The City of Edmonds and the applicant have complied with the requirements of SEPA. F. TECHNICAL COMMITTEE 1. Fact: The proposed Conditional Use Permit has been reviewed and evaluated by other Departments/Divisions of the City (i.e. Fire Department, Public Works Division, and the Parks & Recreation Division). 2. Fact: The Parks and Recreation Department expressed concern regarding noise from the adjacent baseball fields interfering with outdoor weddings and the possibility of wedding guests parking in the Pine Street Park parking lot. 4. Fact: The Engineering Division determined that the applicant has 4 legal parking spaces on -site and neighboring properties would be impacted by insufficient parking on -site during weddings. Based on the foregoing Findings and Conclusions, the request for a Conditional Use Permit for the conducting of in -home weddings is denied. . RECOMMENDATIONS Based on Statements of Fact, Conclusions, and Attachments in this report, we recommend denial of this application. The proposed application is not in compliance with the following sections of the Edmonds Community Development Code: ECDC 15,05,000: The "Bed and & Breakfast" and wedding home occupation increases traffic in a residential area and is not consistent with the Comprehensive Plan. ECDC 20.20.000: The "Bed and & Breakfast" and wedding home occupation calls for { customer traffic to the site. ECDC ? ,2p 0.015: The `Bed and & Breakfast" and wedding home occupation depends upon travel to the site by customers from outside of the neighborhood. Insufficient parking exists on -site, even if suffi4ient parking were provided it would create a condtion that is out of character with a single family neighborhood. Guests for weddings will likely park in 1 Pine Street Park which would harm the parks ability to provide parking for park users. II. FINDINGS OF FACT AND CONCLUSIONS A. SITE DESCRIPTION 1.
