ADDENDUM TO CONDITIONAL USE PERMIT APPLICATIONRECE1V ED Klahaya Swim and Tennis Club FEB 0 5 2008 January 22, 2008 Use for Which CUP is Sought: PERMIT COUNTER The applicant seeks authorization through a CUP to make the following modifications to the existing community facility: 1. Add a lane (8' x 75') to the pool and an associated walk-in stair access and pool deck (approx. 800 sq. ft.) . 2. Replace existing wading pool and install a new separate mechanical area (code required) resulting in an increase of approx. 210 sq. ft. of deck area These improvements are being proposed in conjunction with the facility's obligation to comply with new Department of Health and further comply with ADA requirements. Due to an aging facility and recent swimming pool code requirements, the applicant must perform repairs, health & safety upgrades to the facility in order to comply with the law. It is our understanding that modifications that are necessary to comply with Department of Health and ADA regulations require a building permit, but not a CUP Background: Klahaya Swim and Tennis Club ("Klahaya") is located at 10307 238`h Street SW, in the City of Edmonds, and is zoned RS-8. Klahaya was constructed in the 1950s, under the jurisdiction of Snohomish County, and was annexed to the City of Edmonds in November 1995. Klahaya consists of approximately 106,590 square feet of land (about 2.5 acres), and provides two outdoor tennis courts, an outdoor swimming pool, a large open play field/spectator filed, an approximately 1900 square foot bathhouse with a front desk, and a large open area for parking (a portion of which is paved). Klahaya is a "local public facility" which, under the City of Edmonds Development Code ("ECDC") is a "permitted primary use requiring a conditional use permit," See ECDC 16.20.010(C); ECDC 21.55.007; Code Interpretation No. 2008-1. Klahaya obtained a Conditional Use Permit from the City (CU 96-11) in 1996 in conjunction with Klahaya's proposed construction of a 254 square foot entrance/addition at the facility. Klahaya serves about 220 families, and is a seasonal community facility, open between approximately June and October. The facility hosts up to four swim meets per year. The facility has adequate space for parking up to 32 vehicles, and only uses such space to its full extent when it hosts swim meets (four times per year). When Klahaya needs overflow parking (generally only for swim meets), Klahaya has an arrangement with a nearby church to use their parking lots. Addendum to Conditional Use Permit Application for Klahaya Page 1 of 5 Klahaya desires to add an eight -foot lane to its outdoor swimming pool, and would like to construct the additional lane in conjunction with the pool modifications that Klahaya must make in order to bring the pool into compliance with ADA and State Department of Health regulations (applicable permits are being obtained for such work which, pursuant to ECDC Chapter 17.05 and other applicable law has been determined to be authorized without the need for a CUP). The additional eight -foot lane will enable Klahaya to more efficiently hold its four annual swim meets. Currently, swim meets last for about three hours (four times per year), from 6:00 p.m. til 9:00 p.m. With the extra lane, it is likely that the duration of swim meets will be reduced. Criteria Statement: The addition of an eight -foot lane to the existing outdoor swimming pool is consistent with the City's Comprehensive Plan goals and policies, the applicable provisions of the Zoning Ordinance, and with the public health, safety and welfare. The additional lane will not materially alter the nature or intensity of the current, approved use; nor will the additional lane result in adverse impacts to nearby private property owners and improvements. The additional swimming pool lane will actually reduce impacts on adjacent land owners by likely reducing the duration of the four annual swim meets, and enhance the recreational benefits that Klahaya provides to the community. 1. The Use is Consistent with the Comprehensive Plan. Klahaya Swim and Tennis Club is located in a residential area that is governed by, and consistent with, the City's Comprehensive Plan goals and policies for Residential Development. The additional lane (like the existing use) is consistent with all of the City's Residential Development provisions, and specifically furthers goals and policies, of the Comprehensive Plan, including: State Goals I. Open space and recreation: Encourage the retention of open space and development of recreational opportunities, conserve fish and wildlife habitat, increase access to natural resource lands and water, and develop parks. Klahaya provides open space and recreational opportunities. General Goals (Growth Management) B.2. The Comprehensive Plan and its implementation measures should be developed and maintained in such a manner to guarantee that there are sufficient resources to insure established levels of community services and that ample provisions are made for necessary open space, parks and other recreation facilities. Klahaya Addendum to Conditional Use Permit Application for Klahaya Page 2 of 5 assists in furthering this goal by providing open space and recreational opportunities to the community. The additional lane is consistent with the goal. Residential Goals B. Goal. High quality residential development which is appropriate to the diverse lifestyle of Edmonds residents should be maintained and promoted. The proposed lane is consistent with the goal of serving the diverse lifestyle of Edmonds residents. B.3 Minimize encroachment on view of existing homes by new construction or additions to existing structures. Klahaya provides a large expanse of open space and enhances the view corridor of neighboring properties. The additional lane is consistent with this goal. Open Space A. Generally in urban areas a lack of open space has been one of the major causes of residential blight. This lack has contributed to the movement of people from older densely developed neighborhoods to peripheral areas still possessing open areas. Open space must be reserved now for assurance that future settled areas are relieved by significant open land, providing recreational opportunities as well as visual appeal.... The additional lane will enhance recreational opportunities and visual appeal within a relatively dense residential community. B.2. All feasible means should be used to preserve the following open spaces: .... B.2.h. Lands which would have unique suitability for future recreational uses both passive and active. Klahaya's property is uniquely suitable for recreational uses and the additional lane. 2. The Use Is Consistent with Zoning Ordinances. Klahaya Swim and Tennis Club is a local public facility that has served as a recreational amenity to the community since 1950. Like a regional park, a community park, a school or a church, Klahaya's use is a permitted use, subject to a conditional use permit. ECDC 16.20.010(C)(2). The proposed construction of an additional eight -foot lane on the outdoor swimming pool is similarly consistent with the applicable zoning. ' a. The Use Is Consistent With Residential Zoning. The use is consistent with the purposes of the Residential Zone and the RS-8 zoning district. The proposed use will meet all applicable requirements of the Zoning Codes, including those pertaining to noise and traffic. Klahaya provides such a complementary facility to the residential community, and the additional lane will enhance the facility. Similarly, in the RS zone, a specific purpose is: To provide for additional nonresidential uses which complement and are compatible with single-family dwelling use. ECDC 16.20.00O.B. Klahaya's Swim and Tennis Club directly serves these purposes of the residential classification. The Swim and Tennis Club use is consistent with the goals and purposes of the residential zone in which the facility is located, as is the addition of a lane to the swimming pool. b. The Use Is Authorized Under ECDC 17.100.050. The City's RS Zoning Ordinance specifically authorizes local public facilities such as Klahaya to exist in the RS-8 zone, provided they comply with the provisions of ECDC 17.100.050. See ECDC 16.20.010.C.2. The proposed use complies with, and can be conditioned as necessary pursuant to, the applicable provisions of ECDC 17.100.050. The additional lane, for which Klahaya is seeking the. CUP, is unlikely to result in any impacts, much less any impacts that could not be made compatible with the community through the imposition of appropriate conditions. Parking. The proposed use will not create the need for any additional parking. Klahaya meets, or can be conditioned to meet, the minimum parking requirements of ECDC 17.50.030(C). Klahaya's parking is on -site (except for swim meets) and such parking is within a natural treed area. ECDC 17.50.050(B). Lighting. The proposed use will not result in any additional lighting. Klahaya has minimal lighting, all which is arranged and directed away from adjacent residential uses. ECDC 17.50.050(C). Screening. The proposed use does not involve any screening issues. Electrical substations, pump stations, and yards, to the extent they exists are adequately screened. ECDC 17.50.050(D). Signage. The proposed use will not result in the erection of any additional signage. ECDC 17.50.050(E). Addendum to Conditional Use Permit Application for Klahaya Page 4 of 5 Hazardous Materials. The proposed use will not result in any new use of hazardous, flammable, or explosive materials. Pool cleaners and the like, already being used for pool sanitation, are properly stored, utilized, and disposed of. ECDC 17.50.050(F). 3. The Use Will Not Be Detrimental to Public Health, Safety and Welfare, Nor Will Harm Nearby Property Owners and Improvements. Klahaya's recreational community facility already has been approved and conditioned as a legal permitted use. Klahaya is seeking a CUP for the addition of an eight -foot lane to its outdoor swimming pool. This addition will reduce, rather than increase, impacts on the public and nearby property owners. The Klahaya Swim and Tennis Club is a seasonal facility, open only between approximately June and October. It is situated in a large open area, on about 2.5 acres, with a very limited portion of buildable footprint and impervious surface. The existing use, and the proposed additional lane, provide the surrounding and greater community with a recreational amenity, and with view corridors, open space, and more limited activity and impacts that would likely exist if the property were developed with single- family residences. The facility, as a whole, has been conditioned pursuant to. an earlier CUP, to be compatible with surrounding areas. The additional lane will have no adverse impacts on the public health, safety, or neighboring properties. Klahaya has been required, and will remain required, to comply with all applicable laws and ordinances. Transferability: Pursuant to ECDC 20.05.010.1), the Applicant requests confirmation that the Conditional Use Permit for the proposed use (and the use in general) runs with the land, and is not personal to the Applicant.
