we place sidewalk curb and gutter at the new home that we are
building at the above address.
There are no sidewalks on either side of this property and
any sidewalk would terminate into a sloping open ditch on the
south property line. This we believe is unsafe. Further it is
impossible to establish what the future street grades will be
should 7th ave be widened and resurfaced. We are putting in a
culvert and will make the shoulder area level. We have three
alternatives.
1. Merely widen level and gravel the. shoulder area.
2. Asphalt the widened area with no curb or gutter
3. Make a $500 set -a -side for a future sidewalk should they
be put in in the future.

SUBJECT: Seawood Homes sidewalk waiver request.
Seawood Homes has requested a waiver from the requirement for a
sidewalk at their building site at 1049 7th Ave. S.
In order for a waiver to be granted, at least one of the following must
be shown: a traffic or pedestrian hazard, a significant or long term
aesthetic detraction, or a physical impracticability due to slope,
surfacing water or other physical limitations.
The requested sidewaTk waiver does not meet the aforementioned criteria
for approval as follows:
1. Traffic or pedestrian hazard. The proposed sidewalk would not
interfere with nor impede vehicular or pedestrian traffic. As
mentioned in the request letter from Seawood Homes, there is a
ditch in the front of the property. This, however, will not
create a hazard as the Engineering Division is requiring that a
culvert be placed in this ditch, and that the ditch be covered.
2. A significant or long term aesthetic detraction. Though there are
few or no other sidewalked areas on this portion ofthis street,
this is a short street with many older houses. It likely that
there will be other houses which are removed and new houses built
in their place. At that time, other new sidewalks will be
installed and any aesthetic detraction created by only one
sidewalk on the block will no longer exist.
3. Physical Impracticability. There is no physical limitation
other than the aforementioned ditch near the front of the
property. As the Engineering Division will require a culvert to

We have applied for a building permit for the construction of
a new home at this address. We are demolishing and existing
1600sf home. We do not believe that a sidewalk should be
required for the replacement home.
There are no sidewalks on either side on the street in the
area of this lot. The yard slopes up sharply from an open
storm ditch at the front of the property. Any sidewalk would
only be in front of this residence and terminate at each
property line to an uneven surface.
We are requesting a wavier of the requirement to install a
sidewalk. If you have any questions please call.
