The Critical Areas Checklist contained on this form is to
be filled out by any person preparing a Development
Permit Application for the City of Edmonds prior to
his/her submittal of the application to the City.
The purpose of the Checklist is to enable City staff to
determine whether any potential Critical Areas are, or
may be, present on the subject property. The information
needed to complete the Checklist should be easily
available from observations of the site or data available at
City Hall (Critical areas inventories, maps, or soil
surveys).
A property owner, or his/her authorized representative,
must fill out the checklist, sign and date it, and submit it
to the City. The City will review the checklist, make a
precursory site visit, and make a determination of the
subsequent steps necessary to complete a development
permit application_
Please submit a vicinity map, along with the signed copy
of this form to assist City staff in finding and locating the
specific piece of property described on this form. In
addition, the applicant shall include other pertinent
information (e.g. site plan, topography map, etc.) or
studies in conjunction with this Checklist to assistant staff
in completing their preliminary assessment of the site.
The undersigned applicant, and his/her/its heirs, and assigns, in consideration on the processing of the application agrees

The City is in receipt of your request for waiver from sidewalk construction requirements, dated
March 24, 2008, for the Lybeck Not short plat located at 808 Daley Street. While sidewalks
are required as a condition of approval per the Sidewalk Construction Policy contained in the
adopted December 2002 update to the City of Edmonds Transportation Plan and ECDC
18.90.030, you have requested that the City review this project site and code requirements for a
determination of economic unfeasibility (Sidewalk Construction Policy 3.2.b).
As stated in your letter, there are existing steep slopes on and adjacent to the subject site. The
existing Daley Street right-of-way connecting 8th Ave N to 9th Ave N is currently undeveloped
and will likely remain as such. A walking path has been constructed through this portion of the
undeveloped right-of-way, but does not provide an ADA accessible pedestrian path to 91h Ave
N. Construction of sidewalks adjacent to the subject property would also not comply with ADA
standards without significant re -grading of the right-of-way and construction of retaining walls.
The City agrees that it would be economically unfeasible for this development to incur such
costs.
Furthermore, two other short plat developments constructed within the last 3 years and located
within the vicinity of this project were granted waivers from the requirement of sidewalk
construction. The first, located north of the subject development at 509 9th Ave N, received a
sidewalk construction waiver for that portion of the property fronting 8th Ave N. As portions of
8th Ave N have been vacated between the subject property and the closest sidewalks on 8th Ave
N no link would be provided to other existing sidewalks on 8th Ave N. The second, located west
of the subject development at 716 Daley Street, received a sidewalk construction waiver for that
porition of the property fronting Daley Street.
The City of Edmonds has determined that sidewalks will not be required as a condition of
development for the construction of the subject short plat and subsequent single family
residences at 808 Daley Street due to economic unfeasibility.

While sidewalks are required as a condition of approval per the Sidewalk Construction

the south, on the development's side of the right-of-way. The construction of curb, gutter
and sidewalks along the south side of 235th PI SW would reduce the current roadway
pavement width to approximately 14-feet. Construction of these improvements would
therefore require asphalt widening on the north side of 235th PI SW and realignment of
the existing 235th PI SW roadway. The City agrees that it would be economically
unfeasible for this development to incur such costs.
The City of Edmonds has determined that sidewalks will not be required as a condition
of development for the construction of the subject short plat and subsequent single
family residences at 10506 235" PI SW due to economic unfeasibility.
