The City has received a complaint that vehicles are unable to freely turn around in the cul-de-sac adjacent to your home. City of Edmonds staff has investigated the matter and determined that at various times of the day vehicles can't turn around safely in the cul-de-sac. Per Edmonds Community Development Code (ECDC), Chapter 8.48.190 (copy enclosed, stopping, standing or parking is prohibited upon certain roadways, including cul-de-sacs with turning radius of less than 35 feet. Since your cul-de-sac center radius is less than 35 feet, this portion of the code would apply to it. We appreciate the need to park near your home; however, this cul-de-sac must remain reasonably clear to allow autos and fire vehicles to turn around. By law, the Police Department is required to enforce this parking restriction. If complaints persist, enforcement officers will be directed to issues tickets to violators. You should also be aware that the Edmonds Community Development Code limits 'each dwelling to a maximum of five parked vehicles. Code, no person may stop, park or leave standing any vehicle, whether attended or unattended; upon any paved por- tion of a curbed street in the following manner: 1. Upon street lanes, when such action reduces the street lane width to less than 10 feet for vehicles traveling in the same direc- tion; or 2. Upon cul-de-sacs, when such action reduces the radius of the cul-de-sac to less than 35 feet. [Ord. 3104 § 1, 1996]. 8.48.200 Parking — Notice of violation. A. Whenever any -motor vehicle without an operator is found parked, standing or stopped in violation of any of the parking regulations or time limits of this title, the officer finding it shall complete a notice of parking violation and affix the same in a conspicuous place on the motor vehicle. B. The notice of parking violation shall be in a form approved by the chief of police and shall advise the operator to answer the charges against hire within seven days at a place and manner specified in the notice. The notice of parking infraction shall be filed in the traffic violations bureau no later than 48 hours after issuance. . C. If a violator of any provision of this title regulating stopping, standing or parking does not answer to the charges set forth in the notice of parking 'violation affixed to such motor vehicle within a period of seven days, the chief of police shall send to the owner of the motor vehicle to which the notice was affixed a letter informing him of the violation warning him that in the event such letter is disregarded for a period of seven days, a criminal complaint will be filed and a summons to appear or a warrant for arrest may be issued. [Ord. 2263 § 1, 1982; Ord. 2041 § 1, 1978]. 8.48.210 Failure to respond to notice of parking infraction. RCW 46.64.020 is hereby adopted by this reference as if set forth in full herein. Pursuant to such statute and this chapter, any person who has been issued a notice of parking infrac- tion and who willfully fails to respond as pro- vided in this chapter shall be guilty of a misdemeanor regardless of the disposition of the notice of parking infraction. [Ord. 2263 § 2, 1982; Ord. 2041 § 2, 1978]. 8.48.215 Parking infraction penalties. A. Any person who commits . a parking infraction shall be assessed the following civil penalty, unless otherwise provided herein: 1. All parking infractions whether on public streets or within lots, except as detailed in subparagraphs 2 and 3: $20:00; 2. Unauthorized handicapped zone park- ing: $250.00; 3. Parking in fire zone: $30.00. B. All persons who have committed a park- ing infraction and are issued a notice of infrac- tion for violations of parking infraction ordi- nances except those scheduled in subsections (A)(2) and (A)(3) of this section shall be assessed a reduced fine of $10.00 for that vio- lation if: 1. It is their first violation; and 2. The individual pays the penalty within 24 hours of the issuance of the notice of infraction. C. Repeat Violations Within One Calendar Year. 1. For persons who commit repeated parking violations within one calendar year, there shall be no opportunity for reduction and the penalty shall stand as stated in subsection A of this section regardless of when the pen- alty is paid; provided, however, that nothing (Revised 8/01) 8-16
