The hearing was conducted as a closed record appeal. The record consists of the transcript of the Hearing Examiner's decision and other materials contained in the Edmonds City Council packet concerning this issue, Item 6, on the agenda of the December 7, 1999 Council meeting. FINDINGS AND CONCLUSIONS The City Council adopts as its decision the Hearing Examiner's decision dated October 14, 1999. The Council further adopts the Findings of Fact and Conclusions of Law set forth therein, incorporating them by reference as fully as if herein set forth. DECISION The Appellant has failed to show the existence of special circumstances that. would warrant issuance of a variance in the present case. The City Council finds persuasive both the Staff s recommendation to deny the Appellant's requested variance and the Hearing Examiner's decision affirming the Staff s conclusion. I have been a 30-year resident of the Continental Apartments, 1103 Fifth Ave. South, Edmonds, in which there are 29 apartments -- most occupied by senior citizens -- and 40 parking spaces for them at the south and rear sides of the building. As you know, on most days car and truck traffic is considerable on Fifth Avenue South. Directly in front of our building on the east side of the street, there are three parking spaces for cars or usually two for trucks and vans. If the vehicle parked in the southernmost space is a van, SUV, or truck, the visual obstacle for drivers of cars leaving our driveway is great because as we enter the street we cannot see southbound traffic until it is upon us. Personally, I've had many close calls, as have others who reside in our building. As one example of the problem, one large Ford pickup truck with Arkansas license plates has been parked in front of the building for more than two weeks. Hopefully, you will give serious consideration to permanently eliminating the one and possibly two parking spaces closest to . our driveway. Thank you.
