Hill CRITICAL AREAS RECONNAISSANCE REPORT: STUDY REQUIRED (CA-2005-0119) During review and inspection of the subject site, it was found that the site may contain or be adjacent to an Erosion Hazard Area pursuant to Chapter 23.40 of the Edmonds Community Development Code (ECDC). GENERAL CRITICAL AREAS REPORT REQUIREMENTS Critical Areas Reports identify, classify and delineate any areas on or adjacent to the subject property that may qualify as critical areas. They also assess these areas and identify any potential impacts resulting from your specific development proposal. If a specific development proposal results in an alteration to a critical area the critical areas report will also contain a mitigation plan. You have the option of completing the portion of the study that classifies and delineates the critical areas and waiting until you have a specific development proposal to complete the study. You may also choose submit the entire study with your specific development application. • Please review the minimum report requirements for all types of Critical Areas which are listed in ECDC 23.40.090.D. There are additional report requirements for different types of critical areas (see below). • Note that it is important for the report to be prepared by a qualified professional as defined in the ordinance. There are options on how to complete a critical areas study and an approved list of consultants that you may choose from. The sewer runs across the front yard to the south, into a private drive. It is located just above manhole #208 B-8. South County plumbing had dug up and replaced approximately four (4) feet of pipe'in the yard. I didn't see that section. Fifteen (15) feet from the main line, to the north, there was a crack in the pipe. The contractor cut approximately four (4) feet out of that lateral toward the main and the line was still plugged. He ran a snake down the line and it was unable to pass through. We recommended to him and the home owner to dig it up and repair. On January 7th, 1998, we stopped by at 9:30 am to watch the contractor. The ground all around the pipe area was full of sewage and worms. The home owner at 1120 Olympic Avenue told us that 1 1/2 years ago Mid -Mountain Construction had put new water, phone, cable, and gas services up the road. The plumber had hand dug around all the services and right under the services was the broken and pushed down lateral. It was packed full of crushed rock, which was used in the backfill material. It is our opinion that this lateral was crushed and pushed down during construction of the new utilities. The repair involved a side sewer serving Mrs. Hull who lives directly to the north of this easement. The work was observed by Tim and Chad of the Edmonds Public Works crew and undertaken by South County Plumbing. I am a resident on the private easement and am a friend of Mrs. Hull. I have taken care of her on many occasions and, particularly in this case, intervened to take responsibility to make certain that her sewer repair occurred as quickly as possible. She is 97 years old and a great lady who understandably needs some help on occasion. I became involved when she asked me to informally oversee the plumbers she had asked to resolve her sewer blockage. After several exploratory attempts over several days, South County finally determined that the blockage was at the point of intersection with the City main and her lateral. It was apparent to both South County Plumbing and the City inspectors who viewed the excavation for several hours that Mrs. Hull's lateral line had been dislocated by a utility trench that Mid -Mountain contractors had dug to place utilities to my home at 1120 Olympic as well as to install replacement water lines for my neighbors along the easement. Mid -Mountain was called by me to view that excavation at the suggestion of both the City and the plumber. Mid -Mountain took pictures as did the City staff. Upon hearing that Mid -Mountain was disputing the cause of the line dislocation, South County Plumbing indicated that they would do no further work until someone would assume responsibility for the extensive additional work that would have to commence to restore Mrs. Hull's sewer connection. After talking extensively with the City staff, reviewing their had written findings and getting their verbal assurance that the problem was caused by Mid -Mountain, I agreed to take responsibility for the cost of repairs. Mrs. Hull needed her sewer and my house construction, (Mid -Mountain's activity) apparently, according to both the City and South County Plumbing, was the cause of the dislocation. It is also apparent that neither Mrs. Hull nor I should bear the costs of this repair. Rather, Mid -Mountain would seem to have to take ultimate responsibility. I realize that I will have to take initial responsibility for South County's costs (approximately $6000.00). However, I would hope that I would have the City's full support when I have to collect from Mid -Mountain. I received verbal assurance that this support would be given to me at the time I agreed to step in and take responsibility. In that regard, I will need to have access to the City records pertaining to this matter. This records should minimally include the field notes and written report of Tim and Chad, together with the field pictures they took and any other relevant information. I have not been billed yet by South County Plumbing since the final road repair has not yet occurred. However, I would like to obtain the record as soon as possible to prepare my claim against Mid -Mountain. I would hope that the City would be proactively supportive of my efforts and not, having concluded that the City is not libel, simply fiustrate my efforts to pursue my claim with Mid -Mountain.
