We are writing regarding stormwater damage to our property due to an undersized City storm drain
pipe which is failing. We believe the city bears responsibility for the repair and maintenance of this pipe
and storm drain easement, as we will describe here.
Briefly, in the early 1960's, Gordon Henrikson wished to develop what was then called Maplewood
Village No. 1, on 12th Avenue. He obtained an easement from the Nelsons, owners of the property below
his development, "...for the installation, operation and maintenance of a storm drain over, across,
through and below the following described property, ..." Please see attached this document,
AF#1495750, which describes our property and the easement (currently noted on City maps.)
Then in January of 1992 Mr. Henrikson relinquished the easement and granted it to the City of Edmonds,
"... in consideration of the mutual benefits to be derived from the maintenance of said easement by the
City of Edmonds for and on behalf of the public..." Please see the attached document, AF#9204160429.
We believe this contract binds the City to the continued maintenance of this easement. We have
appreciated the maintenance performed to date. This culvert is on the routine surveillance list and has
been cleared by the Vactor crews approximately 8 times over the past 5-6 years, including 3 times in the
last 2 months. However, due to the recent spate of high water events, more damage has occurred in the
past 3 months and further maintenance is required.
Last Wednesday, October 9th, we invited the City and a DFW biologist, Jamie Bails, to review the recent
damage. Jennifer Lambert, Jeri Machuga, Mike Johnson and others were kind enough to tour the
easement, including 2 sections of the storm pipe that have failed due to erosion and surcharging of this
undersized 12 inch pipe. Previously, the City acknowledged the shortcomings of this drainage system.
"This stream receives stormwater runoff from an area of at least 16 acres, encompassing 40+ lots and
City right -of way that were developed largely before stormwater management was required." Please see
this attached document from the City of Edmonds from April of 2013, written during the hearing process
concerning the previous owners' wish to build a home on this land. The undersized nature of this pipe
and the lower culvert have since been confirmed independently by 2 civil engineers, a senior project
ecologist and the State biologist with whom we have consulted.
Substantial downstream damage is a direct result of the erosion and deterioration of the watercourse
due to this failed pipe and is threatening our properties downstream. You can get further details of the
serious nature of this damage from your City staff who were present.
We appreciate the City accepting responsibility for repairing the damage from this storm pipe and look

Dear Mr. Olbrechts,
The Hearing Examiner's Order on Reconsideration issued on April 16, 2013 regarding Tom and Lin
Hillman's variance application (File No. PLN20120033) allowed for all parties of record to submit
written comments by 5:00 p.m. on April 22, 2013. Comments were received from five parties and
were sent to the Hearing Examiner via email on April 22, 2013. The comments sent to the Hearing
Examiner include the following:

As allowed for by the Hearing Examiner's Order on Reconsideration, the City and applicant may
respond to the above comments by 5:00 p.m. on April 23, 2013. In response to the comments raised,
the City would like to offer the following.
With regards to stormwater flows at the subject site, the City has relied on the statements and
documentation of a licensed professional Wetland Ecologist. As provided in Attachment 8 of the
City's Report and Recommendations to the Hearing Examiner dated March 7, 2013, the Wetland
Ecologist has indicated that stormwater from the subject site flows to the northwest culvert. It is the
applicants responsibility to show compliance with stormwater codes with a city -prescribed design
that attempts to match the post -development stormwater runoff rates with the pre -development
stormwater runoff rates from the property up to the 10-year, 24-hour storm event only. As stated by
the Wetland Ecologist and the neighbors, during heavy rain events the stream may overflow along
the west property line and outfall via the southwest culvert. As the culvert is only used as an
overflow outlet in both pre and post development conditions, there is no approval needed by the
owners of 1111 Sierra Pl.
City Engineering staff wishes to reiterate that monitoring of the proposed site stormwater
management system to verify that it fully prevents any increase in stormwater discharges to

neighboring properties is problematic. Flow onto the Hillman property in part comes from the City's
storm system that discharges into the stream. This stream receives stormwater runoff from an area of
at least 16 acres, encompassing 40+ lots and City right-of-way that were developed largely before
stormwater management was required. In addition, the site is also subject to groundwater seepage
from the surrounding upstream area and surface runoff from adjacent parcels, which may influence
the surface water flows that come off the Hillman property.
In closing, Planning and Engineering Division staff confirms its position made in the City's April 8,
2013 request for reconsideration and respectfully requests that the Hearing Examiner
reconsider/clarify the findings and conclusions of the decision on the Hillman variance request in
addition to Conditions #1 and #2 and add clarification of the City's appeal procedures.

Attached please find the executive summary of the meeting we had on November 151", 2013. In it we
summarize the mutual agreements and commitments as we understand them. If you would like to make
any changes please let me know by November 25t", the day prior to our site visit with Jamie Bails and
Bob Bernard from WDFW. Otherwise we'll assume you concur with the points in this summary.
We're appreciative of your time and efforts in this matter and are very optimistic as we move forward
together to resolve these drainage problems.
EXECUTIVE SUMMARY

The above representatives of the City and the Sierra Place properties met to discuss the storm water
erosion problems at 1142 Vista Place (Schroeder), 1135 and 1139 Sierra Place (Brown) and 1111 Sierra
Place (Hachler). There was mutual agreement on the following:
1. The causes of the problem — a failing 12 inch circa 1962 concrete the storm pipe from 12th
Ave., unable to convey high stormwater flow, is eroding back into the hill. The high pressure
flow during high storm water flows is scouring the bed and incising the stream bank, moving
sediment downstream, occasionally obstructing the downstream 12 inch culvert and
requiring maintenance by the city's Vactor crews. This sediment is also being deposited on
the 1111 Sierra property, changing the direction of stream flow and endangering the home
on the property.
2. The legal definitions of the various easements — the uppermost easement (Maplewood
Village #1) is an easement managed by the City. The pipe outfall section is a private
easement on 1142 Vista Place property, for which the city has acknowledged responsibility.
The middle and lower portions are a public maintenance easement assigned to the City in
1992. It was noted that the lower storm drain easement did not accurately describe the
location of the 12 inch culvert and portions of the stream within the lower easement. While
the main body of the 12 inch culvert is within this easement, the entrance to this culvert is
outside the easement.
3. The general nature of the needed repairs — restore the 2 failed pipe sections and install an
energy dissipation system at the outfall; slow the stream flow with log check dams (shown
on the Lider Engineering preliminary drawing dated 11/14/13, distributed at the meeting) to
reduce bank incising and sediment flow; shore up the bank in several locations in the middle
stream section; and, further evaluate what repairs are needed in the lower section to
protect the house on 1111 Sierra Place. Upsizing the storm drains is not a viable option.
The following commitments were made:
1. The City will video inspect the storm drainpipe from Maplewood Village #1, then perform
and fund the necessary repairs to the upper pipe outfall and construct an energy dissipater
on the Schroeder property at 1142 Vista Place.
2. Steve Schroeder will grant a temporary construction access easement to the City on 1142
Vista for necessary supplies and equipment needed for said repairs with steps taken to
mitigate damage to the property.
3. The property owners and the City will serve as co -applicants for any necessary SEPA or HPA
permits.
4. Jerry Schuster will explore the option of performing the necessary outflow pipe repairs
under the City's maintenance HPA agreement.
5. The City will pursue transferring the storm drain easement on 1142 Vista to the City.
6. The City will send delegates to meet on -site with the WDFW biologist and engineer on
November 26 at 10:00 AM.
7. The property owners will obtain competitive bids for the repair work on the middle and
lower sections and engage a company to perform the repairs. The property owners and City
will equally split the cost of repairs to the middle and lower section if the total cost is equal
to or less than $10,000. If the cost is higher, further negotiations will occur.

Coordination of the location of any structure with respect to
utilities, streets, property lines and driveway grades is the
responsibility of the contractor.
(2) The contractor is required to keep the abutting streets clean-
