Dear Mr. Clouston:
The revised checklist which you submitted for this project does not
provide enough information nor adequately address the areas of
concern. It will be necessary for you to provide more detailed
information in order for us to complete review of this project and
issue a declaration on the environmental impact. Since we are unable
to assess the project with the current information, it will be
necessary for us to reschedule your hearing.

This determination of nonsignificance is subject to the following
conditions:
1. All excavation and grading shall comply with Chapter 70 of the
Uniform Building Code, 1985 edition.
2. The Applicant shall submit an erosion control plan for review and
approval of the City Engineer.
3. The Applicant shall be responsible for keeping all streets clean
and free of debris.
4. All grading work shall be done during normal working hours of the
City of Edmonds, 8 a.m. to 5 p.m., Monday to Friday.
5. The Applicant shall obtain a grading permit from the Building
Department and comply with all conditions of permit approval. As
part of that permit, the Applicant shall submit a soils report,
prepared by a licensed engineer, for review and approval by the
Building Official.
6. The Applicant shall submit a truck route plan to the City Engineer
for approval prior to any removal of excavated material.

Dear Mr. Bowman:
This letter is in response to your request for our comments on the Proposed
Mitigated Determination of Non -Significance regarding the excavation and
grading of approximately 2,500 cubic yards of material in conjunction with the
development of a six unit apartment building. The site is located in the
northwest quadrant of the SR 104/5th Avenue South intersection.
We agree with all the proposed "Conditions of Mitigation" for the above project.
Since the subject property is located within the Edmonds City Limits, it is the
City's responsibility to ensure that access to and from the site is designed
properly. However, no direct access from the site to SR 104 will be permitted
since this portion of SR 104 is a limited access facility.

IV. STAFF FINDINGS AND CONCLUSIONS
A. Description of the Subject Property and Surrounding Area
The subject property is located along the west side of 5th
Ave. S. and SR 104. It is a triangular shaped lot
containing approximately 12,436 sq. ft. of land area.
The site is presently undeveloped. The lot is relatively
level along 5th Ave. S. but then slopes steeply to the
west. The Applicant intends to excavate approximately
2,500 cubic yards of earth to construct a six unit
apartment building. A variance was granted to reduce the
required street setback from SR 104 to 51.
Surrounding development is primarily multifamily
residential.

C. Zoning Ordinance
The subject property, as well as the surrounding area, is
zoned RM-1.5. To the west is RS-6 zoning.
The requested conditional use permit does not appear to
conflict with the purposes of the Zoning Ordinance or the
RM-1.5 zone.
D. Comprehensive Plan
The subject property and surrounding area is designated as
a High Density Residential
The proposed conditional use permit does not appear to
conflict with the purposes of the Comprehensive Plan. The
grading is limited to the building pad and parking lot.
E. Not Detrimental
The proposed use should not be significantly detrimental to
the public nor to nearby private property or improvements.
A mitigated declaration of nonsignificance has been issued
on this project.
F. Transferability
The permit should not be transferable.
V. STAFF RECOMMENDATION:
Staff recommends approval of CU-30-86, subject to the following
conditions:
1. All excavation and grading shall comply with Chapter 70 of the
uniform Building Code.
2. The Applicant shall submit an erosion control plan for review
and approval by the City Engineer prior to issuance of grading
permit.
3. The Applicant shall obtain a grading permit from the Building
Department and comply with all conditions of permit approval.
As part of that permit, the Applicant shall submit a soils
report, prepared by a licensed engineer, for review and
approval of the Building Official.
4. The Applicant shall submit a truck route plan to the City
Engineer for approval prior to removal of excavated material.

5. The Applicant shall be responsible for keeping all streets

clean and free of debris.
6. All grading work shall be done during normal working hours of
the City of Edmonds, 8 a.m. to 5 p.m., Monday to Friday.
7. The Applicant shall be responsible for providing verification
of the total amount of excavated material prior to
finalization of the grading permit.

DECISION: The conditional use permit is granted
subject to the conditions listed.
INTRODUCTION
Hajo Corporation, 22415 Woodway Park Road, Edmonds, Washington,
98020, and hereinafter referred to as Applicant, has requested
approval of a conditional use permit for grading of approximately
2,500 cubic yards of earth material at 1140 - 5th Avenue South,
Edmonds, Washington. The subject property is more particularly
described as:
That portion of Lot 9, Block 1, South Park
Addition to Edmonds, according to the plat
thereof recorded in Vol. 8 of plats on page
13, Records of Snohomish County, WA., lying
easterly of S.R. 104.
A hearing on the request was held before the Hearing Examiner
of the City of Edmonds on September 18, 1986.

After due consideration of the evidence presented by the Applicant;
evidence elicited during the public hearing; and, as a result of
the personal inspection of the subject property and surrounding
areas by the Hearing Examiner, the following Findings of Fact and
Conclusions constitute the basis of the decision of the Hearing
Examiner.
FINDINGS OF FACT
1.
The Applicant has requested approval of a conditional use
permit to allow the grading of approximately 2,500 cubic
yards of fill on property located at 1140 - 5th Avenue South,
Edmonds, Washington. The requested grading is sought in con-
junction with the development of a six -unit apartment build-
ing on the subject property. (Staff'Report and Bowman testi-
mony.)

The subject property is.located west of 5th Avenue South and
State Route 104. The property is a triangular shape and has
12,436 square feet of land. (Staff report.)
3.
The subject property is undeveloped. It has a level section
that is located near 5th Avenue South. However, west of the
level section there are steep slopes. The Applicant has been
granted a variance from the required street setback from State
Route 104 for the purpose of developing the site on the level
portion of the property. (Bowman testimony.)
4.
Section 18.40.030 of the Edmonds Community Development Code
(ECDC) requires that no person shall perform any grading
involving more than 500 cubic yards on any lot, or contiguous
lots, without first obtaining'a conditional use permit.
(ECDC.)
5.
In order for a conditional use permit to be granted within
the City of Edmonds the criteria as set forth in Section
20.05.010 of the ECDC must be satisfied., These criteria
include:
A. The proposed use must be consistent with the Comprehensive
Plan of the City of Edmonds;
B. The proposed use in its location must be consistent with
the purposes of the zoning ordinance in which the pro-
perty is located;
C. The proposed use must not be significantly detrimental
to the public health, safety or welfare, nor injurious
to nearby private properties or improvements; and,
D. The Hearing Examiner shall determine whether the condi-

tional use permit shall run with the land or shall be
personal.
(ECDC. )
6. Policies on grading within the City of Edmonds are established
in Section 15.15.000 of the ECDC and more specifically Section
15.15.020. The Planning Department of the City of Edmonds sub-
mitted that upon review the proposed grading will be consistent
with these sections of the Code. (Bowman testimony.)
7. The subject property is zoned RM-1:5. The requested conditional
use permit is.not in conflict with the purposes of the zoning
ordinance or the purpose of the RM-1.5 zone. (Staff report.)
8. The proposed excavation will occur on the flat portion of the
subject property where the building is to be constructed. The
excavation will allow the Applicant to develop a basement for
the six -unit apartment building. (Clouston testimony.)
9. The Applicant submitted that it is their intent to conduct all
grading activities and storage of any materials and equipment
on site. No storage of equipment or materials will occur on
any of the properties adjoining the subject property. (Clouston
testimony.)
10. A witness (Franz) testified to be the President of the Seaview
Condo Building Association which is located adjacent to the
subject property to the north. The witness requested that no
trucks be allowed to be parked on the Seaview Condo parking
area. (Franz testimony.)
11. The proposed use will not be detrimental to the public, nor
to nearby private properties or improvements. (Staff report.)
12. A mitigated declaration of nonsignificance has been issued for
the proposed project. (Staff report.)
13. The Planning Department of the City of Edmonds has requested
that the grading permit and the conditional use permit not be
transferable.
14. The Planning Department of the City of Edmonds has recommended
approval of the conditional use permit subject to conditions
as set forth in the Staff Report which was admitted as Exhibit 1
to this hearing.
CONCLUSIONS
1. The application is for the approval of a conditional use permit
for the allowance of grading of approximately 2,500 cubic yards
of earth material on property located at 1140 - 5th Avenue South,
Edmonds, Washington.

2. In order for a conditional use permit to be granted within the
City of Edmonds the criteria as set forth in Section 20.05.010
of the ECDC must*be satisfied. With conditions the application
satisfies these criteria.
3. The requested conditional use permit is consistent with the
RM-1.5 zoning designation and the purposes of this zone.
4. With conditions the requested conditional use permit is not
in conflict with the purposes of the Comprehensive Plan.
5. With conditions the requested conditional use permit will not
be detrimental to the public, nor to nearby private properties
or improvements.
6. The conditional use permit shall not be transferable.

Based upon the preceding Findings of Fact and Conclusions; the
testimony and evidencesubmitted at the public hearing; and, upon
the impressions of the Hearing Examiner at a site view, it is here-
by ordered that the conditional use permit (CU-33-86) be granted.
The specific request granted is for the allowance of grading of
approximately 2,500 cubic yards of earth material on property
located at 1140 - 5th Avenue South, Edmonds, Washington. The
conditional use permit is granted subject to the following
conditions:
1. The conditional use permit shall not be transferable.
2. All excavation and grading shall comply with Chapter 70 of
the Uniform Building Code.
3. The Applicant shall submit an erosion control plan for review
and approval by the City Engineer prior to the issuance of
a grading permit.
4. All grading must be consistent with the approved erosion
control plan.
5. The Applicant must comply with construction time limits and
retrictions as established in the approved erosion control
plan.
6. The Applicant must comply with any reclamation requirements
as established in the erosion control plan.
7. The Applicant shall obtain a grading permit from the Building
Department aqd comply with all conditions of permit approval.
As part of the permit, the Applicant shall submit a soils
report, prepared by a licensed engineer, for review and
approval by the Building official.

8. The Applicant shall submit a truck route plan to the City
Engineer for approval prior to the removal of any excavated
material.
9. The Applicant shall be responsible for maintaining clean
streets in the City of Edmonds that are free from dirt
or debris from the material to be excavated. If the City
is required to conduct any cleanup of the streets because
of the Applicants activities, the Applicant shall be
responsible for the said costs.
10., All grading work'shall be done during normal working hours
of the City of Edmonds, 8 a.m. to 5 p.m.,,Monday through
Friday..
11. The Applicant shall be responsible for providing verification
of the total amount of excavated material prior to finali-
zation of the grading permit. If the Applicant exceeds the
grading amount of 2,500 cubic yards of material, he must
seek a modification of this permit.
12. The Applicant is restricted from parking any of his vehicles
or storing any of the material on any of the property owned
by the Seaview Condo, which -is directly north of the subject
property.

Dear Mr. Jones:
At your request, we have visited the above referenced site and
reviewed the supplied drawings .(Development Plan!, Pages 1 and 2) to
determine the impact of the proposed drainage system on the
proposed rockery wall.
The above referenced site is located on the west side of 5th Ave.
S., just north of the SR 104 underpass. A fairly level cut and
fill pad extends out into the site from 5th Ave. S. The northern
and western portions of the lot appear to be at or near original
grades. These areas slope slightly to moderately in a westerly
direction.
The supplied drawings showed a rockery wall, approximately four (4)
feet high, being placed over the parking lot area storm water
infiltration system. Minimum depths for the storm water
i"'filtration system were not given. The rockery wall is being used
to retain fill placed in the parking lot area.
Materials excavated from percolation test holes were viewed and
classified in the field. In general, these exposed soils consisted
of fine - to coarse -grained sands with varying amounts of gravels.
The materials appeared to be fairly uniform in the area of the
proposed drainage system. The relative depths of the sands is
unknown, but from conversations with Mr. Bob Jones of Lovell-
Sauerland, they are at least ten (10) feet deep. The measured
percolation rate was 3 minutes/inch.

Based upon our review of the supplied drawings and the observa-
tions made during our site visit, we believe there is a potential
impact on the stability of the rockery from the placement of the
infiltration system. However, the probability of the rockery being
impacted may be greatly reduced by implementing the following
recommendations:
1. The top of the infiltration system should be placed a min-
imum of (2) feet below the base of the rockery.
Prior to finalizing any grades in the lower parking lot
area, we recommend that the parking lot infiltration
' system be installed, backfilled and brought up to minimum
grades with compacted structural fill. The structural
fill should be placed in minimum six (6) inch lifts
compacted to 95% of the ASTM D-1557 maximum density
proctor value. On site sands free of deleterious
materials will be suitable for use as structural fill
below the rockery.
2. Structural fill placed in the lower parking lot area
should extend a minimum five (5) feet beyond the front of
the rockery.
After the infiltration system has been installed and back -
filled the lower part of the parking lot may be brought up
to final grades with structural fill. The fill should be
placed as outlined above and extend a minimum five (5)
feet beyond the front of the rockery.

3. Install rockery as specified on Page 2 profiles notes and
details dated 7-24-86.
Upon completion of the placement of structural fill in the
lower parking lot area, the fill should be cut back and
removed as necessary to install rockery and associated
drainage as per the approved plans and specifications.
The above recommendations, if implemented, will greatly reduce and
possibly eliminate any potential impact on the stability of the
rockery from the placement of the parking lot area storm water
infiltration system. These recommendations are presented •within
the scope of the requested investigation and are in accordance with
generally accepted soils and foundation engineering practices. No
other warranties, expressed or implied, are made.
