DATE ISSUED: October 24, 1994 EXPIRATION OF APPEAL PERIOD: November 7, 1994. EFFECTIVE DATE BARRING APPEALS: November 8, 1994 During the month of September, the question of the allowance of ramps and stairs to protrude into required setbacks was raised on several different permits. Since handicapped accessible ramps are not specifically addressed by any portion of the community Development Code the answer, is not clear. In addition, stairs are specifically addressed, and to some degree lprohibited, however, walkways are allowed to be placed in the setback area, and there is no "4 clear definition which describes the difference between walkways and stairs. Therefore an interpretation is necessary to give specific direction as to when or if a handicapped accessible ramp and stairs are allowed to protrude into the setbacks. ECDC 21.90.020 defines "SETBACK" as "the minimum distance that buildings/structures or uses must be set back from a lot line, excluding up to 30 inches of eaves." ECDC 21.90.020 defines "STRUCTURE" as "a combination of materials constructed and erected permanently on the ground or attached to something having permanent location on the ground. Not included are residential fences less than six feet in height, retaining walls, rockeries, and similar improvements of a minor character less than three feet in height." ECDC 16.20.040(C) states that "Uncovered and unenclosed porches, steps, patios, and decks, may project into a required setback not more than one-third of the required setback or four feet, whichever is less, provided that they are no more than 30 inches above the ground." In this case the "ground" is interpreted as the finished grade. UBC section 3306I requires.a minimum handrail height of 34 inches. The community development code does not give specific exceptions or allowances for driveways or walkways to protrude into the required setback. However, the Planning Division Staff has been advised by the City Attorney that to disallow such structures into the setback would be to disallow access to the property. Disallowing access to the property would be a violation of the property owner's rights of use, and would therefore not be legal. INTERPI.DOC The Uniform Building Code allows a 7 inch rise per step for•commercial and multiple family developments, and' an 8 inch rise per step for single family developments. Therefore the following interpretation is made: Uncovered and unenclosed steps, walkways, driveways and other means of property access constructed no higher than eight (8) inches above grade for single family development, and no higher than seven (7) inches above grade for commercial and multiple family development are allowed'to be constructed in the area between the property line and the setback line. Uncovered and unenclosed steps, ramps and other structures which exceed the height as described above, but are not more than 30 inches above the finished grade may protrude into the required setback not more than one-third of the required setback or four feet, whichever is less. Since the required handrail height exceeds the allowable height above the finished grade in all situations, the handrail will be exempt from the height measurement. For the purposes of determining maximum height of handrails, handrails shall be regulated as fences. Uncovered and unenclosed driveways which require retaining walls of a height three (3) feet or higher .will not be allowed to protrude in the required setback.
