The Code does not allow customers to visit the home of a home occupation, and no sale or retail use was foreseen at this site. Neither was dust or noise foreseen. The applicant has a magnetic sign on his car, but he cannot have a sign on his home indicating he has a business there. Mrs. Luster recommended approval as all general Code requirements would be met, there would be no business related traffic to the home, and there would be no employees at the home directly related to the home occupation. The public portion of the hearing was opened, no one wished to speak, and the public portion was closed. Mrs. Stole asked the applicant if there would be a limit on the number of projects he will be working on at one time so that materials and partially com- pleted projects would not be visible to the public or stored around the home. Mrs. Luster advised that the Code requires that all materials must be stored inside. The applicant said he intended installing a. large glass window in the garage to -admit light, so his work would be visible through that window. MRS. STOLE MOVED, SECONDED BY MR. HOVDE. TO APPROVE CU-48-78 AS IT APPEARED IT WOULD NOT ENDANGER THE HEALTH, WELFARE, AND SAFETY OF THE GENERAL PUBLIC AND IT SHOULD NOT BE DETRIMENTAL TO ADJOINING PROPERTIES AS IT WILL BE A LOW KEY TYPE OF BUSINESS. MOTION CARRIED. A short recess was then announced. RICHARD FORD - Variance from required lot width at 77th Ave. W., north side of 203rd St. S.W. (RS-8) This application was in conjunction with a subdivision. It would not amount to a rezone. Because of a 15' easement providing access to the. back lot of the subdivision, the front lot would be short 10' in lot width, the requirement being 70' and the applicant proposing 60'. This proposal would not obstruct any views or endanger the neighborhood, and both lots will exceed the RS-8 square footage requirement. The applicant would not be able to subdivide without the variance, however. firs. Luster felt it was a minimum variance to make for reasonable use of the property by making two buildable lots. All other requirements would be met. She recommended approval because it was a minimum variance to allow for the maximum use of the property, because the shortage was caused by the need for access to the rear lot, and because a safety problem would not be created. The public portion of the hearing was opened. The applicant said the northwest corner of Lot l had been revised to cut off the corner and make accessibility to Lot 2 easier. The public portion of the hearing was closed. Mr. Roy felt it appeared to be a reasonable request. Mrs. Stole commented that since the 15' will be used as a driveway, and therefore retain open space, she felt it would be acceptable, but she would have objected if there were to be a building there. fir. Hovde agreed. MR. LERAAS MOVED, SECONDED BY MR. HOVDE, TO APPROVE V-91-78 AS IT APPEARED TO BE A MINIMUM VARIANCE TO ALLOW MAXIMUM USE OF THE PROPERTY, AND IF THE PROPERTY WERE NOT SUBDIVIDED AT THIS TIME IT MIGHT BECOME LANDLOCKED AT A LATER DATE. 'HE DID NOT FIND IT TO BE DETRIMENTAL TO THE HEALTH, WELFARE, AND SAFETY OF THE SURROUNDING PROPERTIES. MOTION CARRIED. BEN HOLT - Variance from required front yard setback at 1141 Sea Vista:Pl. RS-12 The Code requires a 25' front yard setback and the applicant was asking for a variance which would vary but would not exceed 4'. The lot has three front yards, which creates a problem in setbacks. The applicant wished to extend his garage by 6' as it currently was too short to be able to park cars and close the garage doors. Because of the curve of the property at the location of the garage the maximum variance would be 4' and it would vary, depending on the curve of the property. Mrs. Luster felt it was aminimum variance to make more reasonable use of an existing garage, it would not obstruct views or create a traffic hazard, and a special problem was created by the three front yards, so she recommended approval. The public portion of the hearing was opened. The applicant EDMONDS BOARD OF ADJUSTMENT Page 5 - November 15, 1978 V-94-78 V-95-78 said this was his personal residence and he was remodeling the house extensively and would like to have a garage that he could use properly. The public portion of the hearing was closed. Chairman Bailey observed that this appeared to be a•reasonable request and appeared to be a minimum variance. MRS.-DERLETH MOVED, SECONDED BY MRS. STOLE, TO APPROVE V-92-78 BECAUSE THERE WERE,SPECIAL CIRCUMSTANCES APPLYING TO'THIS';PROPERTY IN THAT IT HAD TO MEET THREE FRONT YARD SETBACKS AND.THE'ACTUAL AREA OF THE BUILDING INVOLVED -WAS QUITE MINIMAL, AND FURTHER, THAT T. APPEARED TO BE A REASONABLE USE OF THE LAND. MOTION CARRIED. WILLIAM E. PONSETI - Variance from required side yard setback at 8228 Talbot Rd. (RS-20) This property had been purchased recently by the applicant and at the time of purchase he intended enlarging the master bedroom to accommodate their furnishings. He was unaware at that time that the house did not sit squarely on the lot, and if it had the variance would not be required. A 31-a' variance of the required 172' side yard setback was necessary for the remodel. The addition to the home would not obstruct any views and it would not extend beyond the existing west wall of the house. The house sits above the road level. Mrs. Luster recommended approval because it would not be detrimental to adjoining property by obstructing views or creating a traffic problem, the expansion would not extend beyond the existing west wall, and it was a minimum variance to allow the applicant to make maximum use of his property and existing home. The public portion of the hearing was opened. P. Leslie Bergman of 8202 Talbot Rd. inquired about the expansion and after the applicant explained his intent Mr. Bergman said he had no objections. The public portion of the hearing was closed. MRS. DERLETH MOVED, SECONDED BY MR. LERAAS, THAT V-94-78 BE APPROVED BECAUSE IT APPEARED TO BE A MINIMUM VARIANCE TO ALLOW EXPANSION OF THE BEDROOM AND SEEMED TO BE ENTIRELY REASONABLE, CONSIDERING THE WAY THE HOUSE WAS SET ON THE LAND. FURTHER, THAT IT WOULD NOT OBSTRUCT ANY VIEWS AND THERE WAS ADEQUATE SPACE BETWEEN THE SUBJECT HOUSE AND THE ADJOINING HOUSE. MOTION CARRIED. CASCADE CONSTRUCTION - Variance from required front yard setback at 7609 238th PI.-T.-W. (RS-8) Mrs. Luster said a 25' front yard setback was required, and this property must meet three front yard setbacks. It is located on the corner of 76th/238th/77th and the home must set back 25' from each of those streets. The applicant was proposing to set back 16' from 238 th with the addition of a garage. The required setback from the other streets would be met. The side yard setback in this area is 7z'. The original garage had been enclosed for living space, and Mrs. Luster indicated that the existing house was small so the addition of a garage would not make it appear excessively large. A single car garage could be built without the variance but the owner had two trucks which he wished to park inside. Mrs. Luster recommended approval because it was a minimum variance to allow for the most reasonable use of the land; the addition would not obstruct views or create a traffic hazard; and a setback of 16' still would be provided, making for an adequate setback since the side yard setback requirement in this zone is 73-,'. The public portion of the hearing was opened, no wished to speak, and the public portion was closed. MR. HOVDE MOVED, SECONDED BY MR. HATLENBUHLER, TO APPROVE V-95-78 BECAUSE THE APPLICANT HAD A UNIQUE SITUATION WITH THREE FRONT YARD SETBACK REQUIREMENTS, AND HE FELT GRANTING OF THE VARIANCE WOULD NOT ENDANGER THE HEALTH, WELFARE, AND SAFETY OF THE NEIGHBORHOOD.
