PRESENT ABSENT STAFF PRESENT Chauncey Wight Greg Selvidge Mary Lou Block, Associate Planner David Kinderfather Jack Christofferson Nancy Luster, Planning Technician Warren LaFon Jackie Parrett, Deputy City Clerk Ken Mattson Perry Spanfelner CONTINUED AGENDA ADB-73-78 HARVE HARRISON - Building, site and landscape review of 21-room hotel at 115 2nd Ave. S. (BC) (Continued from July 5, 1978) Mrs. Block said the questions on this proposal were primarily on the elevations. She noted that expansion joints had been added on the elevations. Mr. LaFon said the air conditioning units and windows were his primary objections. Mr. Kinderfather sketched two sample revisions which broke up the flat panels by recessing the windows. Mr. Harrison suggested it might be easier to protrude the windows, still obtaining the same effect. This created a horizontal band. Mr. Kinderfather also suggested changing the proportions on the windows so the side panels are narrower than the middle ones. MR. KINDERFATHER MOVED, SECONDED BY MR. In subsection (a) change the first paragraph to read as follows: (a) General. When, in the opinion of the Building Official, unusual hazard exists or Pq tyke of,ccnstructtion employed re- quires constant inspection, the owner or his agent shall employ a special inspector. Also: Delete (b) through (f) or move to the Appendix where these re- quirements could be made available at the option of the Building Official. Reason: Current requirement is too comprehensive as a mandatory code requirement. More flexibility is suggested by this proposed code change. 306 (a)-77.1 —C.K.C.Mo. t UtC, 1102.77.2—J.G.D.—[F.L. Sub.] Sec. 1102, page 80. Add a new subsection to read as follows: (c) Tenant Separations. When a building or a portion of a building used as a wholesale or retail store is occupied by dif- ferent tenants, such tenant spaces shall be separated from each other by a minimum of a one -hour fire -resistive separation ex- tending from the surface of the floor to the underside of the floor or roof above. EXCEPTIONS: 1. In buildings protected by an approved automatic sprinkler system. 2. In buildings of Type I and II-F.R. construction. Reason: The fire records telling of fires starting in one tenant space and spreading to other spaces due to lack of any fire -resistive separation be- tween them are indicative of the need. The Exception takes care of the super discount stores, where various small areas within the store are oc- cupied by independent merchants, since they would be sprinklered. Sec. 306 (a), page 37. Change to read as follows: (a) Use or Occupancy. No building or structure of Groups A, E, I, H, B or R Occupancy, shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the Building Of- ficial has'issued a Certificate of Occupancy therefor as provided herein. Reason: With the trend in many cities toward requiring occupancy per- mits in older residences when there is a change in ownership or tenant, it becomes imperative that a Certificate of Occupancy be issued for new single-family dwellings. 403.77.1—J.G.D.—[F.L. Sub.] Sec. 403, page 44. Change the definition of "STAGE" to read as follows: STAGE is a partially enclosed portion of an assembly building which is designed or used for the presentation of plays, demonstrations, or other entertainment wherein scenery, drops, or other effects may be installed or used. Reason: The specification for 5 feet between the top of the proscenium opening and the ceiling is obsolete. If a place of assemblage is provided with an area from which entertainment is given and that area has stage equipment, scenery, lighting, etc., it should be protected as is required of a stage. Too many designers, are developing theater stages but cutting off the height to 4 feet 11 inches and then "fly" the scenery horizontally so that they do not have to provide the built-in stage protection. 5.77.1—R.B.W. Secs. 503 through 506, pages 47 through 52. Change the order of the above sections so that in terms of their current order the sequence is: Section 505—Allowable Floor Area to be new Section 503. Section 504—Location on Property remain as Section 504. Section 506—Allowable Area Increase to be new Section 505. Section 503—Mixed Occupancies to be new Section 506. Reason: It is illogical and confusing to all but the most hardened building code user to discuss mixed occupancies prior to the introduction of allowable areas, location on property, and allowable area increases. 508.77.2—J.G.D.—[F.L. Sub.] Sec. 508, page 53. Change to read as follows: Sec. 508. An approved supervised automatic sprinkler system may be accepted as the equivalent to one -hour fire resistance, provided such system is not otherwise required. EXCEPTION: (Remains without change.) Reason: At present the Code permits only the sprinkler system, which is not required to be supervised, to substitute for one -hour construction when one -hour fire -resistive construction is required throughout. It seems reasonable that a supervised sprinkler system should be considered to be e equiva ent to one -hour fire -resistive construction generally. 1102 (a)•77.1—A.I.S.1.—[F.L. Sub.] Sec. 1102 (a), page 80. Add a new paragraph to read as follows: Other provisions of this Code nothwithstanding, a Group B, Division 2, or Group R, Division 1 Occupancy located in the lower stories of a building housing a Group B, Division 3 open parking garage may be classed as a separate and distinct building for the purpose of area limitation, limitation of number of stories and type of construction, when all of the following condi- tions are met: I. The Group B, Division 2 or Group R, Division 1 Occupancy is not less than Type II Fire -resistive Construc- tion, but in no case of a lesser type of construction than that housing the Group B, Division 3 Occupancy. 2. There is at least a Two-hour Occupancy Separation between the Group B, Division 3 Occupancy and all por- tions of the Group B, Division 2, or Group R, Division 1 Occupancy. 3. The maximum building height in feet does not exceed the limits set forth in Table No. 5-13 for the least type of con- struction involved, nor 75 feet. Reason: The need to put shops, offices or residential occupancies in the lower levels of an open-air parking structure is presently not treated in the Code. Numerous examples of this type of construction have been presented. The exposure hazards from open-air parking structures have been documented by surveys and tests to be minimum and do not present a significant hazard to the occupancies below. Conversely, the hazard to the open-air parking structure of noncombustible construction from the occupancies and construction below clearly represents. no more of a hazard than those exposures to combustible construction from enclosed garages now permitt d by,S,0tion-1102 (a)ri 1413.77.1—J.G.D.—[F.L. Sub.] Sec. 1413, page 94. Add a new paragraph to read as follows: A smoke detector shall be installed in the basement of every dwelling. Such detector shall be connected to a sounding device or other detector to provide an alarm which will be audible in the sleeping area. Reason: The Indiana Dunes tests and NFPA investigations have well established the need for an additional detector in multilevel dwellings. Previously, concern has been expressed as to the audibility of a detector located in the basement. Up to about six detectors can now be intercon- nected to sound an alarm in an area remote from the fire -initiating area or the detector can be connected to a remote horn, bell or other sounding device. 15-77.1—C.K.C.Mo. No person shall erect or main- tain any fence or structure for the purpose of injuring the proper- ty of another by obstructing the view, shutting out sunshine, hindering ventilation or causing inconvenience in any manner. ENVIRONMENTAL CHECKLIST WAC 197-10-365 EN VIRON.'4ENTAL CHECKLIST. (1) The form in subsection (2) hereof is the environmental checklist. Agencies may be their option revise the format of this form; however, the language of the questions shall not be changed. The questions appearing in the environmental checklist are ex- clusive, and considerations which do not appear in it or in 14AC 197-10-360 shall riot be used in making a threshold determination. This checklist does. not supersede or void application forms required under any other federal or state statute or local ordinance, but rather is supplementary thereto. (2) Environmental checklist form: Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RC'd, requires all state and local governmental agencies to consider environmental values both for their o,in actions and when licensing private proposals. The Act also requires that an EIS be prepared for all major actions significantly affecting the quality of the environment. The purpose of this checklist 'is to help the agencies involved determine whether or not a proposal is such a major action. Please answer the following questions as completely as you can with the infor- mation presently available to you. !there explanations of your answers are re- quired, or where you believe an explanation would be helpful -to government decision makers, include your explanation in the space provided, or use addi- tional pages if necessary. You should include references to any reports or studies of which you are aware and ,-ihich are relevant to the answers you pro- vide. Complete answers to t.lese questions now !.sill help all agencies involved with your proposal to undertake the required environmental review without unnecessary delay. The follo, ging questions apply to your total proposal, not ,just to the license for which you are currently applying or the proposal for which approval is sought. Your answers should include the impacts which will be caused by your proposal when it is completed, even though completion may not occur until sometime in the future. This will allow all of the agencies which will be involved to complete their environmental revievi now, without duplicating paperwork in the future.
