HAHN DIRECTOR In response to your letter requesting the.vacation of the utility easement on your south property line, our staff has reviewed your request and, at this time, we feel that it would not be in the best interest of the City to vacate the easement. It may be necessary to make improve- ments to the storm sewer or another utility in the near future that may require the use of the.easement. However, you can make a formal -request to have the easement vacated through the Hearing Examiner, which re-. quires an application fee. You must submit your application to the Planning Division. The Hearing Examiner would base his recommendation on staff input and other information he feels is relevant to the matter. After the hearing, the Hearing Examiner would make his recommendation to the City Council; the City Council makes the final determination. We would.be willing to discuss the possibility of re- ducing the width of the easement to 10' from the existing 15 feet, if this will assist you in any.way. MARTIN On June 13, 1985, we received a letter from Mr. Martin requesting the vacation of a drainage easement on the southerly 15 feet of,lot 14 in the Sea Vista Plat. I went to the site to determine if there would be a potential for the use of the easement in the future. I found an established neighborhood with no obvious areas to be developed in the immediate future. Examination of the plat indicated the subject easement was actually a utility easement, rather than a drainage easement as Mr. Martin had stated. This presented the question: will the P.U.D., General Telephone, Viacom, or one of the other utility companys have need for the easement and can we legally vacate the easement with out their consent? Bobby Mills indicated that it may be in the City's best interest to retain the easement, becauses of the proposed work that will be done upstream in the near future. This work has the potential to increase the volume of water in the culvert that drains through the subject area, thereby requiring improvements to the system which may best be accomplished by installing a new system in the easement. Until such time that the other utilities have indicated that they have no need for the easement and the City feels there is no potential projects in the future that would require the use of this easement, I would reccomend that the easement be retained by the City. Regults of our inve:ti- gzation show that tho developer of this plat was requires: to paro,4da adequate drainage easeriants, culvorts, and channel impmvementa to accaT!n:odate natural drainage flowing; through thin tract. These items were provided to the satisfaction of the engineer at the tima of final plat acceptauc e, We realize that this is no solution to you and your neir'Libora' problems .with thin drainage, as occurred durinj� our lout heavy rainfall,. At tho preaennt time, the City will :)e unable to install or cmnntruct a store sewer t.nroug;h this plat. The courts have held that a city is not autaorined to construct a culvert or ditch on private property to keep open or conflue a natural watercourse. ciowever, Uie City is planning, in 'tone future, a street and major storm drainage improvement program for Nint*. Avenue. At that titae, there would be a possibility of the City providing adequate drainage facilities through this area. In tho ;aeantine, we arc, er.ly able to function in an advisory capacity. We have found that the existing 12" culvert the installed alonj the south property line of a portion of Lots 9, 12 and 13 is not adequate to carry a heavy run-off. We would recommend that an 18" diameter the he installed from the catcma :>asin lccdt`d at the southeast corner of Lot 14 to the south- easterly corner of Lot 9; at this paint a catch basin should be located with an entrance the from the open ditch.
